Meta k\u00ebrkon rishikimin dhe p\u00ebrmir\u00ebsimin e neneve 3, 6, 7 dhe 11, q\u00eb kan\u00eb ndryshuar, apo shtuar nenet 121, 201, 201\/b, si dhe 207\/a t\u00eb Kodit Penal, sipas arsyetimit bashk\u00eblidhur k\u00ebtij dekreti. N\u00eb arsyetimin bashk\u00ebngjitur dekretit t\u00eb kthimit t\u00eb ligjit, Presidenti shprehet se ky ligj i paraqitur p\u00ebr shpallje n\u00eb p\u00ebrgjith\u00ebsi \u00ebsht\u00eb nj\u00eb akt ligjor me tendenc\u00eb pozitive, pasi p\u00ebr disa \u00e7\u00ebshtje, dispozitat aktuale t\u00eb Kodit Penal nuk garantojn\u00eb parandalimin apo nd\u00ebshkimin e duhur t\u00eb disa veprimeve apo mosveprimeve negative q\u00eb jan\u00eb shfaqur n\u00eb shoq\u00ebri, p\u00ebr t\u00eb cilat \u00ebsht\u00eb e nevojshme parashikimi i tyre si vepra penale, apo p\u00ebr disa t\u00eb tjera vler\u00ebsohet e nevojshme forcimi i nd\u00ebshkimit penal.<\/em><\/p>\n<p>Nga ana tjet\u00ebr, -thuhet n\u00eb arsyetim- gjat\u00eb shqyrtimit u konstatua se disa dispozita t\u00eb ve\u00e7anta t\u00eb ligjit nr. 44\/2019 dhe konkretisht nenet 3, 6, 7 dhe 11, q\u00eb kan\u00eb ndryshuar, apo shtuar nenet 121, 201, 201\/b, si dhe 207\/a t\u00eb Kodit Penal, paraqesin paqart\u00ebsi n\u00eb formulimin e disa paragraf\u00ebve t\u00eb tyre; nuk jan\u00eb n\u00eb harmoni apo n\u00eb ndonj\u00eb rast mbivendosen me parashikime t\u00eb tjera t\u00eb Kodit Penal, shkaqe k\u00ebto, q\u00eb mund t\u00eb sjellin zbatim t\u00eb gabuar n\u00eb praktik\u00eb apo keqinterpretim me pasoj\u00eb cenimin e parimeve kushtetuese dhe t\u00eb siguris\u00eb juridike.<\/p>\n<p><em>\u201cDuke pasur parasysh se Gjykata e Lart\u00eb, q\u00eb \u00ebsht\u00eb e ngarkuar p\u00ebr unifikimin apo edhe interpretimin e p\u00ebrdorimit t\u00eb normave ligjore, prej disa muajsh nuk \u00ebsht\u00eb funksionale dhe askush nuk mundet t\u00eb parashikoj\u00eb sot se kur do t\u00eb plot\u00ebsohet kjo trup\u00eb gjyq\u00ebsore me numrin e nevojsh\u00ebm t\u00eb gjyqtar\u00ebve q\u00eb mund t\u00eb b\u00ebjn\u00eb unifikimin e praktik\u00ebs gjyq\u00ebsore n\u00eb procesin penal, vler\u00ebsohet se nuk do t\u00eb jet\u00eb e mundur kryerja e analiz\u00ebs gjithp\u00ebrfshir\u00ebse t\u00eb ndryshimeve dhe efekteve q\u00eb mund t\u00eb ken\u00eb ndryshimet e propozuara mbi efektivitetin n\u00eb sistemin e drejt\u00ebsis\u00eb penale. Pra, n\u00eb k\u00ebto kushte ku ndodhet vendi, pa Gjykat\u00eb t\u00eb Lart\u00eb dhe Gjykat\u00eb Kushtetuese funksionale, i takon Kuvendit t\u00eb Shqip\u00ebris\u00eb q\u00eb t\u00eb tregoj\u00eb kujdesin maksimal gjat\u00eb hartimit dhe miratimit t\u00eb dispozitave t\u00eb reja n\u00eb Kodin Penal, q\u00eb