B\u00ebhet fjal\u00eb p\u00ebr \u00a0disa ndryshime dhe shtesa n\u00eb ligjin \u2018P\u00ebr koncesionet dhe PPP\u201d.<\/p>\n<p>Dit\u00ebn e djeshme, kreu i shtetit\u00a0 ktheu disa ligje p\u00ebr Kodin Penal me argumentimin se jan\u00eb t\u00eb paqarta dhe p\u00ebrb\u00ebjn\u00eb rrezik juridik p\u00ebr jet\u00ebn e qytetar\u00ebve. Kjo u kund\u00ebrshtua hapur nga numri dy i Partis\u00eb Socialiste, Taulant Balla, i cili e etiketoi Met\u00ebn si t\u00eb rreshtuar n\u00eb krah t\u00eb abuzuesve.<\/p>\n<p>N\u00eb p\u00ebrgjigje te akuzave t\u00eb kreut t\u00eb grupit parlamentar\u00a0 n\u00eb Partin\u00eb Socialiste, Taulant Ball\u00ebs, z\u00ebdh\u00ebn\u00ebsi i Presidenti Meta, Tedi Blushi tha se sulmet e Ball\u00ebs nuk kan\u00eb fare lidhje me projektligjin e kthyer dje nga Meta, por shqet\u00ebsimi i tij lidhet me ligjin e kthyer sot p\u00ebr Koncesionet dhe Partneritetin Publik Privat, e njohur ndryshe si praktika e PPP-ve.<\/p>\n<p><strong>\u00a0Njoftimi i plot\u00eb:<\/strong><\/p>\n<p><strong>Presidenti Meta dekreton kthimin p\u00ebr rishqyrtim n\u00eb Kuvend t\u00eb ligjit \u201cP\u00ebr disa ndryshime dhe shtesa n\u00eb ligjin \u2018P\u00ebr koncensionet dhe PPP\u2019\u201d<\/strong><\/p>\n<p><strong>7 gusht 2019<\/strong><\/p>\n<p>Institucioni i Presidentit t\u00eb Republik\u00ebs b\u00ebn me dije se, Presidenti i Republik\u00ebs Sh.T.Z Ilir Meta, n\u00eb ushtrim t\u00eb kompetencave t\u00eb Tij, n\u00eb mb\u00ebshtetje t\u00eb neneve 85, pika 1 dhe 93, t\u00eb Kushtetut\u00ebs,<\/p>\n<p><strong>me Dekretin nr. 11251, dat\u00eb 05.08.2019,<\/strong>\u00a0ka vendosur:<\/p>\n<p>\u201cKthimin p\u00ebr rishqyrtim t\u00eb ligjit\u00a0<strong>nr. 50\/2019,\u00a0<\/strong>\u201cP\u00ebr disa ndryshime dhe shtesa n\u00eb ligjin nr. 125\/2013, \u201cP\u00ebr koncesionet dhe partneritetin publik privat\u201d, t\u00eb ndryshuar\u201d,\u00a0<strong>me q\u00ebllim p\u00ebrmir\u00ebsimin e neneve 17 dhe 18 t\u00eb k\u00ebtij ligji<\/strong>, sipas arsyetimit bashk\u00eblidhur k\u00ebtij dekreti.<\/p>\n<p>Presidenti i Republik\u00ebs shqyrtoi ligjin nr. 50\/2019, duke b\u00ebr\u00eb nj\u00eb vler\u00ebsim dhe analiz\u00eb t\u00eb p\u00ebrmbajtjes s\u00eb aktit t\u00eb miratuar; praktik\u00ebs parlamentare t\u00eb ndjekur p\u00ebr k\u00ebt\u00eb projektligj; p\u00ebrputhshm\u00ebris\u00eb s\u00eb ligjit t\u00eb miratuar n\u00eb raport me respektimin e parimeve kushtetuese, interesin publik, duke krahasuar q\u00ebllimet e k\u00ebsaj iniciative ligjore me momentin e hyrjes n\u00eb fuqi t\u00eb k\u00ebtyre ndryshimeve ligjore.