LEYLA MOSES-ONES<\/strong><br \/>\n<strong>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0\u00a0 E NGARKUAR ME PUN\u00cb E AMBASAD\u00cbS S\u00cb SHTETEVE T\u00cb BASHKUARA T\u00cb AMERIK\u00cbS N\u00cb REPUBLIK\u00cbN E SHQIP\u00cbRIS\u00cb<\/strong><\/p>\n<p><strong>TIRAN\u00cb<\/strong><\/p>\n<p><strong>E nderuar zonja Llagami,<\/strong><\/p>\n<p>Institucioni i Presidentit t\u00eb Republik\u00ebs me shkres\u00eb nr. 1778 prot, dat\u00eb 06.06.2019 ka p\u00ebrcjell\u00eb pran\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor (KLGJ) shqet\u00ebsimin e Presidentit t\u00eb Republik\u00ebs mbi situat\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb p\u00ebr shkak t\u00eb mosfunksionimit t\u00eb institucioneve m\u00eb t\u00eb larta t\u00eb dh\u00ebnies s\u00eb drejt\u00ebsis\u00eb, n\u00eb t\u00eb cilat p\u00ebrfshihet edhe Gjykata e Lart\u00eb.<\/p>\n<p>Si\u00e7 \u00ebsht\u00eb cituar n\u00eb shkres\u00ebn nr.1778 prot, dat\u00eb 06.06.2019, Gjykata e Lart\u00eb prej nj\u00eb periudhe t\u00eb gjat\u00eb kohe ka funksionuar me nj\u00eb trup\u00eb gjyq\u00ebsore t\u00eb cunguar, deri me vet\u00ebm 3 gjyqtar\u00eb nga 19 q\u00eb ka qen\u00eb numri i p\u00ebrgjithsh\u00ebm i tyre.\u00a0Nd\u00ebrkoh\u00eb q\u00eb, aktualisht Gjykata e Lart\u00eb ka ngelur vet\u00ebm me dy an\u00ebtar\u00eb duke e patur t\u00eb pamundur ligj\u00ebrisht t\u00eb formoj\u00eb nj\u00eb trup\u00eb gjykuese, si dhe duke dal\u00eb praktikisht jasht\u00eb funksionit t\u00eb saj.<\/p>\n<p>Neni 136 i Kushtetut\u00ebs parashikon se, Gjyqtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb em\u00ebrohen nga Presidenti i Republik\u00ebs, me propozim t\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor, p\u00ebr nj\u00eb mandat 9-vje\u00e7ar, pa t\u00eb drejt\u00eb riem\u00ebrimi. Nd\u00ebrsa neni 179, pika 12, paragrafi i 2-t\u00eb i Kushtetut\u00ebs, parashikon se me krijimin e K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor, Presidenti em\u00ebron gjyqtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb, sipas nenit 136 t\u00eb Kushtetut\u00ebs.<\/p>\n<p>Pra, referuar k\u00ebtyre dispozitave kushtetuese, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor (KLGj) \u00ebsht\u00eb organi i cili duhet t\u2019i propozoj\u00eb Presidentit t\u00eb Republik\u00ebs kandidat\u00ebt q\u00eb zgjidhen nga rradh\u00ebt e jurist\u00ebve p\u00ebr t\u2019u em\u00ebruar n\u00eb Gjykat\u00ebn e Lart\u00eb, si dhe gjyqtar\u00ebt q\u00eb promovohen p\u00ebr n\u00eb k\u00ebt\u00eb Gjykat\u00eb.