krijojn\u00eb figura t\u00eb reja t\u00eb veprave penale, pasi kriminalizimi i sjelljeve apo veprimeve n\u00eb figura krimi, nd\u00ebrkoh\u00eb q\u00eb ende nuk \u00ebsht\u00eb funksionale trupa gjyq\u00ebsore q\u00eb mund t\u00eb b\u00ebj\u00eb unifikimin e praktik\u00ebs gjyq\u00ebsore n\u00eb k\u00ebt\u00eb drejtim mund t\u00eb sjell\u00eb si rezultat aplikim t\u00eb ndrysh\u00ebm t\u00eb norm\u00ebs n\u00eb praktik\u00eb, duke krijuar rrezik p\u00ebr cenim t\u00eb parimit t\u00eb siguris\u00eb juridike t\u00eb shtetasve apo d\u00ebnimin pa ligj\u201d, deklaron Presidenti Meta.<\/em><\/p>\n<p>Presidenti Meta dekreton kthimin p\u00ebr rishqyrtim n\u00eb Kuvend t\u00eb ligjit \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb Kodin Penal\u201d<\/p>\n<p>Institucioni i Presidentit t\u00eb Republik\u00ebs b\u00ebn me dije se, Presidenti i Republik\u00ebs Sh.T.Z Ilir Meta n\u00eb ushtrim t\u00eb kompetencave t\u00eb Tij, n\u00eb mb\u00ebshtetje t\u00eb neneve 85, pika 1 dhe 93, t\u00eb Kushtetut\u00ebs:<\/p>\n<p>I. Me Dekretin nr. 11248, dat\u00eb 05.08.2019, ka vendosur: \u201cKthimin p\u00ebr rishqyrtim n\u00eb Kuvend t\u00eb ligjit nr. 44\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 7895, dat\u00eb 27.1.1995, \u2018Kodi Penal i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u2019, t\u00eb ndryshuar\u201d\u2019, me q\u00ebllim rishikimin dhe p\u00ebrmir\u00ebsimin e neneve 3, 6, 7 dhe 11, q\u00eb kan\u00eb ndryshuar, apo shtuar nenet 121, 201, 201\/b, si dhe 207\/a t\u00eb Kodit Penal, sipas arsyetimit bashk\u00eblidhur k\u00ebtij dekreti;<\/p>\n<p>Arsyet kryesore t\u00eb kthimit t\u00eb k\u00ebtij ligji paraqiten si m\u00eb posht\u00eb :<br \/>\nPresidenti vler\u00ebsoi p\u00ebrputhshm\u00ebrin\u00eb e ligjit nr. 44\/\/2019, n\u00eb raport me Kushtetut\u00ebn, me kuadrin ligjor n\u00eb fuqi, dhe n\u00eb p\u00ebrfundim t\u00eb shqyrtimit, \u00e7mon se ky ligj i paraqitur p\u00ebr shpallje n\u00eb p\u00ebrgjith\u00ebsi \u00ebsht\u00eb nj\u00eb akt ligjor me tendenc\u00eb pozitive, pasi p\u00ebr disa \u00e7\u00ebshtje, dispozitat aktuale t\u00eb Kodit Penal nuk garantojn\u00eb parandalimin apo nd\u00ebshkimin e duhur t\u00eb disa veprimeve apo mosveprimeve negative q\u00eb jan\u00eb shfaqur n\u00eb shoq\u00ebri, p\u00ebr t\u00eb cilat \u00ebsht\u00eb e nevojshme parashikimi i tyre si vepra penale, apo p\u00ebr disa t\u00eb tjera vler\u00ebsohet e nevojshme forcimi i nd\u00ebshkimit penal.