<\/p>\n<p><strong>N\u00eb p\u00ebrfundim t\u00eb shqyrtimit Presidenti i Republik\u00ebs ka arritur n\u00eb p\u00ebrfundimin se:<\/strong><\/p>\n<p><strong>Miratimi i ndryshimeve n\u00eb ligjin e koncesioneve \u00ebsht\u00eb nj\u00eb nis\u00ebm pozitive, por tep\u00ebr e vonuar e Kuvendit t\u00eb Shqip\u00ebris\u00eb, dhe me pasoja negative p\u00ebr ekonomin\u00eb e vendit.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>Ligji nr. 50\/2019,\u00a0<\/strong>i p\u00ebrcjell\u00eb p\u00ebr dekretim\u00a0<strong>i duhet kthyer Kuvendit me q\u00ebllim rishikimin e neneve 17 dhe 18<\/strong>\u00a0t\u00eb tij, pasi k\u00ebto dy nene\u00a0<strong>shtyjn\u00eb subjektivisht<\/strong>\u00a0hyrjen n\u00eb fuqi t\u00eb kufizimeve q\u00eb vendosen n\u00eb dh\u00ebnien e kontratave koncesionare\/PPP, q\u00eb po ky ligji i ri parashikon.<\/p>\n<p><strong>Presidenti i Republik\u00ebs, k\u00ebrkon rishikimin t\u00ebr\u00ebsor t\u00eb k\u00ebtyre dy neneve, sepse ato kompromentojn\u00eb q\u00ebllimin e t\u00eb gjith\u00eb pjes\u00ebs tjet\u00ebr t\u00eb ligjit, pasi keto dy dispozita krijojn\u00eb hap\u00ebsir\u00ebn e nevojshme p\u00ebr t\u00eb prodhuar s\u00ebrish pasoja dhe q\u00ebllime klienteliste.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Projektligji n\u00eb fjal\u00eb pasi u shqyrtua n\u00eb datat\u00a0<strong>11, 18, 25 dhe 26 shkurt 2019<\/strong>\u00a0n\u00eb Komisionet respektive Parlamentare, u shqyrtua n\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs<strong>\u00a018.07.2019,\u00a0<\/strong>duke u mbajtur pezull n\u00eb m\u00ebnyr\u00eb t\u00eb paarsyetuar\u00a0<strong>p\u00ebr nj\u00eb periudh\u00eb 4-mujore.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Nga shqyrtimi i raporteve t\u00eb Komisioneve Parlamentare apo dokumentave shoq\u00ebruese t\u00eb projektligjit, nuk rezulton i argumentuar fakti se,\u00a0<strong>p\u00ebrse kjo nism\u00eb<\/strong>\u00a0<strong>ligjv\u00ebn\u00ebse e depozituar q\u00eb n\u00eb dat\u00eb 09.01.2019 dhe e shqyrtuar p\u00ebrfundimisht n\u00eb komisione parlamentare n\u00eb dat\u00eb 26.02.2019, nuk i \u00ebsht\u00eb kaluar me precedenc\u00eb p\u00ebr shqyrtim seanc\u00ebs plenare, nd\u00ebrkoh\u00eb q\u00eb vet projektligji p\u00ebrcaktonte afate proceduriale dhe dispozita materiale, q\u00eb b\u00ebjn\u00eb t\u00eb detyruesh\u00ebm shqyrtimin e tij brenda nj\u00eb afati t\u00eb caktuar, dhe q\u00eb b\u00ebnte t\u00eb domosdoshme shqyrtimin me p\u00ebrpar\u00ebsi t\u00eb k\u00ebtij ligji n\u00eb seanc\u00eb plenare!