Nd\u00ebr k\u00ebto vendimmarrje po ve\u00e7oj vet\u00ebm dy prej tyre: pranimin e \u201cofertave t\u00eb pak\u00ebrkuara\u201d dhe ofrimin e aseteve t\u00eb ndryshme dhe pasurive t\u00eb vendit n\u00eb form\u00ebn e programit t\u00eb njohur si \u201cShqip\u00ebria 1 Euro\u201d<\/p>\n<p>\u00cbsht\u00eb nj\u00eb fakt i njohur q\u00eb p\u00ebrmes \u201cofertave t\u00eb pak\u00ebrkuara\u201d \u00ebsht\u00eb kanalizuar futja e kapitalit privat n\u00eb infrastruktur\u00ebn publike t\u00eb trajtimit t\u00eb mbetjeve urbane, komunikacionit, sh\u00ebndet\u00ebsis\u00eb etj. Kjo \u00ebsht\u00eb b\u00ebr\u00eb kryesisht n\u00ebn mbules\u00ebn e pamund\u00ebsis\u00eb financiare t\u00eb shtetit p\u00ebr t\u00eb kryer investimet n\u00eb k\u00ebto sektor\u00eb, duke presupozuar q\u00eb investitori privat zot\u00ebron p\u00ebrvoj\u00ebn e duhur, kapacitetet e nevojshme teknike dhe burimet e veta financiare dhe k\u00ebshtu, sh\u00ebrbimet publike p\u00ebrkat\u00ebse do t\u00eb kushtonin m\u00eb lir\u00eb dhe qytetar\u00ebt do t\u00eb sh\u00ebrbeheshin m\u00eb mir\u00eb.<\/p>\n<p>N\u00eb t\u00eb v\u00ebrtet\u00eb, kjo form\u00eb investimi, q\u00eb gjat\u00eb dekad\u00ebs s\u00eb fundit ka marr\u00eb form\u00ebn e nj\u00eb agresioni t\u00eb v\u00ebrtet\u00eb ndaj gjith\u00e7kaje publike, jo vet\u00ebm ka rezultuar financiarisht kund\u00ebrproduktive (kostot e sh\u00ebrbimeve jan\u00eb rritur), por \u00ebsht\u00eb leht\u00ebsisht e verifikueshme q\u00eb shumica e kompanive t\u00eb p\u00ebrzgjedhura nga qeveria shqiptare p\u00ebr t\u00eb ofruar k\u00ebto sh\u00ebrbime jan\u00eb kompani t\u00eb krijuara posa\u00e7\u00ebrisht p\u00ebr k\u00ebt\u00eb q\u00ebllim; ato zot\u00ebrohen nga kompani t\u00eb tjera guaska, pronar\u00eb anonim\u00eb edhe\/ ose jan\u00eb t\u00eb regjistruara n\u00eb zonat offshore, nuk kan\u00eb pasur p\u00ebrvoja t\u00eb m\u00ebparshme dhe as kapitalin e nevojsh\u00ebm p\u00ebr t\u00eb kryer investimin fillestar; kan\u00eb hartuar vet\u00eb projekte investimi t\u00eb fryra, gj\u00eb q\u00eb ka \u00e7uar n\u00eb rritjen e kostove t\u00eb sh\u00ebrbimit; jan\u00eb pjes\u00eb e skemave gjigante t\u00eb evazionit fiskal\/mospagimit t\u00eb TVSHs\u00eb; shpenzojn\u00eb shuma t\u00eb konsiderueshme fondesh n\u00eb sh\u00ebrbime konsulence fiktive etj.<\/p>\n<p>N\u00ebse shumica prej tyre, n\u00eb mos t\u00eb gjitha, kan\u00eb lidhje t\u00eb dukshme dhe t\u00eb padukshme me politikan\u00eb t\u00eb lart\u00eb edhe\/ ose me enturazhin e tyre, nj\u00eb num\u00ebr kontratash t\u00eb tilla pa dyshim q\u00eb kan\u00eb mund\u00ebsuar dhe po leht\u00ebsojn\u00eb edhe penetrimin n\u00eb sektorin publik t\u00eb parave t\u00eb krimit t\u00eb organizuar dhe korrupsionit. N\u00eb faz\u00ebn e sotme t\u00eb zhvillimit t\u00eb vendit, procesi i pastrimit t\u00eb parave, p\u00ebrve\u00e7 p\u00ebrfshirjes s\u00eb njohur n\u00eb prokurimet publik, n\u00eb sektorin e nd\u00ebrtimit, loj\u00ebrave t\u00eb fatit, etj., po i shnd\u00ebrron parat\u00eb e krimit t\u00eb organizuar dhe korrupsionit edhe n\u00eb borxh publik, mbasi investimet n\u00eb kontratat e llojit PPP do t\u00eb vazhdojn\u00eb t\u00eb paguhen nga taksat e qytetar\u00ebve shqiptar\u00eb edhe p\u00ebr vitet dhe dekadat q\u00eb vijn\u00eb. Nuk mbeten jasht\u00eb k\u00ebtij trendi rr\u00ebnues p\u00ebr ekonomin\u00eb komb\u00ebtare edhe disa bashki t\u00eb vendit, por nuk \u00ebsht\u00eb ky objekti i k\u00ebtij shkrimi.