Shehaj pretendoi se kishte arritur t\u00eb kund\u00ebrshtonte barr\u00ebn e prov\u00ebs dhe k\u00ebrkoi konfirmimin n\u00eb detyr\u00eb.<\/p>\n<p>Trupa e KPK q\u00eb po kryen rivler\u00ebsimin e gjyqtares Enerieta Shehaj kryesohej nga Firdes Shuli, me relatore Xhensila Pinen dhe an\u00ebtar Olsi Komicin. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Theo Jacobs.<\/p>\n<p>Enerjeta Shehaj i p\u00ebrfundoi studimet n\u00eb Shkoll\u00ebn e Magjistratur\u00ebs n\u00eb vitin 2008 dhe pas nj\u00eb periudhe stazhi n\u00eb Gjykat\u00ebn e Tiran\u00ebs, u em\u00ebrua gjyqtare n\u00eb Gjykat\u00ebn e Kavaj\u00ebs. Prej vitit 2013, Znj. Shehaj e ushtron funksionin e gjyqtares pran\u00eb Gjykat\u00ebs Administrative t\u00eb Tiran\u00ebs.<\/p>\n<p>Barra e prov\u00ebs p\u00ebr apartamentin<\/p>\n<p>Prokurorja Enerjeta Shehaj u p\u00ebrball me t\u00eb nj\u00ebjt\u00ebn barr\u00eb prove p\u00ebr burimet e blerjes s\u00eb nj\u00eb apartamenti n\u00eb Tiran\u00eb si dhe bashk\u00ebshorti i saj, Erjon Shehaj, prokuror n\u00eb Prokurorin\u00eb e Lezh\u00ebs.<\/p>\n<p>Prokurori Shehaj arriti ta bindte Komisionin p\u00ebr ligjshm\u00ebrin\u00eb e burimeve t\u00eb disa huave dhe arriti t\u00eb kaloj\u00eb vetingun n\u00eb shkall\u00eb t\u00eb par\u00eb. Megjithat\u00eb, konfirmimi i tij u ankimua n\u00eb Kolegj p\u00ebr probleme profesionale.<\/p>\n<p>Bashk\u00ebshort\u00ebt Shehaj kan\u00eb pasqyruar n\u00eb deklarat\u00ebn \u201cveting\u201d apartamentin me sip\u00ebrfaqe 84 m2 + 10 m2 n\u00eb Tiran\u00eb, me kontrat\u00eb premtim shitje t\u00eb n\u00ebn\u00ebnshkruar n\u00eb janar 2014, p\u00ebr vler\u00ebn 62 mij\u00eb euro. Po ashtu, \u00ebsht\u00eb sh\u00ebnuar si detyrim nj\u00eb kredi e vitit 2009 n\u00eb vler\u00ebn totale 4 milion\u00eb lek\u00eb p\u00ebr blerjen e apartamentit, hua 2.5 milion\u00eb lek\u00eb nga babai i bashk\u00ebshortit t\u00eb marr\u00eb po m\u00eb n\u00eb 2009-\u00ebn, mb\u00ebshtetur n\u00eb nj\u00eb deklarat\u00eb noteriale t\u00eb atij viti. Si detyrime p\u00ebr k\u00ebt\u00eb pasuri jan\u00eb deklaruar dhe nj\u00eb hua tjet\u00ebr n\u00eb vler\u00ebn 14 mij\u00eb euro, marr\u00eb nga vjehrri i subjektit n\u00eb vitin 2013 dhe nj\u00eb k\u00ebst i pashlyer n\u00eb shum\u00ebn 2900 euro.<\/p>\n<p>Nga hetimi ka rezultuar se subjekti dhe bashk\u00ebshorti kan\u00eb porositur fillimisht n\u00eb vitin 2009 nj\u00eb apartament me sip\u00ebrfaqe 75 m2 tek i nj\u00ebjti pallat dhe n\u00eb 2014-\u00ebn jan\u00eb dakord\u00ebsuar p\u00ebr nd\u00ebrrimin me nj\u00eb banes\u00eb tjet\u00ebr me sip\u00ebrfaqe m\u00eb t\u00eb madhe kundrejt nj\u00eb vlereshtes\u00eb, q\u00eb \u00ebsht\u00eb apartamenti q\u00eb ata zot\u00ebrojn\u00eb aktualisht.