{"id":316010,"date":"2023-03-14T14:22:06","date_gmt":"2023-03-14T13:22:06","guid":{"rendered":"https:\/\/zjarr.tv\/?p=316010"},"modified":"2023-03-14T14:22:06","modified_gmt":"2023-03-14T13:22:06","slug":"opinion-nga-avokati-erald-aga-procesi-i-audimit-e-rindertimit-te-banesave-50-vjecare-dhe-reforma-agrare-1946","status":"publish","type":"post","link":"https:\/\/zjarr.tv\/en\/opinion-nga-avokati-erald-aga-procesi-i-audimit-e-rindertimit-te-banesave-50-vjecare-dhe-reforma-agrare-1946\/","title":{"rendered":"Opinion nga Avokati Erald Aga \/ Pro\u00e7esi i Audimit e Rind\u00ebrtimit t\u00eb banesave 50 vje\u00e7are dhe Reforma Agrare 1946"},"content":{"rendered":"<p>Opinion nga Avokati Erald Aga \/ QYTETAR\u00cb ZGJOHUNI SA NUK \u00cbSHT\u00cb AKOMA VON\u00cb!<br \/>\nPro\u00e7esi i Audimit e Rind\u00ebrtimit t\u00eb banesave 50 vje\u00e7are dhe Reforma Agrare 1946.<br \/>\nPeriudha post-t\u00ebrmet deri tek projekt vendimit p\u00ebr auditimin e banesave mbi 50 vje\u00e7are?<br \/>\nPas t\u00ebrmetit t\u00eb 26 N\u00ebntorit 2019 shteti shqiptar me q\u00ebllimin n\u00eb dukje \u201cp\u00ebr t\u00eb ndihmuar pronar\u00ebt nga pasojat e t\u00ebrmetit\u201d miratoi:<br \/>\n\u2022 Aktin normativ nr 9 dat\u00eb 16.12.2019 \u201cP\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsive natyrore\u201d;<br \/>\n\u2022 VKM nr 7 dat\u00eb 06.01.2020 \u201cP\u00ebr kushtet dhe procedur\u00ebn p\u00ebr shpron\u00ebsimet dhe\/ose shk\u00ebmbimin e pron\u00ebs, p\u00ebr interes publik, n\u00eb funksion t\u00eb procesit t\u00eb rind\u00ebrtimit\u201d me an\u00eb t\u00eb cil\u00ebs ngarkoi nj\u00ebsit\u00eb e qeverisjes vendore p\u00ebr t\u00eb vijuar me procesin e rind\u00ebrtimit;<br \/>\n\u2022 Ndryshimet ligjore n\u00eb ligjin nr 8561, dat\u00eb 22.12.1999 \u201cP\u00ebr shpron\u00ebsimet dhe marrjen n\u00eb p\u00ebrdorim t\u00eb p\u00ebrkohsh\u00ebm t\u00eb pasuris\u00eb pron\u00eb private p\u00ebr interes publik\u201d, ku m\u00eb kryesoret ishin ndryshimi t\u00ebr\u00ebsor i nenit 7 dhe shtimi i pikave \u00eb dhe g n\u00eb nenin 8 t\u00eb k\u00ebtij ligji;<br \/>\n\u2022 VKM nr 904, dat\u00eb 24.12.2019 \u201cP\u00ebr p\u00ebrcaktimin e rregullave, t\u00eb kategorive prioritare, mas\u00ebs s\u00eb p\u00ebrfitimit, autoriteteve p\u00ebrgjegj\u00ebse dhe procedurave p\u00ebr vler\u00ebsimin dhe p\u00ebrzgjedhjen e p\u00ebrfituesve nga disa programe t\u00eb procesit t\u00eb rind\u00ebrtimit \u201d ndryshuar pika 23 me VKM nr 51 dat\u00eb 27.01.2021.<br \/>\nCitim i dispozitave thelb\u00ebsore t\u00eb kuadrit ligjor t\u00eb \u201crind\u00ebrtimit\u201d<br \/>\nNeni 7<br \/>\nObjekte t\u00eb shpron\u00ebsimit<br \/>\nObjekte t\u00eb shpron\u00ebsimit jan\u00eb pasurit\u00eb e paluajtshme n\u00eb form\u00ebn e tok\u00ebs, t\u00eb nd\u00ebrtimeve t\u00eb \u00e7do lloji, me karakter t\u00eb p\u00ebrhersh\u00ebm, pasurit\u00eb e luajtshme t\u00eb treguara n\u00eb shkronjat \u201ce\u201d dhe \u201c\u00eb\u201d, t\u00eb nenit 8, t\u00eb k\u00ebtij ligji, kulturat bujq\u00ebsore, si dhe \u00e7do investim tjet\u00ebr i trup\u00ebzuar n\u00eb tok\u00ebn bujq\u00ebsore, q\u00eb do t\u00eb shpron\u00ebsohet.