<\/strong><\/p>\n<p>I vetmi dokument q\u00eb evidentohet se \u00ebsht\u00eb krijuar nga Kuvendi i Shqip\u00ebris\u00eb, dhe q\u00eb ka lidhje me k\u00ebt\u00eb ligj p\u00ebrgjat\u00eb gjith\u00eb k\u00ebsaj periudhe boshe\u00a0<strong>26 shkurt 2019 \u2013 18 korrik 2019,\u00a0<\/strong>\u00ebsht\u00eb k\u00ebrkesa e deputetit Arben Ahmetaj e dat\u00ebs<strong>\u00a017 korrik 2019,\u00a0<\/strong>i cili k\u00ebrkonte seanc\u00ebs plenare ndryshimin pa argumenta t\u00eb neneve\u00a0<strong>17 dhe 18 t\u00eb projektligjit,<\/strong>\u00a0p\u00ebr t\u00eb shtyr\u00eb afatin e dh\u00ebnies pa kufizim t\u00eb koncesioneve n\u00eb \u00e7do fush\u00eb t\u00eb ekonomis\u00eb s\u00eb vendit,\u00a0<strong>edhe p\u00ebr nj\u00eb afat 3-mujor shtes\u00eb deri n\u00eb 1 tetor 2019.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>Presidenti konstatoi se, vet\u00ebm\u00a0<strong>nj\u00eb dit\u00eb p\u00ebrpara zhvillimit t\u00eb seanc\u00ebs plenare,\u00a0<\/strong>deputeti Arben Ahmetaj ka paraqitur amendamente n\u00eb projektligjin \u201cP\u00ebr disa ndryshime dhe shtesa n\u00eb ligjin nr. 125\/2013, \u201cP\u00ebr koncesionet dhe partneritetin publik privat\u201d, t\u00eb ndryshuar\u201d, vet\u00ebm p\u00ebr t\u00eb ndryshuar p\u00ebrmbajtjen e k\u00ebtyre dy neneve kryesore t\u00eb tij\u00a0<strong>(nenin 17 dhe 18 t\u00eb projektligjit)<\/strong>.<\/p>\n<p><strong>\u00a0Rezultoi se vet\u00ebm 24 or\u00eb p\u00ebrpara se seanca plenare e Kuvendit, do t\u00eb votonte ligjin p\u00ebr t\u00eb kufizuar dh\u00ebnien me koncesion t\u00eb sektor\u00ebve t\u00eb ndrysh\u00ebm t\u00eb ekonomis\u00eb, z.Arben Ahmetaj ka paraqitur nj\u00eb k\u00ebrkes\u00eb p\u00ebr ndryshimin e dy neneve (17-18), me q\u00ebllim q\u00eb k\u00ebto kufizime t\u00eb shtyhen p\u00ebr nj\u00eb periudhe kohe edhe me\u00a0 3 muaj t\u00eb tjer\u00eb.<\/strong><\/p>\n<p><strong>\u00a0Edhe pse k\u00ebrkesa e deputetit nuk ishte e justifikuar, sa i takon q\u00ebllimit real dhe objektiv se p\u00ebrse k\u00ebrkohen realisht k\u00ebto amendamente, s\u00ebrish Kuvendi e pranoi k\u00ebt\u00eb k\u00ebrkes\u00eb dhe me votimin e neneve t\u00eb ndryshuara u hap edhe nj\u00eb her\u00eb rruga q\u00eb koncesionet t\u00eb aplikohen pa kufizim edhe p\u00ebr 3 muaj t\u00eb tjer\u00eb.<\/strong><\/p>\n<p><strong>\u00a0Pra me ndryshimet q\u00eb p\u00ebsuan nenet 17-18 t\u00eb ligjit, kontratat koncesionare do t\u00eb vazhdojn\u00eb t\u00eb jepen pa kufizim, p\u00ebr \u00e7do lloj fushe, pasi afati u shty nga data 1 korrik 2019 q\u00eb ishte planifikuar,\u00a0 u shty p\u00ebr t\u00eb hyr\u00eb n\u00eb fuqi n\u00eb dat\u00eb 1 tetor 2019.