<\/p>\n<p>Bazuar n\u00eb k\u00ebto parashikime kushtetuese, referuar faktit q\u00eb deri n\u00eb k\u00ebto momente pran\u00eb Institucionit t\u00eb Presidentit t\u00eb Republik\u00ebs nuk \u00ebsht\u00eb administruar asnj\u00eb propozim nga K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor, si dhe n\u00eb kushtet kur ekziston nj\u00eb paqart\u00ebsi se deri kur do t\u00eb zgjas\u00eb kjo gjendje n\u00eb Gjykat\u00ebn e Lart\u00eb, Presidenti i Republik\u00ebs, Sh. T. Z. Ilir Meta, n\u00eb zbatim t\u00eb nenit 92\/h t\u00eb Kushtetut\u00ebs, me shkres\u00ebn nr.1778 prot, dat\u00eb 06.06.2019, i ka k\u00ebrkuar institucionit tuaj informacion mbi dy aspekte thelb\u00ebsore dhe m\u00eb konkretisht:<\/p>\n<ol>\n<li>Informacion mbi ecurin\u00eb dhe veprimtarin\u00eb e deritanishme t\u00eb KLGJ-s\u00eb p\u00ebr procesin e shpalljes dhe administrimit t\u00eb aplikimeve p\u00ebr plot\u00ebsimin e vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb, si dhe n\u00eb \u00e7far\u00eb faze \u00ebsht\u00eb procesi i verifikimit dhe vler\u00ebsimit nga K\u00ebshilli n\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje me kaq r\u00ebnd\u00ebsi p\u00ebr vendin.<\/li>\n<li>Referuar gjithashtu t\u00eb dh\u00ebnave t\u00eb b\u00ebra publike, Presidenti i Republik\u00ebs ka k\u00ebrkuar informacion n\u00ebse pran\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor \u00ebsht\u00eb administruar opinion i misionit t\u00eb ekspertiz\u00ebs s\u00eb BE-s\u00eb \u201cEuralius V\u201d, ku i sugjerohet K\u00ebshillit (KLGJ) p\u00ebrdorimi i nj\u00eb skeme provizore\/zgjidhje sui generis p\u00ebr plot\u00ebsimin e vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb, duke caktuar an\u00ebtar\u00eb \u201ct\u00eb p\u00ebrkohsh\u00ebm\u201d n\u00eb k\u00ebt\u00eb gjykat\u00eb n\u00ebp\u00ebrmjet skem\u00ebs s\u00eb delegimit nga gjykatat e niveleve m\u00eb t\u00eb ulta, p\u00ebr t\u00eb formuar trup\u00ebn gjyq\u00ebsore t\u00eb p\u00ebrkohshme n\u00eb Gjykat\u00ebn e Lart\u00eb, derisa t\u00eb riformohet numri i tri kolegjeve.<\/li>\n<\/ol>\n<p>N\u00eb p\u00ebrgjigje t\u00eb k\u00ebrkes\u00ebs p\u00ebr informacion, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor, n\u00ebp\u00ebrmjet Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm me shkres\u00eb nr. 3061\/1 prot, dat\u00eb 18.06.2019, ka konfirmuar vet\u00ebm faktin se:<\/p>\n<p>\u201cPran\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor n\u00eb rrug\u00eb elektronike nga Misioni \u2018EURALIUS V\u2019, ka ardhur nj\u00eb opinion, i cili \u00ebsht\u00eb nj\u00eb dokument pune, n\u00eb proces p\u00ebrpunimi dhe vler\u00ebsimi si nga K\u00ebshilli, ashtu dhe nga EURALIUS-i. Ky dokument nuk i \u00ebsht\u00eb n\u00ebnshtruar ende vler\u00ebsimit nga K\u00ebshilli dhe n\u00eb momentin q\u00eb do t\u00eb ket\u00eb nj\u00eb q\u00ebndrim t\u00eb till\u00eb, institucioni juaj do t\u00eb b\u00ebhet me dije\u201d.\u00a0Bashk\u00eblidhur \u00ebsht\u00eb d\u00ebrguar dhe opinioni i Misionit \u201cEURALIUS V\u201d.<\/p>\n<p>P\u00ebrgjigja e institucionit tuaj ndaj k\u00ebrkes\u00ebs s\u00eb Presidentit t\u00eb Republik\u00ebs nuk p\u00ebrmbush kriteret formale dhe p\u00ebrmbajt\u00ebsore.