<br \/>\nNeni 8<br \/>\nShkaku i shpron\u00ebsimit<br \/>\n\u00eb) P\u00ebr rastet kur objekte t\u00eb luajtshme e t\u00eb paluajtshme, p\u00ebr shkaqe objektive, n\u00eb kushtet e degradimit ose forc\u00ebs madhore, krijojn\u00eb rrezik t\u00eb p\u00ebrhersh\u00ebm p\u00ebr sigurin\u00eb dhe sh\u00ebndetin publik ose krijojn\u00eb rreziqe p\u00ebr zhvillimin e q\u00ebndruesh\u00ebm, n\u00eb at\u00eb shkall\u00eb q\u00eb me gjith\u00eb ndihm\u00ebn e shtetit, k\u00ebto rreziqe nuk mund t\u00eb parandalohen nga pronari i tyre.<br \/>\ng) P\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsis\u00eb natyrore, sipas parashikimeve t\u00eb legjislacionit n\u00eb fuqi.<br \/>\nVKM 904 dat\u00eb 24.12.2019<br \/>\n23. Marr\u00ebveshja paraprake dhe kontrata p\u00ebr kalimin e banesave\/sht\u00ebpive individuale n\u00eb pron\u00ebsi t\u00eb subjekteve p\u00ebrfituese t\u00eb programeve t\u00eb rind\u00ebrtimit dhe\/ose atyre n\u00eb funksion t\u00eb procesit t\u00eb rind\u00ebrtimit duhet t\u00eb p\u00ebrmbajn\u00eb, t\u00eb pakt\u00ebn,parashikimet e modeleve tip, q\u00eb i bashk\u00eblidhen k\u00ebtij vendimi dhe jan\u00eb pjes\u00eb p\u00ebrb\u00ebr\u00ebse t\u00eb tij. Kontrata duhet t\u00eb shoq\u00ebrohet me deklarat\u00ebn noteriale t\u00eb heqjes dor\u00eb, nga subjektet p\u00ebrfituese, nga \u00e7do pretendim mbi t\u00eb drejtat e pron\u00ebsis\u00eb p\u00ebr banes\u00ebn apo sht\u00ebpin\u00eb individuale t\u00eb m\u00ebparshme, p\u00ebrve\u00e7 rasteve kur parashikohet ndryshe n\u00eb k\u00ebt\u00eb vendim ose n\u00eb aktin normativ nr. 9, dat\u00eb 16.12.2019, t\u00eb K\u00ebshillit t\u00eb Ministrave, \u201cP\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsis\u00eb natyrore\u201d, t\u00eb miratuar me ligjin nr. 97\/2019, si kusht p\u00ebr p\u00ebrfitimin nga programet e procesit t\u00eb rind\u00ebrtimit. Regjistrimi i akteve kryhet nga Agjencia Shtet\u00ebrore e Kadastr\u00ebs, n\u00eb em\u00ebr t\u00eb p\u00ebrfituesit.<br \/>\nT\u00eb kat\u00ebrta k\u00ebto nisma ligjore t\u00eb shtetit shqiptar n\u00eb dukje ngjasojn\u00eb si veprime rutin\u00eb ligjore tekniko-administrative p\u00ebr kalimin e zakonsh\u00ebm t\u00eb tok\u00ebs nga duart e pronar\u00ebve n\u00eb duart e shtetit q\u00eb ky i fundit t\u00eb rind\u00ebrtoj\u00eb e t\u00eb ndihmoj\u00eb pronar\u00ebt q\u00eb u d\u00ebmtuan nga t\u00ebrmeti.