<\/p>\n<p>Nga ana tjet\u00ebr, gjat\u00eb shqyrtimit u konstatua se disa dispozita t\u00eb ve\u00e7anta t\u00eb ligjit nr. 44\/2019 dhe konkretisht nenet 3, 6, 7 dhe 11, q\u00eb kan\u00eb ndryshuar, apo shtuar nenet 121, 201, 201\/b, si dhe 207\/a t\u00eb Kodit Penal, paraqesin paqart\u00ebsi n\u00eb formulimin e disa paragraf\u00ebve t\u00eb tyre; nuk jan\u00eb n\u00eb harmoni apo n\u00eb ndonj\u00eb rast mbivendosen me parashikime t\u00eb tjera t\u00eb Kodit Penal, shkaqe k\u00ebto, q\u00eb mund t\u00eb sjellin zbatim t\u00eb gabuar n\u00eb praktik\u00eb apo keqinterpretim me pasoj\u00eb cenimin e parimeve kushtetuese dhe t\u00eb siguris\u00eb juridike.<\/p>\n<p>Nga shqyrtimi konstatohet se formulimet e disa dispozitave t\u00eb Kodit Penal q\u00eb ndryshohen n\u00ebp\u00ebrmjet neneve 3, 6, 7 dhe 11, t\u00eb ligjit nr. 44\/2019, p\u00ebrmbajn\u00eb problematika q\u00eb c\u00ebnojn\u00eb parimin e zbatimit efektivitetit t\u00eb norm\u00ebs, duke rrezikuar aplikimin dhe interpretimin n\u00eb praktik\u00eb t\u00eb tyre, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb qart\u00ebsis\u00eb, \u00e7ka do t\u00eb k\u00ebrkonte shum\u00eb shpejt ose amendim t\u00eb tyre, ose do t\u00eb b\u00ebnte t\u00eb nevojshme sqarimin e tyre nga jurisprudenca.<\/p>\n<p>Duke pasur parasysh se Gjykata e Lart\u00eb, q\u00eb \u00ebsht\u00eb e ngarkuar p\u00ebr unifikimin apo edhe interpretimin e p\u00ebrdorimit t\u00eb normave ligjore, prej disa muajsh nuk \u00ebsht\u00eb funksionale dhe askush nuk mundet t\u00eb parashikoj\u00eb sot se kur do t\u00eb plot\u00ebsohet kjo trup\u00eb gjyq\u00ebsore me numrin e nevojsh\u00ebm t\u00eb gjyqtar\u00ebve q\u00eb mund t\u00eb b\u00ebjn\u00eb unifikimin e praktik\u00ebs gjyq\u00ebsore n\u00eb procesin penal, vler\u00ebsohet se nuk do t\u00eb jet\u00eb e mundur kryerja e analiz\u00ebs gjithp\u00ebrfshir\u00ebse t\u00eb ndryshimeve dhe efekteve q\u00eb mund t\u00eb ken\u00eb ndryshimet e propozuara mbi efektivitetin n\u00eb sistemin e drejt\u00ebsis\u00eb penale.<\/p>\n<p>Pra, n\u00eb k\u00ebto kushte ku ndodhet vendi, pa Gjykat\u00eb t\u00eb Lart\u00eb dhe Gjykat\u00eb Kushtetuese funksionale, i takon Kuvendit t\u00eb Shqip\u00ebris\u00eb q\u00eb t\u00eb tregoj\u00eb kujdesin maksimal gjat\u00eb hartimit dhe miratimit t\u00eb dispozitave t\u00eb reja n\u00eb Kodin Penal, q\u00eb krijojn\u00eb figura t\u00eb reja t\u00eb veprave penale, pasi kriminalizimi i sjelljeve apo veprimeve n\u00eb figura krimi, nd\u00ebrkoh\u00eb q\u00eb ende nuk \u00ebsht\u00eb funksionale trupa gjyq\u00ebsore q\u00eb mund t\u00eb b\u00ebj\u00eb unifikimin e praktik\u00ebs gjyq\u00ebsore n\u00eb k\u00ebt\u00eb drejtim mund t\u00eb sjell\u00eb si rezultat aplikim t\u00eb ndrysh\u00ebm t\u00eb norm\u00ebs n\u00eb praktik\u00eb, duke krijuar rrezik p\u00ebr cenim t\u00eb parimit t\u00eb siguris\u00eb juridike t\u00eb shtetasve apo d\u00ebnimin pa ligj.