<\/p>\n<p>Prej analizimit t\u00eb burimeve t\u00eb deklaruara, ka rezultuar se kredia nuk mund t\u00eb kishte sh\u00ebrbyer p\u00ebr shlyrjen e k\u00ebstit t\u00eb par\u00eb n\u00eb maj t\u00eb 2009-\u00ebs n\u00eb vler\u00ebn 30 mij\u00eb euro, pasi \u00ebsht\u00eb disbursuar disa muaj m\u00eb von\u00eb.<\/p>\n<p>Bashk\u00ebshorti dhe subjekti kan\u00eb shpjeguar se n\u00eb kushte t\u00eb ngutshme p\u00ebr shlyerjen e k\u00ebstit t\u00eb par\u00eb, kan\u00eb biseduar me familjar\u00ebt dhe nj\u00eb i af\u00ebrm \u00ebsht\u00eb ofruar p\u00ebr dh\u00ebnien e nj\u00eb huaje deri n\u00eb momentin e marrjes s\u00eb kredis\u00eb. Si burim p\u00ebr k\u00ebt\u00eb hua jan\u00eb deklaruar t\u00eb ardhurat e kompanis\u00eb q\u00eb zot\u00ebronte i af\u00ebrmi S.\u00c7..<\/p>\n<p>P\u00ebr t\u00eb provuar dh\u00ebnien e huas\u00eb n\u00eb shum\u00ebn 30 mij\u00eb euro, si dhe mund\u00ebsin\u00eb financiare t\u00eb huadh\u00ebn\u00ebsit, subjekti ka dor\u00ebzuar si prova nj\u00eb deklarat\u00eb noteriale t\u00eb vitit 2009 t\u00eb n\u00ebnshkruar prej t\u00eb af\u00ebrmit dhe babait t\u00eb bashk\u00ebshortit, si dhe dokumentacionin p\u00ebr t\u00eb ardhurat e shoq\u00ebris\u00eb s\u00eb tij.<\/p>\n<p>Babai i bashk\u00ebshortit t\u00eb subjektit ka deklaruar se e merrte huan\u00eb 30 mij\u00eb euro me q\u00ebllim p\u00ebr t\u2019ia dh\u00ebn\u00eb djalit q\u00eb t\u00eb prenotonte nj\u00eb apatament n\u00eb Tiran\u00eb dhe se gjith\u00eb vler\u00ebn do ta shlyente deri n\u00eb fund t\u00eb vitit 2009.<\/p>\n<p>\u201cDuket se bashk\u00ebshorti i subjektit n\u00eb p\u00ebrfundim t\u00eb procesit t\u00eb vetingut ka deklaruar nj\u00eb burim t\u00eb ri t\u00eb t\u00eb ardhurave p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb\u201d, deklaroi Pine.<\/p>\n<p>Komisioni ka verifikuar edhe huan\u00eb tjet\u00ebr t\u00eb deklaruar se \u00ebsht\u00eb marr\u00eb nga vjehrri i subjektit n\u00eb shum\u00ebn 2.5 milion\u00eb lek\u00eb, me burim t\u00eb ardhurat nga emigracioni dhe shitja e nj\u00eb trualli n\u00eb vitin 2001.<\/p>\n<p>Komisioni v\u00ebren se nuk \u00ebsht\u00eb depozituar dokumentacion lidhur me t\u00eb ardhurat nga emigracioni, nd\u00ebrsa ka rezultuar se trualli \u00ebsht\u00eb shitur p\u00ebr shum\u00ebn 400 mij\u00eb lek\u00eb.<\/p>\n<p>Bazuar n\u00eb k\u00ebto rezultate, KPK e cil\u00ebson t\u00eb paqart\u00eb situat\u00ebn se si vjehrri i subjektit ka marr\u00eb hua nga i af\u00ebrmi p\u00ebr t\u2019ia dh\u00ebn\u00eb hua djalit me q\u00ebllim blerjen e apartamentit, kur mund t\u00eb ishte vet\u00eb ky i fundit q\u00eb t\u2019i merrte. Po ashtu, nuk jan\u00eb gjetur gjurm\u00eb financiare t\u00eb marrjes s\u00eb k\u00ebtyre huave, t\u00eb destinacionit t\u00eb shumave, si dhe koha dhe m\u00ebnyra e shlyerjes s\u00eb huave nga vjehrri.<\/p>\n<p>\u201cSubjekti  nuk ka arritur t\u00eb provoj\u00eb rregjistrimin e veprimeve noteriale n\u00eb rregjistrin noterial q\u00eb t\u00eb v\u00ebrtetoj\u00eb kryerjen e aktit noterial t\u00eb vitit 2013\u201d, theksoi Pine.