<br \/>\nP\u00ebrkundrazi, n\u00eb analiz\u00eb t\u00eb ftoht\u00eb dhe t\u00eb thell\u00eb juridike k\u00ebto kat\u00ebr nisma ligjore t\u00eb nj\u00ebpasnj\u00ebshme kan\u00eb shnd\u00ebrruar marr\u00ebdh\u00ebnien e pron\u00ebsis\u00eb s\u00eb pronar\u00ebve mbi tok\u00ebn, zhdukjen dhe zhveshjen p\u00ebrfundimisht t\u00eb pronar\u00ebve nga e drejta e pron\u00ebs, si dhe kufizimin e thell\u00eb t\u00eb s\u00eb drejt\u00ebs s\u00eb pron\u00ebs private mbi tok\u00ebn.<br \/>\nN\u00eb thelb k\u00ebto nisma ligjore kan\u00eb tjet\u00ebrsuar me detyrim pronat e pronar\u00ebve (banesa dhe trualli mbi t\u00eb cilat ngriheshin banesat ) ku e gjith\u00eb toka private (trualli) dhe banesat apo pallatet q\u00eb ngriheshin mbi pronat e pronar\u00ebve me nisjen e procesit t\u00eb \u201crind\u00ebrtimit\u201d kalonin n\u00eb pron\u00ebsi t\u00eb shtetit pa t\u00eb drejt\u00eb p\u00ebr pronar\u00ebt p\u00ebr t\u00eb pretenduar n\u00eb t\u00eb ardhmen pron\u00ebsin\u00eb mbi trualli apo objektet q\u00eb rind\u00ebrtoheshin n\u00eb pron\u00ebn e tyre. P\u00ebr t\u00eb kamufluar k\u00ebt\u00eb zhvatje t\u00eb pron\u00ebs private, zhveshje t\u00eb pronar\u00ebve nga e drejta pron\u00ebs shteti vendosi t\u2019i kompesonte pronar\u00ebt me nj\u00eb banes\u00eb t\u00eb nd\u00ebrtuar nga vet\u00eb shteti diku n\u00eb periferi t\u00eb Tiran\u00ebs me kushtin e vet\u00ebm q\u00eb k\u00ebta shtetas \u201cish-pronar\u00eb\u201d thjesht\u00eb t\u00eb banonin sepse nuk do t\u00eb kishin t\u00eb drejt\u00ebn t\u00eb shitnin apo dhuronin banes\u00ebn e dhuruar nga shteti n\u00eb funksion t\u00eb rind\u00ebrtimit.<br \/>\nPak kujtes\u00eb mbi \u201cReform\u00ebn Agrare 1946\u201d<br \/>\nAjo sh\u00ebnoi shnd\u00ebrrimin demokratik t\u00eb marr\u00ebdh\u00ebnieve t\u00eb pron\u00ebsis\u00eb mbi tok\u00ebn, zhdukjen p\u00ebrfundimisht t\u00eb mbeturinave t\u00eb feudalizmit n\u00eb ekonomi dhe t\u00eb klas\u00ebs s\u00eb \u00e7ifligar\u00ebve, si dhe kufizimin e thell\u00eb t\u00eb s\u00eb drejt\u00ebs s\u00eb pron\u00ebs private mbi tok\u00ebn.<br \/>\nSipas ligjit u shpron\u00ebsuan dhe u tjet\u00ebrsuan me detyrim e pa shp\u00ebrblim tokat pron\u00eb e shtetit \u00e7ifligaro-borgjez, prona e \u00e7ifligar\u00ebve dhe e institucioneve fetare, e gjith\u00eb toka private q\u00eb kalonte madh\u00ebsin\u00eb e parashikuar prej ligjit (mbi 5 ha). Pjesa m\u00eb e madhe e tok\u00ebs s\u00eb shpron\u00ebsuar iu shp\u00ebrnda falas fshatar\u00ebsis\u00eb punonj\u00ebse sipas parimit \u00abToka i p\u00ebrket atij q\u00eb e punon\u00bb. Pjesa fjet\u00ebr e tok\u00ebs u shpall tok\u00eb shtet\u00ebrore dhe mbi baz\u00ebn e saj u krijuan nd\u00ebrmarrje shtet\u00ebrore.