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>Kuvendi, duke pranuar k\u00ebt\u00eb propozim \u201cde facto\u201d ka shtyr\u00eb aplikimin e dispozitave kufizuese t\u00eb ligjit t\u00eb ri.<\/strong><\/p>\n<p><strong>\u00a0Duke shtyr\u00eb afatin e kufizimeve q\u00eb vendos ligji i ri, p\u00ebr nj\u00eb dat\u00eb t\u00eb m\u00ebvonshme 1 tetor 2019, Kuvendi n\u00eb kund\u00ebrshtim me interesin publik krijon nj\u00eb\u00a0mund\u00ebsi t\u00eb re q\u00eb \u00e7do k\u00ebrkese p\u00ebr koncesion, q\u00eb paraqitet deri n\u00eb 1 tetor 2019, t\u00eb shqyrtohet dhe t\u00eb pranohet nga qeveria shqiptare,\u00a0pa asnj\u00eb kufizim s\u00ebrish me ligjin e vjet\u00ebr.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>Pra \u00e7dokush mund t\u00eb paraqes\u00eb nj\u00eb k\u00ebrkes\u00eb p\u00ebr t\u00eb marr\u00eb gjith\u00e7ka me koncesion, dhe kjo sepse t\u00eb gjitha kufizimet e ligjit t\u00eb ri t\u00eb sapomiratuar nr. 50\/2019, shtyhen p\u00ebr t\u2019u aplikuar n\u00eb nj\u00eb dat\u00eb t\u00eb m\u00ebvonshme.Kuvendi duke shtyr\u00eb afatin e zbatimit t\u00eb ligjit, b\u00ebhet \u201cde facto\u201d, ligj\u00ebrues i praktikave t\u00eb dyshimta koncesionare dhe hap edhe nj\u00eb her\u00eb mund\u00ebsin\u00eb q\u00eb k\u00ebto praktika q\u00eb kan\u00eb g\u00ebrryer ekonomin\u00eb e \u00e7do familje shqiptare, t\u00eb vijojn\u00eb t\u00eb realizohen pa u penguar edhe p\u00ebr k\u00ebto 3 muaj t\u00eb tjer\u00eb.<\/strong><\/p>\n<p>Shtyrja e afatit p\u00ebr n\u00eb 1 tetor 2019, n\u00eb ndryshim nga nisma fillestare q\u00eb p\u00ebrcaktonte dat\u00ebn 1 korrik 2019 \u00ebsht\u00eb tregues i qart\u00eb p\u00ebr:<\/p>\n<p>Munges\u00eb transparence n\u00eb procedurat e shqyrtimit t\u00eb propozimeve ligjore;<\/p>\n<p>Nj\u00eb veprimtari tinzare t\u00eb deputet\u00ebve t\u00eb Kuvendit, t\u00eb cil\u00ebt mbrojn\u00eb dhe promovojn\u00eb dh\u00ebnien me koncesion t\u00eb pasuris\u00eb publike t\u00eb shqiptar\u00ebve pa asnj\u00eb kufizim;<\/p>\n<p>Ndikimin e deputet\u00ebve t\u00eb Kuvendit nga interesat e lidhura me koncesionimin e pron\u00ebs publike;<\/p>\n<p>Munges\u00eb transparence ndaj qytetar\u00ebve n\u00eb propozimet e pak\u00ebrkuara\/PPP q\u00eb jan\u00eb administruar gjat\u00eb k\u00ebsaj periudhe nga autoritetet kontraktuese, duke qen\u00eb se tashm\u00eb nisma p\u00ebr kufizimin e propozimeve t\u00eb pak\u00ebrkuara dihej dhe njihej;<\/p>\n<p>Krijmin e hap\u00ebsir\u00ebs kohore, jo vet\u00ebm p\u00ebr depozitimin e