<\/p>\n<p>Sa u takon investimeve t\u00eb llojit \u201cShqip\u00ebria 1 Euro\u201d, d\u00ebshiroj t\u00eb ndalem vet\u00ebm n\u00eb pak aspekte, tek ato m\u00eb t\u00eb dukshmet p\u00ebr syrin e cilitdo qytetar, votues e taksapagues i vendit ton\u00eb. K\u00ebshtu, p\u00ebrtej deklaratave p\u00ebr \u201cperspektiv\u00ebn e zhvillimit t\u00eb k\u00ebtij apo t\u00eb atij sektori p\u00ebrmes investitor\u00ebve t\u00eb p\u00ebrzgjedhur nga qeveria\u201d, t\u00eb cilit ajo i dhuron gati falas asete t\u00eb r\u00ebnd\u00ebsishme publike, shihet qart\u00eb se interesi i k\u00ebtyre t\u00eb fundit \u00ebsht\u00eb vet\u00ebm toka apo trualli, mbi t\u00eb cilin ishte ngritur nd\u00ebrmarrja apo institucioni i trash\u00ebguar nga periudha e regjimit komunist, nd\u00ebrsa planet e \u201czhvillimit\u201d vlejn\u00eb vet\u00ebm sa p\u00ebr nj\u00eb kronik\u00eb lajmesh televizive se n\u00eb shumic\u00ebn e rasteve harrohen q\u00eb t\u00eb nes\u00ebrmen.<\/p>\n<p>Duke shmangur komentin mbi rolin kushtetues t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb, d\u00ebshiroj t\u00eb referoj vet\u00ebm rolin e Autoritetit t\u00eb Konkurrenc\u00ebs ose ndryshe agjencis\u00eb antimonopol, tek e cila kam pasur fatin t\u00eb kontribuoj personalisht n\u00eb fillimet e saj. Nd\u00ebr funksionet baz\u00eb t\u00eb k\u00ebtij institucioni \u00ebsht\u00eb parashikuar n\u00eb ligj q\u00eb \u201cMe k\u00ebrkes\u00ebn e komisioneve te Kuvendit, jep vler\u00ebsime p\u00ebr \u00e7\u2019\u00ebshtj\u00eb q\u00eb lidhen me konkurrenc\u00ebn dhe legjislacionin n\u00eb k\u00ebt\u00eb fush\u00eb\u201d<\/p>\n<p>\u201cU jep vleresime dhe rekomandime organeve t\u00eb administrat\u00ebs qendrore e vendore dhe institucioneve t\u00eb tjera publike, shoqatave tregtare, sindikatave, shoqatave t\u00eb konsumatorit, dhomave t\u00eb tregtis\u00eb dhe t\u00eb industris\u00eb, p\u00ebr \u00e7\u00ebshtjet q\u00eb lidhen me konkurrenc\u00ebn\u201d (pikat e) dhe f) te Neni 24 \u2013 Detyrat dhe p\u00ebrgjegj\u00ebsit\u00eb e Komisionit t\u00eb Konkurrenc\u00ebs) E p\u00ebrmenda k\u00ebt\u00eb referenc\u00eb ligjore p\u00ebr t\u00eb th\u00ebn\u00eb se me asistenc\u00ebn e BE-s\u00eb, vendi yn\u00eb ka p\u00ebrshtatur duksh\u00ebm kuadrin e vet ligjor, por zbatimi n\u00eb praktik\u00eb i k\u00ebtij kuadri, p\u00ebr fat t\u00eb keq, po ec\u00ebn n\u00eb kahjen e kund\u00ebrt. Le ta konkretizojm\u00eb k\u00ebt\u00eb konstatim me nj\u00eb rast vendimmarrjeje t\u00eb till\u00eb.<\/p>\n<p>Si\u00e7 dihet, qeveria shqiptare ka shpallur q\u00eb Porti i Durr\u00ebsit do t\u00eb jet\u00eb Dubai i Mesdheut, q\u00eb ky port do t\u00eb jet\u00eb m\u00eb i madhi n\u00eb Mesdhe dhe, sipas Kryeministrit, njer\u00ebzit m\u00eb t\u00eb pasur n\u00eb bot\u00eb do t\u00eb ankorojn\u00eb jahtet e tyre n\u00eb Durr\u00ebs e p\u00ebr shkak t\u00eb k\u00ebsaj, ata do t\u00eb k\u00ebrkojn\u00eb edhe sh\u00ebrbime luksi. \u00c7far\u00eb e pengon Kuvendin e Shqip\u00ebris\u00eb t\u00eb ushtroj\u00eb detyr\u00ebn e vet kushtetuese p\u00ebr t\u00eb k\u00ebrkuar vler\u00ebsime