<br \/>\nSa m\u00eb lart, po t\u00eb heqim nj\u00eb vij\u00eb paralele me nismat ligjore t\u00eb \u201cReform\u00ebs s\u00eb Pro\u00e7esit t\u00eb Rind\u00ebrtimit\u201d, fare qart\u00eb dallohet q\u00eb t\u00eb dy k\u00ebto \u201creforma\u201d ngjasojn\u00eb si dy pika uji por me nj\u00eb avantazh t\u00eb madh t\u00eb \u201cReform\u00ebs Agrare\u201d n\u00eb fillimet e saj e cila i la nj\u00eb pjes\u00eb t\u00eb caktuar t\u00eb pasuris\u00eb s\u00eb paluajtshme pronar\u00ebve q\u00eb t\u00eb silleshin si pronar\u00eb. Kurse \u201cReforma e Procesit t\u00eb Rind\u00ebrtimit\u201d q\u00eb n\u00eb nisje t\u00eb saj i ka zhveshur t\u00ebr\u00ebsisht pronar\u00ebt nga e drejta pron\u00ebsis\u00eb dhe prona e tyre p\u00ebrvec se shpallet tok\u00eb shtet\u00ebrore por mbi k\u00ebto prona \u201cinvestuesi strategjik privat\u201d nd\u00ebrton pallate e komplekse pallatesh duke ushtruar aktivitet t\u00ebr\u00ebrsisht ekonomik. Pra, shteti me \u201cReform\u00ebn e Procesit t\u00eb Rind\u00ebrtimit\u201d dhe \u201cLigjit t\u00eb Shpron\u00ebsimit\u201d merr rolin e \u201cRobin Hood\u201d duke i marr\u00eb pron\u00ebn private pronar\u00ebve dhe duke ja dh\u00ebn\u00eb firma private t\u00eb nd\u00ebrtimit t\u00eb cilat me kosto thuajse zero nd\u00ebrtojn\u00eb e zhvillojn\u00eb biznes tek \u201cish pronat\u201d e pronar\u00ebve.<br \/>\nPor si nisi Reforma Agrare e PKSh-s\u00eb?<br \/>\n1.Konfiskimi i pasurive bujq\u00ebsore<br \/>\nKonfiskimin e pronave t\u00eb luajtshme dhe t\u00eb paluajtshme.<br \/>\n2.Komisionet dhe zyrat p\u00ebr tokat e shtetit<br \/>\nU ngrit nj\u00eb komision p\u00ebr tokat e shtetit, i cili kishte si detyr\u00eb p\u00ebr t\u00eb studiuar gjedjen e pasurive t\u00eb luajtshme dhe t\u00eb paluajtshme.<br \/>\n3.Ndalimi i shitblerjes, tjet\u00ebrsimit dhe hipotekimit t\u00eb pronave bujq\u00ebsore nga pronar\u00ebt legjitim\u00eb<br \/>\nU miratua nj\u00eb urdh\u00ebres\u00eb drejtuar komiteteve ekzekutive t\u00eb k\u00ebshillave nacional\u00e7lirimtare t\u00eb prefekturave dhe n\u00ebnprefekturave p\u00ebr ndalimin e shitblerjes, hipotekimit, pjestimit dhe tjet\u00ebrsimit t\u00eb pronave bujq\u00ebsore. Zyrat noteriale dhe t\u00eb hipotek\u00ebs u ndaluan t\u00eb l\u00ebshonin akte q\u00eb kishin si objekt shitblerjen ose, ndryshimin e gjendjes juridike t\u00eb tokave bujq\u00ebsore.<br \/>\n4. Miratimi i ligjint p\u00ebr Reform\u00ebn Agrare.<br \/>\nFaza 1: Sipas k\u00ebtij ligji, do t\u00eb shpron\u00ebsoheshin familjet e m\u00ebdha, bashk\u00ebsit\u00eb fetare dhe pronar\u00ebt.<br \/>\nFaza 2: Sipas saj, \u00e7do kryefamiljari nuk i jepej m\u00eb shum\u00eb se pes\u00eb hektar\u00eb tok\u00eb dhe kur familja i kalonte gjasht\u00eb frym\u00eb, p\u00ebr \u00e7do kuror\u00eb shtes\u00eb, jepeshin edhe dy hektar\u00eb.<br \/>\nPra, kat\u00ebr nisma ligjore gjat\u00eb koh\u00ebs pas t\u00ebrmetit n\u00ebntor 2019 &#8211; janar 2021 dhe 4 nisma ligjore edhe gjat\u00eb koh\u00ebs s\u00eb \u201cReform\u00ebs Agrare\u201d. Kushdo q\u00eb i lexon me pak kujdes dhe pak v\u00ebmendje do t\u00eb kuptoj\u00eb q\u00eb gjat\u00eb \u201cReform\u00ebs Agrare\u201d shtetasit pronar\u00eb kishin m\u00eb shum\u00eb t\u00eb drejta p\u00ebr g\u00ebzimin e pron\u00ebs dhe kompesoheshin shum\u00eb her\u00eb m\u00eb mir\u00eb sesa gjat\u00eb \u201cReform\u00ebs s\u00eb Procesit t\u00eb Rind\u00ebrtimit\u201d.