k\u00ebrkesave t\u00eb reja koncesionare\/PPP, por edhe p\u00ebr trajtimin dhe miratimin e tyre sipas kritereve dhe procedur\u00ebs s\u00eb vjet\u00ebr ligjore;<\/p>\n<p>Nd\u00ebrkoh\u00eb q\u00eb me hyrjen n\u00eb fuqi t\u00eb ndryshimeve ligjore pas dat\u00ebs 1 tetor 2019, k\u00ebrkesat dhe procedurat q\u00eb duhet t\u00eb ndiqen p\u00ebr miratimin e kontratave koncesionare\/PPP, do t`i n\u00ebnshtrohen kushteve ligjore kufizuese, miratuese dhe monitoruese, t\u00ebr\u00ebsisht t\u00eb ndryshme, krijuar k\u00ebshtu,\u00a0<strong>jo vet\u00ebm<\/strong>\u00a0<strong>rrezik p\u00ebr cenim t\u00eb interesit publik,<\/strong>\u00a0<strong>por edhe pabarazi n\u00eb trajtimin e subjekteve private n\u00eb kund\u00ebrshtim me parimet kushtetuese.<\/strong><\/p>\n<p><strong>\u00a0\u00c7do subjekt\u00a0 i ndersh\u00ebm dhe i palidhur me qeverin\u00eb do t\u00eb duhet t\u00eb konkurroj\u00eb me oferta t\u00eb paraqitura sipas k\u00ebrkesave t\u00eb reja ligjore, nd\u00ebrkoh\u00eb q\u00eb \u00e7do subjekt q\u00eb \u00ebsht\u00eb sado af\u00ebr me qeverin\u00eb e di fare mir\u00eb se mund t\u00eb fitoj\u00eb dhe t\u00eb marr\u00eb me koncesion \u00e7do gj\u00eb q\u00eb ligji i vjet\u00ebr e lejon, pasi ligjin e ri mund ta ndryshojn\u00eb n\u00eb \u00e7do koh\u00eb, madje dhe nj\u00eb or\u00eb p\u00ebrpara votimit t\u00eb tij.<\/strong><\/p>\n<p><strong>\u00a0<\/strong>\u00c7do lloj k\u00ebrkese e re p\u00ebr marrjen e nj\u00eb t\u00eb drejte koncesionare\/PPP q\u00eb mund t\u00eb jet\u00eb depozituar nd\u00ebrkoh\u00eb, k\u00ebrkon nj\u00eb adresim t\u00eb sakt\u00eb ligjor p\u00ebr trajtimin e saj, sipas kushteve t\u00eb reja ligjore t\u00eb propozuara pasi nxitimi q\u00eb mund t\u00eb karakterizoj\u00eb miratimin e k\u00ebtyre propozimeve t\u00eb pak\u00ebrkuara, sipas ligjit t\u00eb vjet\u00ebr, mund t\u00eb sjell\u00eb si rezultat;<\/p>\n<p>Miratimin e kontratave q\u00eb nuk kan\u00eb nj\u00eb studim t\u00eb plot\u00eb fizibiliteti e p\u00ebr pasoj\u00eb reduktimin e cil\u00ebsis\u00eb s\u00eb sh\u00ebrbimit apo nd\u00ebrtimit t\u00eb siguruar, rritjes s\u00eb kostove, dhe duke l\u00ebn\u00eb hap\u00ebsira favorizuese q\u00eb krijojn\u00eb nivele t\u00eb larta rrisku p\u00ebr praktika korruptive.<\/p>\n<p><strong>Presidenti i Republik\u00ebs, gjen me vend t\u00eb evidentoj\u00eb se institucionet financiare nd\u00ebrkomb\u00ebtare, kan\u00eb k\u00ebrkuar nga qeveria shqiptare n\u00eb m\u00ebnyr\u00eb eksplicite eliminimin n\u00eb m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme t\u00eb ofertave t\u00eb pak\u00ebrkuara, si oferta me nj\u00eb kosto t\u00eb r\u00ebnd\u00eb n\u00eb ekonomin\u00eb e vendit<\/strong>.