Arben Kraja shkres\u00eb p\u00ebr heqjen e kufizimit t\u00eb mandatit 3-vje\u00e7ar n\u00eb krye t\u00eb SPAK, drejtuesja e BKH k\u00ebrkon pavar\u00ebsi financiare"},"content":{"rendered":"<p>N\u00eb prag t\u00eb mesnat\u00ebs s\u00eb 21 korrikut 2016, Kuvendi i Shqip\u00ebris\u00eb miratoi unanimisht nj\u00eb paket\u00eb t\u00eb ndryshimeve kushtetuese, t\u00eb cilat i hap\u00ebn rrug\u00ebn ngritjes s\u00eb nj\u00eb sistemi t\u00eb ri t\u00eb drejt\u00ebsis\u00eb n\u00eb vend.<\/p>\n<p><span data-preserver-spaces=\"true\">Reforma n\u00eb drejt\u00ebsi premtonte rikthimin e besimit t\u00eb publikut p\u00ebrmes nj\u00eb procesi t\u00eb p\u00ebrkohsh\u00ebm vetingu dhe nj\u00eb arkitekture t\u00eb re, q\u00eb do t\u00eb garantonte sipas hartuesve pavar\u00ebsin\u00eb dhe llogaridh\u00ebnien.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Por gjasht\u00eb vjet m\u00eb von\u00eb, drejtuesit e institucioneve t\u00eb reja t\u00eb drejt\u00ebsis\u00eb jan\u00eb v\u00ebn\u00eb n\u00eb gar\u00eb me nj\u00ebri-tjetrin p\u00ebr m\u00eb shum\u00eb kompetenca dhe privilegje, duke v\u00ebn\u00eb n\u00eb l\u00ebvizje Kuvendin p\u00ebr t\u00eb p\u00ebrgatitur nj\u00eb paket\u00eb t\u00eb re ndryshimesh ligjore \u2018p\u00ebr t\u00eb korrektuar\u2019 reform\u00ebn n\u00eb drejt\u00ebsi.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">M\u00eb 14 shtator, Komisioni i Ligjeve miratoi ngritjen e nj\u00eb grupi t\u00eb p\u00ebrbashk\u00ebt pune mes deputet\u00ebve t\u00eb mazhoranc\u00ebs dhe nj\u00eb pjese t\u00eb opozit\u00ebs p\u00ebr t\u00eb adresuar me ndryshime ligjore k\u00ebrkesat e vazhdueshme t\u00eb organeve drejtuese t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb p\u00ebr ndryshime ligjore.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">BIRN i siguroi propozimet p\u00ebr ndryshime ligjore q\u00eb kan\u00eb dor\u00ebzuar n\u00eb Kuvend Prokuroria e Posa\u00e7me, Byroja Komb\u00ebtare e Hetimit, K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb dhe Prokuroria e P\u00ebrgjithshme.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">K\u00ebto propozime p\u00ebrmbajn\u00eb kryesisht k\u00ebrkesa p\u00ebr zgjatje mandatesh, garanci pas p\u00ebrfundimit t\u00eb detyr\u00ebs, zgjerim kompetencash apo m\u00eb shum\u00eb pavar\u00ebsi ndaj mekanizmave t\u00eb kontrollit.<\/span><\/p>\n<p>SPAK dhe BKH me \u2018halle\u2019 t\u00eb ndryshme<\/p>\n<p><span data-preserver-spaces=\"true\">Kreu i SPAK, Arben Kraja dhe drejtuesja e Byrose Komb\u00ebtare te Hetimit, Aida Hajnaj gjat\u00eb nj\u00eb konference. Foto: LSA<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Prokuroria e Posa\u00e7me Kund\u00ebr Krimit t\u00eb Organizuar dhe Korrupsionit, SPAK dhe Byroja Komb\u00ebtare e Hetimit, BKH p\u00ebrb\u00ebjn\u00eb s\u00eb bashku struktur\u00ebn e posa\u00e7me n\u00eb luft\u00ebn kund\u00ebr korrupsionit t\u00eb lart\u00eb dhe krimit t\u00eb organizuar.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Rreth dy vjet pas krijimit, Prokuroria e Posa\u00e7me ka ngritur pretendime mbi baz\u00ebn ligjore q\u00eb rregullon funksionimin e k\u00ebtij organi hetimi, ku si problem t\u00eb par\u00eb evidenton kufizimin ligjor t\u00eb mandatit 9-vje\u00e7ar p\u00ebr prokuror\u00ebt dhe at\u00eb 3-vje\u00e7ar p\u00ebr drejtuesin e SPAK.