The Special Court of Appeal for Corruption and Organized Crime has released Erzen Breçan, who was arrested as part of the “Metamorphosis” operation, from his cell.
The appeal has changed the security measure for Breçan, assigning “house arrest”.
DECISION OF THE SPECIAL APPEAL COURT FOR CORRUPTION AND ORGANIZED CRIME
The Special Court of Appeal for Corruption and Organized Crime, with a monocratic panel composed of judge Engert Pëllumbi, today on 16.07.2024, announced the decision on criminal case no. 158 act, date 12.07.2024 registration, on the appeal of the person under investigation E.B., with object: “Appeal against decision no. 76, dated 30.05.2024 of the Special Court of First Instance for Corruption and Organized Crime”, disposed of in the case of personal security measures, and decided:
The change of decision no. 76, dated 30.05.2024 of the Special Court of First Instance for Corruption and Organized Crime, as follows:
– Acceptance of the request; the replacement of the security measure “Arrest in prison”, provided by article 238 of the Penal Code, assigned to the person under investigation E.B., with decision no. 124., dated 17.11.2023 of the Special Court of First Instance for Corruption and Organized Crime, verified by decision no. 128, dated 23.11.2023, of this court and approved by decision no. 87-2024-4 (1), dated 04.01.2024 of the Special Court of Appeal for Corruption and Organized Crime, with the security measure “House arrest”, provided by Article 237 of this code.
– It is ordered to release the person under investigation E.B., from the detention facilities, if he is not kept in isolation for any other reason.
– The person under investigation E.B. is ordered not to leave his apartment located at the address ***, and not to communicate with other people, except for those who live in the same apartment.
– The Special Prosecutor’s Office against Corruption and Organized Crime, as well as the relevant judicial police services, are charged with the implementation of this decision.
– Against this decision, an appeal can be made to the Supreme Court within 45 days from the day after its announcement.