<\/p>\n<p>Nga hetimi ka rezultuar se babai i bashk\u00ebshortit t\u00eb subjektit nuk mundej q\u00eb t\u00eb jepte hua nj\u00eb pjes\u00eb t\u00eb shum\u00ebs 2.5 milion\u00eb lek\u00eb n\u00eb vitin 2009 dhe p\u00ebr k\u00ebt\u00eb arsye kjo vler\u00eb nuk \u00ebsht\u00eb pasqyruar n\u00eb analiz\u00eb kjo vler\u00eb.<\/p>\n<p>Sipas Komisionit, duket se subjekti dhe bashk\u00ebshorti i saj nuk kan\u00eb arritur t\u00eb dokumentojn\u00eb burimet e deklaruara t\u00eb t\u00eb ardhurave q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr pages\u00ebn  e shum\u00ebs prej 30 mij\u00eb euro n\u00eb vitin 2009, gjetje p\u00ebr t\u00eb cil\u00ebn i \u00ebsht\u00eb kaluar Shehaj barra e prov\u00ebs.<\/p>\n<p>P\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb n\u00eb shum\u00ebn 15 mij\u00eb e 600 euro, t\u00eb shlyer me kredin\u00eb, nuk jan\u00eb gjetur probleme.<\/p>\n<p>Si burim p\u00ebr pages\u00ebn e vler\u00ebs s\u00eb shtuar si pasoj\u00eb e ndryshimit t\u00eb apartamentit, n\u00eb shum\u00ebn 13 mij\u00eb e 500 euro, \u00ebsht\u00eb deklaruar nj\u00eb hua e marr\u00eb nga babai i bashk\u00ebshortit t\u00eb subjektit, n\u00eb vler\u00ebn 14 mij\u00eb euro. Por, KPK v\u00ebren se huaja nuk \u00ebsht\u00eb deklaruar si shtes\u00eb n\u00eb cash-in e vitin 2013.<\/p>\n<p>Bazuar n\u00eb k\u00ebto gjetje, KPK nuk e ka p\u00ebrfshir\u00eb n\u00eb analiz\u00eb huan\u00eb 14 mij\u00eb euro dhe p\u00ebr rrjedhoj\u00eb ka rezultuar pamund\u00ebsi p\u00ebr shlyerjen e k\u00ebstit 13 mij\u00eb e 500 euro.<\/p>\n<p>Gjyqtarja Shehaj theksoi se veprimet e kryera p\u00ebr shlyerjen e k\u00ebsteve t\u00eb apartamenteve, p\u00ebrputhen me deklarimet vjetore. Ajo pretendoi se kishte dor\u00ebzuar dokumentacion ligjor q\u00eb v\u00ebrtetonte burimet e ligjshme t\u00eb huadh\u00ebn\u00ebsve, si t\u00eb vjeherrit ashtu dhe t\u00eb kush\u00ebririt t\u00eb bashk\u00ebshortit.<\/p>\n<p>Subjekti shpjegoi se huaja n\u00eb vitin 2009 ishte marr\u00eb pasi nuk ishte p\u00ebrfituar ende kredia. Ajo v\u00ebrejti se huadh\u00ebn\u00ebsi ishte djali i xhaxhait t\u00eb bashk\u00ebshortit, q\u00eb ishte aksioneri kryesor i kompanis\u00eb ku ai ishte ortak dhe k\u00ebmb\u00ebnguli se ai kishte pasur mund\u00ebsi p\u00ebr dh\u00ebnien e vler\u00ebs 30 mij\u00eb euro.<\/p>\n<p>P\u00ebrfaq\u00ebsuesi i ONM-s\u00eb, Theo Jacobs u ndal n\u00eb faktin se deklarata noteriale p\u00ebr marrjen e huas\u00eb n\u00eb vitin 2013 nuk rezultonte e regjistruar, si dhe rip\u00ebrs\u00ebriti gjetjet e KPK-s\u00eb p\u00ebr huan\u00eb 14 mij\u00eb euro t\u00eb marr\u00eb n\u00eb vitin 2013, konkretisht p\u00ebr munges\u00ebn e dokumentacionit p\u00ebr transferimin e shum\u00ebs n\u00eb fjal\u00eb; p\u00ebr mosdeklarimin si gjendje cash.