The Tirana court has announced the verdict in the Tire Alldervishi scandal, the black squads have declared the other suspects innocent, except for Tire Alldervishi.
Tire Alldervishi was sentenced to 22 months of probation, after taking 8 million lek from a Covid patient in exchange for service.
The “Tire” scandal was first published in an investigative show and through videotaping it was revealed that she was introducing herself as a nurse to the families of patients who were hospitalized at Shefqet Ndroqi Hospital, taking money in search of service.
“Tire” was also filmed by a girl from whom he managed to extort about 8 million lek, promising to take care of her mother who was with Covid-19, but the patient died.
The notice states that it has been decided:
1. Changing the legal qualification of the criminal fact against the defendant T. A., and declaring her guilty of the criminal offense “Fraud”, provided for by Article 143/1 of the Criminal Code, and based on this provision sentencing her to 4 (four) years of imprisonment.
2. The execution of this sentence begins on the day of her detention, carried out on 12.01.2021, for the account of this criminal proceeding.
3. In application of Article 59 of the Criminal Code, the Court orders the suspension of the execution of the prison sentence, for the remaining unserved part of this criminal sentence (specifically 11 months), and placing the defendant on probation for a period of 22 months, provided that during the probation period, the defendant does not commit any other criminal offense.
4. In application of Article 60/9 of the Criminal Code, the defendant is ordered not to accompany convicted persons.
5. In application of Article 61 of the Criminal Code, the defendant is obliged to maintain continuous and systematic contact with the Probation Service Office, implementing the conditions and obligations set by the Court.
6. In application of Article 61 of the Criminal Code, the defendant is obliged to obtain the consent of the Probation Service Office for changes of residence, for movements abroad, as well as frequent ones within the country.
7. The probation period begins from the day after this decision becomes final.
8. A copy of this decision is immediately officially communicated to the Prosecutor’s Office at the Court of First Instance of General Jurisdiction in Tirana, as well as to the Probation Service Office, Tirana.
9. Not guilty plea for the defendant M. B., for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
10. Not guilty plea for the defendant Sheqerije Koçi, for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
11. Not guilty plea for the defendant Sidorela Çela, for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
12. Not guilty plea for the defendant Erjola Jazxhi, for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
13. Not guilty plea for the defendant Gylbra Halilaj, for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
14. Not guilty plea for the defendant Rukije Hoxhaj, for the criminal offense of “Fraud” provided for in Articles 143/2/3 – 25 of the Criminal Code and “Abuse of office”, provided for in Articles 248 and 25 of the Criminal Code.
15. The procedural costs during the investigation phase and the court costs are partly borne by the defendant T.A., and partly borne by the prosecution body.
16. An appeal against this decision is allowed at the Court of Appeal of General Jurisdiction of Tirana, within 15 (fifteen) days, starting this deadline from the day after the communication of this reasoned decision.