<\/p>\n<p>Konkretisht, jan\u00eb v\u00ebrejtur problematika dhe mang\u00ebsi n\u00eb disa dispozita t\u00eb tij, si m\u00eb posht\u00eb:<\/p>\n<p>1. Neni 3 i ligjit 44\/2019, q\u00eb synon ndryshimin e nenit 121 t\u00eb Kodit Penal, q\u00eb parashikon vepr\u00ebn penale t\u00eb nd\u00ebrhyrjeve t\u00eb padrejta n\u00eb jet\u00ebn private, krijon mbivendosje me dispozitat e tjera t\u00eb Kodit Penal dhe nuk \u00ebsht\u00eb n\u00eb harmoni me parashikimet e Kodit t\u00eb Procedur\u00ebs Penale.<\/p>\n<p>Nga shqyrtimi i praktik\u00ebs shoq\u00ebruese t\u00eb projektligjit, relacionit shoq\u00ebrues apo raportit t\u00eb komisioneve p\u00ebrgjegj\u00ebse, nuk p\u00ebrcaktohet asnj\u00eb arsye e mb\u00ebshtetur n\u00eb t\u00eb dh\u00ebna konkrete, q\u00eb ka diktuar nevoj\u00ebn e amendimit t\u00eb k\u00ebsaj dispozite t\u00eb Kodit.<\/p>\n<p>Paragrafi i kat\u00ebrt i nenit 121 t\u00eb Kodit Penal sipas ndryshimeve t\u00eb miratuara me ligjin nr.44\/2019, k\u00ebrkon patjet\u00ebr p\u00ebrmir\u00ebsim sepse ka shum\u00eb paqart\u00ebsi n\u00eb lidhje me subjektin e vepr\u00ebs penale.<\/p>\n<p>Gjithashtu ky paragraf duhet riformuluar dhe qart\u00ebsuar, edhe n\u00ebn drit\u00ebn e faktit se duhet b\u00ebr\u00eb nj\u00eb dallim edhe m\u00eb i fort\u00eb me subjektin e vepr\u00ebs penale sipas parashikimeve t\u00eb k\u00ebtij neni t\u00eb sapomiratuar, me at\u00eb t\u00eb nenit pasardh\u00ebs, (neni 122), q\u00eb n\u00ebnkupton nj\u00eb kategori tjet\u00ebr funksionar\u00ebsh shtet\u00ebror\u00eb apo publik, q\u00eb p\u00ebr shkak t\u00eb detyr\u00ebs disponojn\u00eb k\u00ebto t\u00eb dh\u00ebna (Punonj\u00ebsit e Sh\u00ebrbimeve Inteligjente, Polici, OPGJ, Prokurori, etj).<\/p>\n<p>Gjithashtu, nj\u00eb tjet\u00ebr arsye se p\u00ebrse paragrafi i kat\u00ebrt i shtuar ka paqart\u00ebsi, \u00ebsht\u00eb fakti se ai nuk p\u00ebrcakton qart\u00eb n\u00ebse nd\u00ebshkohen ose jo n\u00eb k\u00ebt\u00eb rast ato veprime q\u00eb parashikon po e nj\u00ebjta dispozit\u00eb n\u00eb paragrafin e par\u00eb, ku parashikohet se: \u201cvendosja e aparaturave q\u00eb sh\u00ebrbejn\u00eb p\u00ebr d\u00ebgjim apo regjistrim, d\u00ebgjimi ose regjistrimi i fjal\u00ebve, fiksimi ose regjistrimi i figurave si dhe ruajtja p\u00ebr publikim i t\u00eb dh\u00ebnave\u201d, apo vet\u00ebm \u201cshp\u00ebrndarja ofrimi p\u00ebr publikim apo publikimi\u201d.