<\/p>\n<p>Ai evidentoi faktin se noteri q\u00eb kishte p\u00ebrpiluar dkelarat\u00ebn e huadh\u00ebnies ishte arrestuar p\u00ebr abuzime. \u201cNoteri e regjistron tek regjistri i tij, pr nuk mund t\u00eb regjistrohet n\u00eb librat e t\u00eb dh\u00ebnave n\u00eb Ministrin\u00eb e drejt\u00ebsis\u00eb\u201d, v\u00ebrejti Jacobs.<\/p>\n<p>Shehaj pranoi se noteri n\u00eb fjal\u00eb ishte arrestuar, por ajo k\u00ebmb\u00ebnguli se nuk kishte lidhje me aktin noterial p\u00ebr huadh\u00ebnie. \u201cP\u00ebrzgjedhja e noterit ka qen\u00eb rast\u00ebsore se jan\u00eb fqinj me familjen e bashk\u00ebshortit prej reth 40 vitesh\u201d, sqaroi Shehaj dhe shtoi se p\u00ebrgjegj\u00ebsia e saj kishte t\u00eb b\u00ebnte me deklarimin rregullisht t\u00eb deklarat\u00ebs noteriale t\u00eb huas\u00eb, si n\u00eb deklaratat periodike, ashtu dhe n\u00eb at\u00eb \u201cveting\u201d.<\/p>\n<p>N\u00eb seanc\u00eb u relatua nd\u00ebr t\u00eb tjera edhe p\u00ebrdorimi i nj\u00eb automjeti n\u00eb pron\u00ebsi t\u00eb v\u00ebllait t\u00eb subjektit. Nga hetimi ka rezultuar se bashk\u00ebshort\u00ebt Shehaj e kan\u00eb p\u00ebrdorur k\u00ebt\u00eb mjet p\u00ebr t\u00eb udh\u00ebtuar jasht\u00eb shtetit, edhe para se t\u00eb blihej nga familjari i tyre.<\/p>\n<p>Komisioni evidentoi se v\u00ebllai i subjektit nuk ka qen\u00eb n\u00eb Shqip\u00ebri n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb shitblerjes s\u00eb mjetit q\u00eb e ka b\u00ebr\u00eb pronar. Po ashtu, n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb q\u00eb \u00ebsht\u00eb n\u00ebnshkruar kontrata e shitblerjes, u \u00ebsht\u00eb dh\u00ebn\u00eb e drejta e p\u00ebrdorimit motr\u00ebs dhe bashk\u00ebshortit t\u00eb saj.<\/p>\n<p>Nisur nga k\u00ebto fakte, KPK i ka k\u00ebrkuar subjektit q\u00eb t\u00eb provoj\u00eb burimin e ligjsh\u00ebm t\u00eb v\u00ebllait p\u00ebr blerjen e k\u00ebsaj pasurie.<\/p>\n<p>Komisioneri Komici dhe Jacobs ngrit\u00ebn dyshime mbi marr\u00ebdh\u00ebnien e subjektit me mjetin n\u00eb p\u00ebrdorim. Sipas Komicit, dukej se subjekti zot\u00ebronte dy automjete, nj\u00eb n\u00eb p\u00ebrdorim dhe nj\u00eb tjet\u00ebr q\u00eb e kishin bler\u00eb.<\/p>\n<p>Shehaj argumentoi se nuk kishte logjik\u00eb q\u00eb n\u00ebse do t\u00eb kishin nj\u00eb mjet n\u00eb zot\u00ebrim, t\u00eb blinin nj\u00eb tjet\u00ebr brenda nj\u00eb kohe t\u00eb shkurt\u00ebr. Ajo u shpreh se e kan\u00eb p\u00ebrdorur vet\u00ebm nj\u00ebher\u00eb jasht\u00eb shtetit makin\u00ebn e v\u00ebllait dhe p\u00ebrpara se ai ta blinte. Sipas saj, kishte qen\u00eb nj\u00eb nevoj\u00eb e momentit, p\u00ebr t\u00eb mund\u00ebsuar udh\u00ebtimin.<\/p>\n<p> Figura dhe profesionalizmi<\/p>\n<p>Gjyqtarja Shehaj u vler\u00ebsua pozitivisht p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs. Lidhur me profesionalizmin Komisioni u ndal n\u00eb denoncimet e kryer nga publiku lidhur me disa \u00e7\u00ebshtje t\u00eb gjykuara prej subjektit.