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Kushtetuta dhe Ligji nr.95.2016 \u201cP\u00ebr organizimin dhe funksionimin e institucioneve p\u00ebr t\u00eb luftuar korrupsionin dhe krimin e organizuar\u201d, parashikon q\u00eb prokuror\u00ebt e SPAK kan\u00eb nj\u00eb mandat 9-vje\u00e7ar, pa t\u00eb drejt\u00eb p\u00ebrs\u00ebritje, nd\u00ebrsa drejtuesi nj\u00eb mandat 3-vje\u00e7ar pa t\u00eb drejt\u00eb p\u00ebrs\u00ebritje.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">N\u00eb k\u00ebrkes\u00ebn e tij drejtuar Kuvendit n\u00eb prill t\u00eb vitit 2021, kreu i SPAK, Arben Kraja k\u00ebrkon heqjen e k\u00ebtij kufizimi dhe t\u00eb drejt\u00ebn e rikandidimit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cGjyqtar\u00ebt e Gjykat\u00ebs s\u00eb Posa\u00e7me t\u00eb Shkall\u00ebs s\u00eb Par\u00eb dhe Gjykat\u00ebs s\u00eb Posa\u00e7me t\u00eb Apelit nuk e kan\u00eb nj\u00eb kufizim t\u00eb till\u00eb; t\u00eb gjith\u00eb prokuror\u00ebt e tjer\u00eb n\u00eb sistemin e prokuroris\u00eb nuk e kan\u00eb nj\u00eb kufizim t\u00eb till\u00eb; drejtuesit e institucioneve kushtetuese nuk kan\u00eb nj\u00eb mandat t\u00eb till\u00eb t\u00eb shkurt\u00ebr n\u00eb koh\u00eb dhe pa t\u00eb drejt\u00eb rikandidimi\u2026,\u201d thuhet n\u00eb k\u00ebrkes\u00ebn e Kraj\u00ebs.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Kraja, mandati i s\u00eb cilit p\u00ebrfundon n\u00eb dhjetor t\u00eb k\u00ebtij viti, k\u00ebrkon q\u00eb k\u00ebto p\u00ebrcaktime ligjore duhen hequr ose riformuluar, me q\u00ebllim q\u00eb t\u00eb hiqet mandati i kufizuar.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201c\u2026propozojm\u00eb q\u00eb ndryshimi t\u00eb jet\u00eb vet\u00ebm n\u00eb dh\u00ebnien e t\u00eb drejt\u00ebs p\u00ebr t\u00eb rikandiduar, si p\u00ebr drejtuesin e prokuroris\u00eb, ashtu dhe p\u00ebr prokuror\u00ebt e posa\u00e7\u00ebm,\u201d shton ai.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">N\u00eb vijim, SPAK ngre gjithashtu shqet\u00ebsimin se sipas parashikimit ligjor, nj\u00eb oficer i BKH-s\u00eb duhet t\u00eb kryej\u00eb v\u00ebzhgimin periodik t\u00eb komunikimeve t\u00eb gjyqtar\u00ebve, prokuror\u00ebve, personelit administrativ dhe familjar\u00ebve t\u00eb af\u00ebrt. Sipas Kraj\u00ebs, d\u00ebgjimi i komunikimeve t\u00eb prokuror\u00ebve t\u00eb SPAK me funksionar\u00eb t\u00eb zbatimit t\u00eb ligjit do t\u00eb p\u00ebrb\u00ebnte \u2018c\u00ebnim t\u00eb sekretit hetimor\u2019.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Po ashtu, ai v\u00ebren se duhet t\u00eb p\u00ebrgjohen minimalisht 268 persona si dhe familjar\u00ebt e tyre, \u00e7ka do t\u00eb sillte sipas tij bllokimin e pajisjes s\u00eb p\u00ebrgjimit, duke penguar realizimin e p\u00ebrgjimeve procedurale. SPAK konsideron se kryerja e nj\u00eb procedure t\u00eb till\u00eb \u00ebsht\u00eb n\u00eb pamund\u00ebsi fizike dhe kohore t\u00eb hetuesit t\u00eb BKH-s\u00eb.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Nd\u00ebrkoh\u00eb, drejtuesja e BKH-s\u00eb, Aida Veizaj (Hajnaj) prezanton probleme t\u00eb tjera nga ato t\u00eb Kraj\u00ebs. Ajo k\u00ebrkon ndryshime ligjore q\u00eb i japin asaj m\u00eb shum\u00eb pavar\u00ebsi procedurale dhe financiare nga Prokuroria e Posa\u00e7me.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Hajnaj vler\u00ebson si nj\u00eb ndryshim t\u00eb domosdosh\u00ebm m\u00ebnyr\u00ebn e miratimit t\u00eb struktur\u00ebs s\u00eb BKH-s\u00eb. Legjislacioni aktual p\u00ebrcakton se kjo struktur\u00eb rregullohet me udh\u00ebr t\u00eb p\u00ebrbashk\u00ebt t\u00eb drejtorit t\u00eb BKH-s\u00eb dhe drejtuesit t\u00eb Prokuroris\u00eb s\u00eb Posa\u00e7me, por Hajnaj k\u00ebrkon q\u00eb t\u00eb jet\u00eb e vetme p\u00ebr t\u00eb vendosur n\u00eb k\u00ebt\u00eb rast.