<\/p>\n<p>N\u00ebse paragrafi i fundit i referohet kryerjes s\u00eb vepr\u00ebs penale me m\u00ebnyrat e p\u00ebrcaktuara n\u00eb paragrafin e par\u00eb t\u00eb nenit t\u00eb amenduar, ateher\u00eb sipas paragrafit t\u00eb kat\u00ebrt t\u00eb po k\u00ebtij neni jemi para rastit klasik, kur mund t\u00eb krijohen keqkuptime p\u00ebr zbatimin e k\u00ebsaj dispozite ndaj shtetasve q\u00eb kan\u00eb p\u00ebr detyr\u00eb vendosjen e aparaturave dhe regjistrimin e fjal\u00ebve, fiksimin e tyre, sipas autorizimit t\u00eb posa\u00e7\u00ebm t\u00eb marr\u00eb n\u00eb p\u00ebrputhje me legjislacionin n\u00eb fuqi p\u00ebr k\u00ebt\u00eb q\u00ebllim.<\/p>\n<p>N\u00eb k\u00ebto raste, do duhej t\u00eb ishte identifikuar qart\u00eb q\u00ebllimi n\u00eb kryerjen e vepr\u00ebs penale t\u00eb sanksionar n\u00eb paragrafin e fundit, \u00e7ka nuk \u00ebsht\u00eb b\u00ebr\u00eb dhe l\u00eb vend p\u00ebr keqp\u00ebrdorim t\u00eb k\u00ebtij parashikimi.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, parashikimet e nenit 3 t\u00eb ligjit nr. 44\/2019, duhet analizuar edhe n\u00eb raport me nenin 59 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale, sepse neni 121 t\u00eb Kodit Penal, si\u00e7 \u00ebsht\u00eb aktualisht i pandryshuar, hyn n\u00eb grupin e atyre veprave penale q\u00eb ndiqet nga vet\u00eb viktima akuzuese e d\u00ebmtuar nga kryerja e vepr\u00ebs penale drejtp\u00ebrdrejt n\u00eb gjykat\u00eb.<\/p>\n<p>Me shtimin e paragraf\u00ebve n\u00eb nenin 121 t\u00eb Kodit Penal parashikohet nj\u00ebkoh\u00ebsisht rritja e rrezikshm\u00ebris\u00eb shoq\u00ebrore.<\/p>\n<p>N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb \u00ebsht\u00eb e nevojshm\u00eb q\u00eb t\u00eb b\u00ebhet edhe ndryshimi i nenit 59 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale, p\u00ebr t\u00eb sakt\u00ebsuar n\u00ebse dhe p\u00ebr cilin prej k\u00ebtyre paragraf\u00ebve ndjekja penale do t\u00eb ushtrohet nga vet\u00eb viktima akuzuese apo nga prokurori.<\/p>\n<p>2. Neni 6 i ligjit nr. 44\/2019, q\u00eb ndryshon nenin 201 t\u00eb Kodit Penal, n\u00eb paragraf\u00ebt 2-5 p\u00ebrmban shprehje abstrakte, p\u00ebrdorimi i t\u00eb cilave jo vet\u00ebm e b\u00ebn t\u00eb pamundur zbatimin k\u00ebtyre paragraf\u00ebve n\u00eb praktik\u00eb, por krijon rrezik q\u00eb t\u00eb sjell\u00eb nj\u00eb precedent n\u00eb ushtrimin e ndjekjes penale apo dh\u00ebnien e d\u00ebnimeve n\u00eb m\u00ebnyr\u00eb jo proporcionale.<\/p>\n<p>P\u00ebrmir\u00ebsimi i nenit 201 t\u00eb Kodit Penal, \u00ebsht\u00eb tejet i mir\u00ebpritur nga t\u00eb gjith\u00eb, por n\u00eb k\u00ebt\u00eb dispozit\u00eb t\u00eb re t\u00eb riformuluar n\u00eb 4 paragraf\u00ebt e saj (paragrafi 2-5), paraqet problematike, sa i p\u00ebrket m\u00ebnyr\u00ebs se si ajo \u00ebsht\u00eb nd\u00ebrtuar nga ana gjuh\u00ebsore, ku rezulton se rrethana e cil\u00ebsuar e kryerjes s\u00eb vepr\u00ebs penale, q\u00eb sjell si rezultat rritjen e mas\u00ebs s\u00eb d\u00ebnimit rezulton t\u00eb jet\u00eb p\u00ebrcaktuar me shprehje t\u00eb pap\u00ebrshtatshme p\u00ebr q\u00ebllimin p\u00ebr t\u00eb cilin k\u00ebto dispozita jan\u00eb hartuar.