<\/p>\n<p>S\u00eb pari,\u00a0referuar p\u00ebrmbajtjes s\u00eb p\u00ebrgjigjes s\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor dh\u00ebn\u00eb me shkres\u00eb nr. 3061\/1 prot, dat\u00eb 18.06.2019, evidentohet se ka nj\u00eb munges\u00eb impenjimi t\u00eb KLGJ-s\u00eb p\u00ebr t\u2019i kthyer nj\u00eb p\u00ebrgjigje shteruese k\u00ebrkes\u00ebs s\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr nj\u00eb ?\u00ebshtje kaq t\u00eb r\u00ebnd\u00ebsishme.<\/p>\n<p>K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor nuk i ka kthyer p\u00ebrgjigje Presidentit t\u00eb Republik\u00ebs p\u00ebr informacionin e k\u00ebrkuar mbi ecurin\u00eb dhe veprimtarin\u00eb e deritanishme t\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor p\u00ebr gjith\u00eb procesin e shpalljes dhe administrimit t\u00eb aplikimeve sipas Kushtetut\u00ebs dhe ligjit p\u00ebr plot\u00ebsimin e vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb, si dhe n\u00eb \u00e7far\u00eb faze \u00ebsht\u00eb procesi i verifikimit dhe vler\u00ebsimit nga K\u00ebshilli.<\/p>\n<p>K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor \u00ebsht\u00eb konstituuar m\u00eb dat\u00eb\u00a020 dhjetor 2018, kur zhvilloi mbledhjen e tij t\u00eb par\u00eb, duke zgjedhur Kryetarin e k\u00ebtij organi dhe ka deklaruar me vendim si dat\u00eb t\u00eb krijimit t\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor dat\u00ebn\u00a012.12.2018. N\u00eb nenin 174 pika 1, shkronja \u201ca\u201d, \u201cAktet n\u00ebnligjore\u201d, t\u00eb ligjit nr. 96\/2016 \u201cP\u00ebr statusin e Gjyqtar\u00ebve dhe t\u00eb Prokuror\u00ebve n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, parashikohet shprehimisht se:<\/p>\n<p>\u201cNgarkohen K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor dhe K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb\u00a0t\u00eb miratojn\u00eb rregullat e detajuara, sipas parashikimeve dhe afateve t\u00eb k\u00ebtij ligji.\u00a0a) Brenda tre muajve nga krijimi i K\u00ebshillave, aktet q\u00eb lidhen me aktivitete jasht\u00eb funksionit, krijimin e dosjeve personale, caktimin e p\u00ebrkohsh\u00ebm n\u00eb detyr\u00eb t\u00eb t\u00eb em\u00ebruarve t\u00eb rinj n\u00eb pozicione t\u00eb komanduara, magjistrat\u00ebt n\u00eb skem\u00ebn e delegimit,\u00a0ngritjen n\u00eb detyr\u00eb n\u00eb nivele m\u00eb t\u00eb larta ose t\u00eb specializuara, em\u00ebrimin e an\u00ebtar\u00ebve jogjyqtar\u00eb t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, em\u00ebrimin e Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm dhe caktimet n\u00eb pozicionet e p\u00ebrkohshme\u201d.<\/p>\n<p>Pra sipas k\u00ebsaj dispozite, rezulton se KLGJ-ja ka tejkaluar afatin fillestar 3-mujor t\u00eb p\u00ebrcaktuar nga neni 174\/1, shkronja \u201ca\u201d e ligjit nr. 96\/2016, edhe me m\u00eb shum\u00eb se 3-muaj t\u00eb tjer\u00eb, periudh\u00eb brenda t\u00eb cil\u00ebs k\u00ebshilli duhej t\u00eb kishte miratuar t\u00eb gjitha aktet e nevojshme n\u00ebnligjore p\u00ebr t\u00eb nisur procedurat e plot\u00ebsimit t\u00eb vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb sipas kushtetut\u00ebs dhe ligjit.