<\/p>\n<p><strong>Shtyrja n\u00eb koh\u00eb e hyrjes n\u00eb fuqi t\u00eb ligjit nr. 50\/2019, q\u00eb ndryshon ligjin nr. 125\/2013,\u00a0shton rrezikun e rritjes s\u00eb borxhit publik, nisur nga fakti q\u00eb deri n\u00eb dat\u00ebn 1 tetor 2019, mund t\u00eb paraqiten oferta t\u00eb reja t\u00eb pak\u00ebrkuara.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>Presidenti i Republik\u00ebs, \u00e7mon se ligji nr. 50\/2019, i paraqitur p\u00ebr shpallje \u00ebsht\u00eb nj\u00eb iniciativ\u00eb shum\u00eb e vonuar e qeveris\u00eb dhe e Kuvendit t\u00eb Shqip\u00ebris\u00eb, pasi ndryshime t\u00eb k\u00ebsaj natyre duhet t\u00eb ishin nd\u00ebrmarr\u00eb shum\u00eb koh\u00eb m\u00eb par\u00eb nga mazhoranca.<\/strong><\/p>\n<p>P\u00ebr gjith\u00eb sa u parashtrua m\u00eb sip\u00ebr, me q\u00ebllimin e vet\u00ebm p\u00ebrmir\u00ebsimin e k\u00ebtij ligji n\u00eb p\u00ebrputhje me frym\u00ebn me t\u00eb cil\u00ebn kjo nis\u00ebm \u00ebsht\u00eb propozuar;<\/p>\n<p>n\u00eb m\u00ebnyr\u00eb q\u00eb ky ndryshim ligjor t\u00eb jet\u00eb realisht n\u00eb p\u00ebrputhje me rekomandimet e institucioneve nd\u00ebrkomb\u00ebtare q\u00eb asistojn\u00eb dhe monitorojn\u00eb Shqip\u00ebrin\u00eb;<\/p>\n<p>n\u00eb mbrojtje t\u00eb interesit publik dhe p\u00ebr t\u00eb mos lejuar m\u00eb, q\u00eb familjet shqiptare t\u00eb p\u00ebrballojn\u00eb kosto t\u00eb panevojshme financiare, q\u00eb jan\u00eb t\u00eb panjohura deri m\u00eb tani, por q\u00eb duket se shkojn\u00eb p\u00ebrtej mund\u00ebsis\u00eb s\u00eb tyre dhe q\u00eb shtrihen p\u00ebr nj\u00eb koh\u00eb t\u00eb ardhme t\u00eb gjat\u00eb dhe t\u00eb pap\u00ebrllogaritur sakt\u00eb,<\/p>\n<p>N\u00eb bindje t\u00eb Kushtetut\u00ebs dhe n\u00eb zbatim t\u00eb nenit 85 pika 1 t\u00eb saj, Presidenti i Republik\u00ebs ka vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr.\u00a0<strong>50\/2019 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 125\/2013 \u2018P\u00ebr koncensionet dhe partneritetin publik privat\u2019, t\u00eb ndryshuar\u201d\u00a0me q\u00ebllim rishqyrtimin dhe p\u00ebrmir\u00ebsimin e neneve 17 dhe 18 t\u00eb k\u00ebtij ligji.\u00a0\u00a0<\/strong>P\u00ebrmir\u00ebsimi i k\u00ebtyre dy neneve nga Kuvendi duhet t\u00eb b\u00ebhet n\u00eb m\u00ebnyr\u00eb t\u00eb atill\u00eb q\u00eb t\u00eb pengoj\u00eb m\u00ebnjeher\u00eb dh\u00ebnien me koncesion t\u00eb pron\u00ebs publike dhe pasuris\u00eb shtet\u00ebrore jasht\u00eb kritereve.
