Pal\u00ebt kan\u00eb r\u00ebn\u00eb dakord q\u00eb transferimi i titullit t\u00eb pron\u00ebsis\u00eb, p\u00ebr pron\u00ebn objekt t\u00eb k\u00ebsaj marr\u00ebveshjeje, si dhe regjistrimi i titullit t\u00eb pron\u00ebsis\u00eb nga pala e par\u00eb, n\u00eb favor dhe n\u00eb em\u00ebr t\u00eb pal\u00ebs s\u00eb dyt\u00eb, do t\u00eb realizohet me n\u00ebnshkrimin e kontrat\u00ebs p\u00ebrfundimtare t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb, e cila do t\u00eb lidhet n\u00ebp\u00ebrmjet pal\u00ebve me akt publik, dhe do t\u00eb regjistrohet sipas rregullave pran\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs, vet\u00ebm pas n\u00ebnshkrimit t\u00eb t\u00eb gjitha dokumenteve t\u00eb nevojshme dhe plot\u00ebsimit t\u00eb kushteve t\u00eb m\u00eb poshtme.<\/em> <em>2.2 Pala e par\u00eb merr p\u00ebrsip\u00ebr t\u00eb mbuloj\u00eb t\u00eb gjitha detyrimet dhe kostot, n\u00eb lidhje me shpenzimet noteriale dhe regjistrimin e k\u00ebsaj marr\u00ebveshjeje pran\u00eb Agjencis\u00eb Shtet\u00ebrore t\u00eb Kadastr\u00ebs, brenda 30 dit\u00ebve nga data e n\u00ebnshkrimit t\u00eb saj.<\/em><\/p>\n<p><em>Deklarime dhe garanci t\u00eb pal\u00ebve<\/em> <em>3.1 Pala e par\u00eb, deklaron dhe garanton pal\u00ebn e dyt\u00eb p\u00ebr secil\u00ebn prej \u00e7\u00ebshtjeve t\u00eb m\u00ebposhtme:i) merr p\u00ebrsip\u00ebr q\u00eb nd\u00ebrtimin e pasuris\u00eb ta kryej\u00eb n\u00eb p\u00ebrputhje me parimet e rind\u00ebrtimit, sipas kushteve dhe teknikave q\u00eb parandalojn\u00eb rreziqet e fatkeq\u00ebsive natyrore n\u00eb t\u00eb ardhmen, bazuar n\u00eb konceptin \u201crind\u00ebrto m\u00eb mir\u00eb\u201d<\/em> <em>;ii) merr p\u00ebrsip\u00ebr t\u00eb dor\u00ebzoj\u00eb pasurin\u00eb, sipas parimit \u201cme \u00e7el\u00ebsa n\u00eb dor\u00eb\u201d, t\u00eb gatshme p\u00ebr banim;iii) do t\u00eb p\u00ebrmbush\u00eb detyrimet dhe do t\u00eb plot\u00ebsoj\u00eb kushtet e parashikuara n\u00eb k\u00ebt\u00eb marr\u00ebveshje<\/em> <em>;iv) p\u00ebr aq koh\u00eb sa kjo marr\u00ebveshje do t\u00eb jet\u00eb n\u00eb fuqi, pasuria, objekt i k\u00ebsaj marr\u00ebveshjeje, nuk mund t\u2019i premtohet, t\u2019i jepet n\u00eb p\u00ebrdorim apo t\u2019i shitet nj\u00eb pale t\u00eb tret\u00eb<\/em> <em>;v) pala e par\u00eb deklaron dhe siguron se ka autoritetin dhe miratimet e duhura p\u00ebr t\u00eb n\u00ebnshkruar, zbatuar dhe p\u00ebrmbushur dispozitat e k\u00ebsaj marr\u00ebveshjeje<\/em> <em>;vi) pala e par\u00eb merr p\u00ebrsip\u00ebr dhe garanton pal\u00ebn e dyt\u00eb se, p\u00ebrgjat\u00eb gjith\u00eb koh\u00ebzgjatjes q\u00eb do t\u00eb duhet p\u00ebr dor\u00ebzimin e pasuris\u00eb, sipas parimit \u201cme \u00e7el\u00ebsa n\u00eb dor\u00eb\u201d, do t\u2019i siguroj\u00eb subvencionin e pages\u00ebs s\u00eb qiras\u00eb deri n\u00eb momentin q\u00eb k\u00ebsaj pale t\u2019i kaloj\u00eb e drejta e pron\u00ebsis\u00eb s\u00eb pasuris\u00eb, n\u00eb baz\u00eb t\u00eb vlerave dhe kushteve t\u00eb miratuara, n\u00eb p\u00ebrputhje me aktet ligjore dhe n\u00ebnligjore n\u00eb fuqi.<\/em><\/p>\n<p><em>3.2 Pala e dyt\u00eb deklaron dhe garanton pal\u00ebn e par\u00eb p\u00ebr secil\u00ebn prej \u00e7\u00ebshtjeve t\u00eb m\u00ebposhtme:i) pala e dyt\u00eb pranon kushtet n\u00eb k\u00ebt\u00eb marr\u00ebveshje dhe \u00ebsht\u00eb plot\u00ebsisht dakord q\u00eb, n\u00eb momentin e duhur dhe pas plot\u00ebsimit t\u00eb kushteve t\u00eb vendosura sipas legjislacionit n\u00eb fuqi, t\u00eb n\u00ebnshkruaj\u00eb kontrat\u00ebn p\u00ebrfundimtare t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb s\u00eb pasuris\u00eb, objekt i k\u00ebsaj marr\u00ebveshjeje;ii) kjo marr\u00ebveshje p\u00ebrb\u00ebn nj\u00eb detyrim ligjor, t\u00eb vlefsh\u00ebm dhe t\u00eb ekzekutuesh\u00ebm p\u00ebr pal\u00ebn e dyt\u00eb, e cila i ka t\u00eb gjitha kompetencat t\u00eb lidh\u00eb k\u00ebt\u00eb marr\u00ebveshje dhe t\u00eb p\u00ebrmbush\u00eb detyrimet q\u00eb rrjedhin prej saj;iii) pala e dyt\u00eb do t\u00eb n\u00ebnshkruaj\u00eb deklarat\u00ebn noteriale p\u00ebr heqje dor\u00eb, sipas parashikimeve t\u00eb legjislacionit n\u00eb fuqi.<\/em> <em>3.3 N\u00ebse pala e dyt\u00eb nuk plot\u00ebson t\u00eb gjitha kushtet e vendosura n\u00eb legjislacionin n\u00eb fuqi, at\u00ebher\u00eb kjo marr\u00ebveshje nuk do t\u00eb ket\u00eb fuqi ligjore dhe pala e par\u00eb zhvishet nga t\u00eb gjitha detyrimet e ngarkuara n\u00eb k\u00ebt\u00eb aktmarr\u00ebveshje.<\/em> <em>3.4 Pal\u00ebt pranojn\u00eb se deklarimet dhe garancit\u00eb e parashikuara n\u00eb nenet m\u00eb sip\u00ebr jan\u00eb kryer n\u00eb zbatim t\u00eb dispozitave ligjore n\u00eb fuqi dhe me q\u00ebllim angazhimin e secil\u00ebs prej tyre p\u00ebr t\u00eb lidhur k\u00ebt\u00eb