<\/p>\n<p>Ka qen\u00eb ONM q\u00eb i ka k\u00ebrkuar Komisionit t\u00eb verifikoj\u00eb kat\u00ebr \u00e7\u00ebshtje t\u00eb shqyrtuara prej subjektit.<\/p>\n<p>Shehaj u pyet nga p\u00ebrfaq\u00ebsuesi ONM-s\u00eb lidhur me vendimarrjen e saj p\u00ebr nj\u00eb padi ku ngriheshin pretendime p\u00ebr zaptim t\u00eb tok\u00ebs n\u00ebp\u00ebrmjet dokumenteve t\u00eb falsifikuara.<\/p>\n<p>Sipas relatores Pine, gjat\u00eb gjykimit t\u00eb k\u00ebsaj \u00e7\u00ebshtje, \u00ebsht\u00eb k\u00ebrkuar pezullimi i gjykimit me argumentin se nj\u00eb leje nd\u00ebrtimi n\u00eb tok\u00ebn ku kishte mbivendosje t\u00eb pronar\u00ebve, ishte n\u00eb proces penal.<\/p>\n<p>Por gjyqtarja Shehaj ka vler\u00ebsuar se pretendimet kan\u00eb pasur t\u00eb b\u00ebjn\u00eb me nj\u00eb kuad\u00ebr pretendimesh p\u00ebr pavlefshm\u00ebrin\u00eb relative t\u00eb aktit dhe jo pavlefshm\u00ebrin\u00eb absolute, ashtu si ka parashtruar n\u00eb fillim t\u00eb k\u00ebrkes\u00eb padis\u00eb pala padit\u00ebse. Bazuar n\u00eb k\u00ebto argumente, Shehaj ka vendosur ta rr\u00ebzoj\u00eb padin\u00eb.<\/p>\n<p>Komisioni vler\u00ebson se Shehaj duhej t\u00eb kishte pezulluar gjykimin deri sa t\u00eb v\u00ebrtetohej n\u00ebse kishte ose jo vep\u00ebr penale t\u00eb falsifikimit, si dhe se ajo kishte p\u00ebr detyr\u00eb t\u00eb zbatonte vendimin Unifikues t\u00eb Kolegjeve t\u00eb Bashkuar nr. 3\/2012 dhe Kodin e Procedur\u00ebs Sivile p\u00ebr t\u00eb zbuluar shkakun e padis\u00eb duke analizuar padin\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e saj \u2013 jo duke u kufizuar vet\u00ebm n\u00eb dispozitat ligjore t\u00eb referuara nga padit\u00ebsi.<\/p>\n<p>Pine theksoi se, n\u00eb gjykimin e k\u00ebsaj \u00e7\u00ebshtje, subjekti ka manifestuar mang\u00ebsi n\u00eb drejtim t\u00eb interpretimit dhe zbatimit t\u00eb ligjit, si dhe ka treguar mang\u00ebsi n\u00eb arsyetimin ligjor.<\/p>\n<p>Jacobs v\u00ebrejti se vendimarrja e subjektit kishte ndihmuar nj\u00eb subjekt q\u00eb t\u00eb nd\u00ebrtonte n\u00eb tok\u00ebn e tjetrit duke p\u00ebrdorur dokumente t\u00eb falsifikuara. \u201cDenoncuesi k\u00ebrkoi q\u00eb t\u00eb ndalohej kjo paligjshm\u00ebri. Ai shkoi edhe n\u00eb prokurori. Por fal\u00eb jush, dikush nd\u00ebrtoi me dokumente false n\u00eb tok\u00ebn e tjetrit. Ju kishit detyr\u00ebn si gjyqtare q\u00eb t\u00eb prisnit p\u00ebrfundimin e hetimeve. Ju e lejuat k\u00ebt\u00eb paligjshm\u00ebri\u201d, konstatoi Jacobs.<\/p>\n<p>Gjyqtarja Shehaj pranoi se ishte e v\u00ebrtet\u00eb se trajtimi i \u00e7\u00ebshtjes nga ana e saj kishte qen\u00eb teorik. Ajo u justifikua me faktin se edhe aktualisht ka \u00e7\u00ebshtje p\u00ebr nd\u00ebrtime pa leje q\u00eb trajtohen administrativisht dhe penalisht.