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cP\u00ebrfshirja e drejtuesit t\u00eb PP-s\u00eb n\u00eb miratimin e struktur\u00ebs \u00ebsht\u00eb e panevojshme n\u00eb vler\u00ebsimin ton\u00eb, p\u00ebr sa koh\u00eb rregullimi i saj nuk prek apo ndikon n\u00eb hetimet procedurale n\u00ebn udh\u00ebheqjen e PP-s\u00eb,\u201d argumenton shefja e BKH-s\u00eb n\u00eb propozimin e saj drejtuar Kuvendit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Ajo e konsideron gjithashtu t\u00eb panevojsh\u00ebm komisionin e prokuror\u00ebve p\u00ebr mbik\u00ebqyrjen e drejtorit t\u00eb BKH-s\u00eb, duke e cil\u00ebsuar dispozit\u00ebn ligjore t\u00eb paqart\u00eb.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Hajnaj k\u00ebrkon q\u00eb drejtuesit t\u00eb SPAK t\u2019i hiqet e drejta p\u00ebr rekomandimin e pezullimit dhe shkarkimit t\u00eb z\u00ebvend\u00ebsdrejtorit t\u00eb BKH-s\u00eb dhe q\u00eb kjo kompetenc\u00eb t\u2019i kaloj asaj. Po ashtu, k\u00ebrkon q\u00eb drejtuesi i SPAK t\u00eb mos jap\u00eb p\u00eblqimin n\u00eb em\u00ebrimin e hetuesve t\u00eb BKH-s\u00eb, duke e konsideruar si akt formal, t\u00eb panevojsh\u00ebm dhe t\u00eb pavler\u00eb nga pik\u00ebpamja juridike.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">N\u00eb vijim, drejtuesja e BKH-s\u00eb v\u00ebren se ajo nuk ka funksion vet\u00ebm veprimtarin\u00eb procedurale, por edhe at\u00eb funksionale e menaxhimin e veprimtaris\u00eb administrative, financiare apo logjistike t\u00eb BKH-s\u00eb.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Hajnaj k\u00ebrkon t\u2019i jepet e drejta t\u00eb marr\u00eb pjes\u00eb n\u00eb hartimin e projekt-buxhetit n\u00eb bashk\u00ebpunim me drejtuesin e Prokuroris\u00eb s\u00eb Posa\u00e7me. Sipas saj, n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb u q\u00ebndrohet korrekt p\u00ebrcaktimeve t\u00eb ligjit se, SPAK p\u00ebrb\u00ebhet nga Prokuroria e Posa\u00e7me dhe BKH.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Kraja dhe Hajnaj bien dakord q\u00eb punonj\u00ebsit administrativ\u00eb n\u00eb t\u00eb dy strukturat t\u00eb p\u00ebrjashtohen nga detyrimi p\u00ebr t\u00eb deklaruar pasurin\u00eb, duke konsideruar t\u00eb nevojsh\u00ebm vet\u00ebm verifikimin e figur\u00ebs.<\/span><\/p>\n<p>An\u00ebtar\u00ebt e KLP k\u00ebrkojn\u00eb t\u00eb b\u00ebhen gjyqtar\u00eb<\/p>\n<p><span data-preserver-spaces=\"true\">P\u00ebrfaq\u00ebsuesit e K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Prokuroris\u00eb n\u00eb nj\u00eb seanc\u00eb me Komisionin e \u00c7\u00ebshtjeve Ligjore n\u00eb Kuvend. Foto: LSA<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">N\u00eb k\u00ebrkes\u00ebn drejtuar Kuvendit, K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb k\u00ebrkon q\u00eb an\u00ebtar\u00ebt jomagjistrat\u00eb t\u00eb ken\u00eb mund\u00ebsi q\u00eb n\u00eb p\u00ebrfundim t\u00eb mandatit t\u00eb tyre, t\u00eb \u2018katapultohen\u2019 si gjyqtar\u00eb n\u00eb gjykatat e Apeleve, pa kryer m\u00eb par\u00eb Shkoll\u00ebn e Magjistratur\u00ebs, q\u00eb nevojitet p\u00ebr t\u00eb p\u00ebrfituar statusin e magjistratit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cV\u00ebm\u00eb re se legjislatori n\u00eb rastin e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm, an\u00ebtar\u00ebt e Kolegjit t\u00eb Posa\u00e7\u00ebm t\u00eb Apelimit, Inspektorit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb, ka parashikuar nj\u00eb rregullim ligjor i cili u garanton atyre caktimin n\u00eb detyr\u00eb si gjyqtar apo prokuror Apeli,\u201d v\u00ebren KLP.