institucionale t\u00eb rregullatorit n\u00eb lidhje me konkurrenc\u00ebn (sepse b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb kontrat\u00eb shtet\u00ebrore, q\u00eb do ta kishte lakmi cilido monark n\u00eb vendet m\u00eb t\u00eb prapambetura t\u00eb bot\u00ebs)? Nuk po them q\u00eb qeveria dhe pushteti vendor duhet t\u00eb ken\u00eb p\u00ebrgjegjshm\u00ebrin\u00eb kushtetuese dhe ligjore qe t\u00eb konsultojn\u00eb rregullatorin p\u00ebrkat\u00ebs sektoral dhe vet\u00eb Autoritetin e Konkurrenc\u00ebs sa her\u00eb q\u00eb vendimet e tyre cenojn\u00eb apo vler\u00ebsohet se cenojn\u00eb n\u00eb t\u00eb ardhmen konkurrenc\u00ebn, ashtu sikurse dhe ky i fundit mund dhe duhet t\u00eb jet\u00eb aktiv p\u00ebr t\u00eb kontribuar q\u00eb ekonomia jon\u00eb komb\u00ebtare t\u00eb \u00e7lirohet nga skllav\u00ebria e vendim-marrjeve t\u00eb tilla klienteliste t\u00eb qeveris\u00eb, madje edhe me dyshim t\u00eb bazuar p\u00ebr favoritiz\u00ebm.<\/p>\n<p>E nj\u00ebjta gj\u00eb mund t\u00eb thuhet edhe p\u00ebr vendimmarrjen qeveritare p\u00ebr investime t\u00eb tjera me ndjeshm\u00ebri t\u00eb lart\u00eb publike, si n\u00eb infrastruktur\u00ebn publike, energjetike etj., q\u00eb ishin dhe mbeten thjesht vendime politike, ekonomikisht t\u00eb paargumentuara, dometh\u00ebn\u00eb favore p\u00ebr lobet dhe kompanit\u00eb guaska offshore apo p\u00ebr kompani q\u00eb thjesht g\u00ebzojn\u00eb mb\u00ebshtetje politike, qoft\u00eb kjo edhe nd\u00ebrkomb\u00ebtare, por q\u00eb veprimtaria e tyre nuk p\u00ebrputhet me interesin e qytetar\u00ebve shqiptar\u00eb aktualisht dhe n\u00eb perspektiv\u00eb.<\/p>\n<p>Duke marr\u00eb shkas nga k\u00ebto zhvillime po rendis disa sugjerime modeste p\u00ebr elit\u00ebn politike n\u00eb pushtet dhe n\u00eb opozit\u00eb: T\u00eb ndalohen p\u00ebr nj\u00eb periudhe kohe, t\u00eb pakt\u00ebn p\u00ebr 10 vjet, pjes\u00ebmarrja e kompanive offshore dhe t\u00eb gjitha \u201cpropozimet e pak\u00ebrkuara\u201d n\u00eb prokurimet publike dhe n\u00eb \u00e7far\u00ebdo forme t\u00eb kontratave publike n\u00eb territorin e vendit. T\u00eb ndalohet p\u00ebrgjithmon\u00eb vazhdimi i programit \u201cShqip\u00ebria 1 Euro\u201d. Avokati i Shtetit, mbi baz\u00ebn e raporteve specifike t\u00eb performanc\u00ebs, t\u00eb rekomandimeve t\u00eb KLSH, t\u00eb analizave t\u00eb riskut nga Open Data Albania apo t\u00eb denoncimeve t\u00eb masmedias t\u00eb rishikoj\u00eb dhe t\u00eb k\u00ebrkoj\u00eb pezullimin e kontratave t\u00eb llojit PPP, t\u00eb atyre q\u00eb jan\u00eb t\u00eb dyshuara p\u00ebr korrupsion dhe eventualisht t\u00eb amendoj\u00eb kontratat e tjera q\u00eb jan\u00eb n\u00eb zbatim e sip\u00ebr, n\u00eb t\u00eb cilat ka dyshim t\u00eb bazuar se nuk \u00ebsht\u00eb respektuar pariteti i pal\u00ebve dhe \u00ebsht\u00eb cenuar interesi publik.<\/p>\n<p>Autoriteti i Konkurrenc\u00ebs t\u00eb raportoj\u00eb \u00e7do tre muaj p\u00ebr nj\u00eb periudh\u00eb prej dy vitesh n\u00eb vijim n\u00eb Kuvendin e Shqip\u00ebris\u00eb mbi shqyrtimin dhe vler\u00ebsimin e legjislacionit aktualisht n\u00eb fuqi q\u00eb prek konkurrenc\u00ebn duke formuluar dhe b\u00ebr\u00eb publike edhe rekomandimet p\u00ebrkat\u00ebse p\u00ebr institucionet sht et\u00ebrore p\u00ebrgjegj\u00ebse.
