The Democratic Party of Re-establishment has requested the dismissal of the judge of the Constitutional Court, Marsida Xhaferllari, since, as stated in the request addressed to the President of the Court, Holta Xhaçe, Xhaferllari is in a conflict of interest.
The request was made by Adriana Kalaja, Chairperson of the Statute Appeal and Evaluation Committee at the Democratic Party and Lawyer at the Tirana Bar Association.
“I request the dismissal of the judge of the Constitutional Court of the Republic of Albania, Marsida Xhaferllari, from the case dated 18.01.2024 at 10.00, requested by 30 deputies of the Democratic Party, due to the conflict of interest that this judge has with the group of deputies of the Democratic Party , directed by Gazment Bardhi, in the capacity of petitioners in this case,” the request states.
The request also explains the reasons why the exemption is requested:
1) The procedural rules provided by the law for waiving cases where the petitioner was her cohabitant have been avoided/indisputably violated.
2) The procedural rules provided by the law were undeniably avoided/violated, for participating in a case, her cohabitant expressed an opinion and voted.
3) The procedural rules provided by the law, for waiving cases where the petitioner was her cohabitant, were indisputably avoided/violated, but it was more seriously violated by being the relators of the case.
4) The procedural rules provided by the law were indisputably violated, by participating in the celebrations of a political group where her co-habitant is a member.
5) It has significantly reduced public confidence in the Constitutional Court.
6) It has significantly reduced public confidence in the Justice System.