<br \/>\nT\u00eb gjith\u00eb e dim\u00eb se cfar\u00eb ndodhi m\u00eb pas me \u201cReform\u00ebn Agrare\u201d ku brenda nj\u00eb kohe t\u00eb shkurt\u00ebr nisi shtet\u00ebzimi dhe kolektivizimi i tok\u00ebs bujq\u00ebsore. Pronar\u00ebt e tokave u shpall\u00ebn kulak\u00eb dhe iu n\u00ebnshtruan persekutimit, internimit dhe burgosjes. Nd\u00ebrkoh\u00eb, me \u201cReform\u00ebn e Procesit t\u00eb Rind\u00ebrtimit\u201d pronar\u00ebt zhvishen q\u00eb n\u00eb momentin e par\u00eb nga e drejta e pron\u00ebsis\u00eb dhe m\u00eb pas \u201cshp\u00ebrblehen\u201d, \u201ckompesohen\u201d me nj\u00eb \u201cpron\u00eb\u201d t\u00eb cil\u00ebn nuk kan\u00eb t\u00eb drejt\u00eb as ta shesin e sa ta dhurojn\u00eb.<br \/>\nVlen p\u00ebr t\u00eb theksuar se gjat\u00eb periudh\u00ebs dhjetor 2019 deri n\u00eb janar 2021 nuk \u00ebsht\u00eb nd\u00ebrmarr\u00eb asnj\u00eb nism\u00eb ligjore konkrete, asnj\u00eb aksion ligjor me natyr\u00eb kushtetuese nga subjektet kushtetuese t\u00eb p\u00ebrcaktuara nga neni 134 i kushtetut\u00ebs si:<br \/>\na) Presidentit t\u00eb Republik\u00ebs;<br \/>\nb) Kryeministrit;<br \/>\nc) jo m\u00eb pak se nj\u00eb t\u00eb pest\u00ebs s\u00eb deputet\u00ebve;<br \/>\n\u00e7) Avokatit t\u00eb Popullit;<br \/>\nd) Kryetarit t\u00eb Kontrollit t\u00eb Lart\u00eb t\u00eb Shtetit;<br \/>\ndh) \u00e7do gjykate, sipas nenit 145, pika 2, t\u00eb k\u00ebsaj Kushtetute;<br \/>\ne) \u00e7do komisioneri t\u00eb krijuar me ligj p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive themelore t\u00eb garantuara nga Kushtetuta;<br \/>\n\u00eb) K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor dhe K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Prokuroris\u00eb;<br \/>\nf) organeve t\u00eb qeverisjes vendore;<br \/>\ng) organeve t\u00eb bashk\u00ebsive fetare;<br \/>\ngj) partive politike;<br \/>\nh) organizatave; si edhe<br \/>\ni) individ\u00ebt p\u00ebr \u00e7\u00ebshtje q\u00eb lidhen me interesat e tyre.<br \/>\nN\u00eb m\u00ebnyr\u00eb t\u00eb till\u00eb q\u00eb t\u00eb vinin n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese p\u00ebr t\u2019i shpallur si anti kushtetuese k\u00ebto akte ligjore dhe n\u00ebnligjore.<br \/>\nZgjidhja e problemit<br \/>\nReferuar nenit 50 t\u00eb ligjit \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese\u201d, k\u00ebrkesat n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr pajtueshm\u00ebrin\u00eb e ligjit ose t\u00eb akteve t\u00eb tjera normative me Kushtetut\u00ebn ose me marr\u00ebveshjet nd\u00ebrkomb\u00ebtare t\u00eb ratifikuara, mund t\u00eb paraqiten brenda dy vjet\u00ebve nga hyrja n\u00eb fuqi e aktit.