<\/p>\n<p>N\u00eb t\u00eb kat\u00ebrt paragraf\u00ebt e fundit t\u00eb k\u00ebtij neni, p\u00ebrdoret togfjal\u00ebshi \u201cose ka mund\u00ebsi t\u00eb shkaktoj\u00eb\u201d.<br \/>\nKuptimi i rrethanave t\u00eb cil\u00ebsuara n\u00eb nj\u00eb figur\u00eb krimi n\u00eb vetvete, \u00ebsht\u00eb p\u00ebrcaktimi i veprimeve apo kushteve, v\u00ebrtetimi i t\u00eb cilave k\u00ebrkon nj\u00eb mas\u00eb m\u00eb t\u00eb r\u00ebnd\u00eb nd\u00ebshkimi.<\/p>\n<p>L\u00ebnia e hap\u00ebsirave abstraguese n\u00eb dispozit\u00eb dhe formulimi jo i sakt\u00eb sa i takon teknik\u00ebs legjislative, \u00ebsht\u00eb nj\u00eb mund\u00ebsi e hapur p\u00ebr keqinterpretim dhe abuzim n\u00eb praktik\u00eb.<\/p>\n<p>P\u00ebrdorimi i togfjal\u00ebshit \u201cka mund\u00ebsi t\u00eb shkaktoj\u00eb\u201d, jo vet\u00ebm q\u00eb e b\u00ebn t\u00eb pamundur zbatimin, por edhe rrezikon q\u00eb n\u00eb praktik\u00eb t\u00eb sjell\u00eb nj\u00eb precedent t\u00eb rreziksh\u00ebm n\u00eb ushtrimin e ndekjes penale apo dh\u00ebnien e d\u00ebnimeve n\u00eb m\u00ebnyr\u00eb joproporcionale. Parashikime ligjore me shprehje abstraguese mbi \u201cpasoj\u00ebn q\u00eb mund t\u00eb vinte\u201d, n\u00eb nj\u00eb dispozit\u00eb penale \u00ebsht\u00eb nj\u00eb hap\u00ebsir\u00eb shum\u00eb e madhe, p\u00ebr keqintepretim dhe abuzim n\u00eb praktik\u00eb.<\/p>\n<p>3. Neni 7 t\u00eb ligjit 44\/2019, i cili parashikon shtimin e nj\u00eb figure t\u00eb re t\u00eb vepr\u00ebs penale, at\u00eb t\u00eb transportimit t\u00eb mbetjeve, \u00ebsht\u00eb i paqart\u00eb n\u00eb m\u00ebnyr\u00ebn se si \u00ebsht\u00eb miratuar dhe e b\u00ebn aplikimin e k\u00ebsaj dispozite t\u00eb v\u00ebshtir\u00eb nga ana praktike.<br \/>\nP\u00ebrpos k\u00ebsaj nga ky shqyrtim i ligjit konstatohet se n\u00eb asnj\u00eb prej k\u00ebtyre veprave nuk \u00ebsht\u00eb p\u00ebrcaktuar si rrethan\u00eb e cil\u00ebsuar kryerja e tyre n\u00eb bashk\u00ebpunim apo p\u00ebrs\u00ebritja e saj.<\/p>\n<p>4. Neni 11 t\u00eb ligjit 44\/2019, ku parashikohet shtimi i nenit 207\/a t\u00eb shtuar dhe sanksionohet si vep\u00ebr penale braktisja e kafsh\u00ebs s\u00eb shoq\u00ebrimit, nuk rezulton t\u00eb jet\u00eb p\u00ebrcaktuar subjekti i vepr\u00ebs penale dhe formulimi i saj paraqet paqart\u00ebsi q\u00eb v\u00ebshtir\u00ebsojn\u00eb aplikimin e saj n\u00eb praktik\u00eb<\/p>\n<p>Kjo dispozit\u00eb ve\u00e7 t\u00eb tjerash ka paqart\u00ebsi dhe \u00ebsht\u00eb formuluar jo mir\u00eb sa i takon teknik\u00ebs legjislative, pasi para s\u00eb gjithash nuk p\u00ebrcakton sakt\u00eb as subjektin e vepr\u00ebs penale.