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">K\u00ebshilli ankohet se an\u00ebtar\u00ebt e tij jan\u00eb t\u00eb vetmit funksionar\u00eb t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb q\u00eb nuk u garantohet vazhdim\u00ebsia n\u00eb sistem \u2013 \u00e7ka konsiderohet nj\u00eb munges\u00eb garancie p\u00ebr \u201cpaanshm\u00ebrin\u00eb, eficens\u00ebn dhe pavar\u00ebsin\u00eb e tyre\u201d.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">KLP i propozon Kuvendit dy alternativa; em\u00ebrimin e an\u00ebtar\u00ebve jo-prokuror\u00eb si gjyqtar\u00eb n\u00eb Apel pas p\u00ebrfundimit t\u00eb mandatit ose dh\u00ebnien e k\u00ebsaj garancie p\u00ebr nj\u00eb periudh\u00eb 10-vje\u00e7are nga data e konstituimit t\u00eb K\u00ebshillit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">KLP e justifikon k\u00ebt\u00eb k\u00ebrkes\u00eb me boshll\u00ebkun q\u00eb po krijohet n\u00eb radh\u00ebt e magjistrat\u00ebve si rezultat i procesit t\u00eb rivler\u00ebsimit kalimtar.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">P\u00ebr an\u00ebtar\u00ebt prokuror\u00eb t\u00eb K\u00ebshillit, k\u00ebrkohet q\u00eb t\u00eb ndryshohen kufizimet n\u00eb lidhje me vijueshm\u00ebrin\u00eb e karrier\u00ebs, ku sipas ligjit aktual p\u00ebrcaktohet se ata kthehen n\u00eb vendet e m\u00ebparshme t\u00eb pun\u00ebs dhe se nuk mund t\u00eb transferohen, t\u00eb ngrihen n\u00eb detyr\u00eb ose t\u00eb delegohen gjat\u00eb tre viteve pas p\u00ebrfundimit t\u00eb mandatit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">KLP k\u00ebrkon q\u00eb an\u00ebtar\u00ebve prokuror\u00eb t\u2019u garantohet e drejta p\u00ebr zhvillimin e karrier\u00ebs s\u00eb tyre n\u00eb p\u00ebrputhje me parimin e proporcionalitetit, duke p\u00ebrcaktuar n\u00eb m\u00ebnyr\u00eb taksative pozicionin se ku do t\u00eb caktohet an\u00ebtari q\u00eb vjen nga shkalla e par\u00eb pas p\u00ebrfundimit t\u00eb mandadit, si dhe duke shmangur konkfliktin e interesit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Tjet\u00ebr propozim i KLP-s\u00eb \u00ebsht\u00eb shtimi i funksionit t\u00eb \u201ck\u00ebshilltarit ligjor\u201d n\u00eb struktur\u00ebn e zyrave t\u00eb prokurorive t\u00eb juridiksionit t\u00eb p\u00ebrgjithsh\u00ebm. Nd\u00ebrkoh\u00eb, k\u00ebrkohet q\u00eb k\u00ebshilltar\u00ebt dhe ndihm\u00ebsit ligjor\u00eb t\u00eb ken\u00eb mund\u00ebsin\u00eb e zhvillimit t\u00eb karrier\u00ebs brenda gjyq\u00ebsorit. Sipas KLP, nj\u00eb eksperienc\u00eb pune t\u00eb pakt\u00ebn 5-vje\u00e7are si k\u00ebshilltar apo ndihm\u00ebs ligjor, t\u00eb vler\u00ebsohet e arsyeshme p\u00ebr t\u00eb krijuar hap\u00ebsir\u00ebn e em\u00ebrimit si magjistrat.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Shkolla e Magjistratur\u00ebs dhe KLP k\u00ebrkojn\u00eb q\u00eb p\u00ebr nj\u00eb periudh\u00eb tranzitore, programi i formimit fillestar p\u00ebr magjistrat\u00ebt me koh\u00ebzgjatje 3 vjet t\u00eb b\u00ebhet 2 vjet. Sipas propozimeve, kjo mund\u00ebsohet me shkrirjen e vitit t\u00eb praktik\u00ebs para-profesionale me vitin e praktik\u00ebs profesionale.