<br \/>\nKjo dispozit\u00eb e re penale nuk rregullon situat\u00ebn ku pasoja n\u00eb sh\u00ebndetin e nj\u00eb personi, plagosja e r\u00ebnd\u00eb nga kafsha mund t\u00eb ndodh n\u00eb banes\u00ebn e pronarit t\u00eb kafsh\u00ebs. Pra sipas dispozit\u00ebs s\u00eb miratuar n\u00ebse ndodh n\u00eb k\u00ebt\u00eb ambient, duket se nuk kemi braktisje dhe normalisht, as dhe p\u00ebrgjegj\u00ebsi penale.<\/p>\n<p>Presidenti i Republik\u00ebs, ka vler\u00ebsuar se nj\u00eb pjes\u00eb e dispozitave t\u00eb m\u00ebsip\u00ebrme nuk mund t\u00eb jen\u00eb plot\u00ebsisht efikase si nj\u00eb burim p\u00ebr t\u00eb luftuar sjelljen e pad\u00ebshirueshme shoq\u00ebrore q\u00eb mund t\u00eb lindin sipas veprave penale t\u00eb propozuara p\u00ebr t\u2019u ndryshuar, sepse n\u00eb m\u00ebnyr\u00ebn se si nj\u00eb pjes\u00eb e k\u00ebtyre dispozitave jan\u00eb miratuar \u00ebsht\u00eb e pashmangshme q\u00eb ato do t\u00eb hasin pengesa n\u00eb praktik\u00eb, pik\u00ebrisht p\u00ebr shkak t\u00eb paqart\u00ebsis\u00eb dhe ambiguitetit (dykuptim\u00ebsis\u00eb) s\u00eb tyre.<\/p>\n<p>K\u00ebshtu, n\u00ebse do t\u00eb kemi n\u00eb praktik\u00eb dispozita t\u00eb paqarta ose t\u00eb paorientuara mir\u00eb rrezikohet t\u00eb aplikohen n\u00eb m\u00ebnyr\u00eb t\u00eb gabuar duke cenuar parimin e siguris\u00eb juridike, ku n\u00eb vend q\u00eb t\u00eb adresojm\u00eb sakt\u00eb problematik\u00ebn dhe aktin e d\u00ebnuesh\u00ebm, do t\u00eb krijohet edhe m\u00eb shum\u00eb paqart\u00ebsi n\u00eb trajtimin e fenomemeve p\u00ebrgjat\u00eb aplikimit n\u00eb praktik\u00eb t\u00eb k\u00ebtyre normave penale.<\/p>\n<p>N\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1, t\u00eb nenit 85 t\u00eb saj, Presidenti ka vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr. 44\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 7895, dat\u00eb 27.1.1995, \u2018Kodi Penal i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u2019, t\u00eb ndryshuar\u201d, me q\u00ebllimin q\u00eb Kuvendi t\u00eb p\u00ebrmir\u00ebsoj\u00eb nenet 3, 6, 7 dhe 11, q\u00eb kan\u00eb ndryshuar, apo shtuar nenet 121, 201, 201\/b, si dhe 207\/a t\u00eb Kodit Penal.<br \/>\nDekreti dhe arsyet e detajuara mbi k\u00ebt\u00eb vendimarrje gjenden t\u00eb publikuara n\u00eb faqen zyrtare t\u00eb Institucionit t\u00eb Presidentit t\u00eb Republik\u00ebs.<\/p>","protected":false},"excerpt":{"rendered":"<p>Presidenti i Republik\u00ebs Ilir Meta i ka kthyer maxhoranc\u00ebs nj\u00eb tjet\u00ebr ligj t\u00eb r\u00ebnd\u00ebsish\u00ebm.