<\/p>\n<p>Ky afat 3-mujor i p\u00ebrcaktuar nga ligji ka p\u00ebrfunduar n\u00eb dat\u00ebn 12 mars 2019, nd\u00ebrkoh\u00eb q\u00eb, nga ky moment kan\u00eb kaluar edhe 3 muaj e 20 dit\u00eb t\u00eb tjera dhe ende K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor rezulton q\u00eb se nuk ka p\u00ebrmbushur detyrimet e tij ligjore.<\/p>\n<p>N\u00eb k\u00ebt\u00eb situat\u00eb, Presidenti i Republik\u00ebs k\u00ebrkon, sa m\u00eb par\u00eb, informacion nga KLGJ-ja, se ?far\u00eb \u00ebsht\u00eb b\u00ebr\u00eb konkretisht deri m\u00eb tani mbi k\u00ebt\u00eb \u00e7\u00ebshtje, p\u00ebr t\u00eb identifikuar qart\u00ebsisht se cila ka qen\u00eb arsyeja e tejkalimit t\u00eb afatit ligjor p\u00ebr hartimin e akteve n\u00ebnligjore, zbatimi i t\u00eb cilave do t\u00eb b\u00ebnte t\u00eb mundur m\u00eb pas nisjen e procedurave ligjore p\u00ebr plot\u00ebsimin e vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb.<\/p>\n<p>A \u00ebsht\u00eb shkaktuar kjo shkelje e afateve ligjore p\u00ebr shkaqe t\u00eb pavarura nga vullneti i KLGJ-s\u00eb dhe cila ka qen\u00eb problematika dhe faktor\u00ebt q\u00eb kan\u00eb ndikuar n\u00eb k\u00ebt\u00eb situat\u00eb ?<\/p>\n<p>N\u00ebse KLGJ-ja \u00ebsht\u00eb ndeshur me shkaqe t\u00eb pavarura prej saj, q\u00eb mund t\u00eb vijn\u00eb nga identifikimi i problematik\u00ebs n\u00eb cil\u00ebsin\u00eb e ligjit, Presidenti i Republik\u00ebs, k\u00ebrkon t\u00eb informohet gjithashtu me faktin n\u00ebse K\u00ebshilli ka k\u00ebrkuar ose jo pran\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb apo Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb ndryshime n\u00eb legjislacion p\u00ebr p\u00ebrmir\u00ebsimin e tij?<\/p>\n<p>Kjo \u00e7\u00ebshtje nuk \u00ebsht\u00eb nj\u00eb zgjedhje p\u00ebr KLGJ-n\u00eb, por nj\u00eb detyr\u00eb e p\u00ebrcaktuar drejtp\u00ebrdrejt\u00eb nga ligji nr.115\/2016 \u201cP\u00ebr organet e qeverisjes n\u00eb sistemin e drejt\u00ebsis\u00eb\u201d, ku n\u00eb nenin 93, pikat 1 dhe 3 t\u00eb k\u00ebtij ligji parashikohet tekstualisht se:<\/p>\n<p>\u201c1. K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr t\u00eb shprehur mendime dhe p\u00ebr t\u00eb b\u00ebr\u00eb propozime lidhur me ndryshimet n\u00eb legjislacionin, q\u00eb mund t\u00eb ndikoj\u00eb n\u00eb pun\u00ebn e gjyq\u00ebsorit dhe \u00e7do \u00e7\u00ebshtje tjet\u00ebr q\u00eb \u00ebsht\u00eb n\u00ebn p\u00ebrgjegj\u00ebsin\u00eb e K\u00ebshillit.<\/p>\n<ol start=\"3\">\n<li>K\u00ebshilli i propozon Ministrit t\u00eb Drejt\u00ebsis\u00eb ushtrimin e nism\u00ebs p\u00ebr ndryshime ligjore n\u00eb lidhje me \u00e7do \u00e7\u00ebshtje q\u00eb \u00ebsht\u00eb n\u00ebn p\u00ebrgjegj\u00ebsin\u00eb e tij.\u201d.<\/li>\n<\/ol>\n<p>N\u00eb k\u00ebto kushte, Presidenti i Republik\u00ebs k\u00ebrkon t\u00eb informohet n\u00eb m\u00ebnyr\u00eb shteruese nga KLGJ-ja p\u00ebr nj\u00eb vler\u00ebsim t\u00eb k\u00ebtij organi mbi shkakun e vonesave.<\/p>\n<p>K\u00ebrkesa p\u00ebr informacion mb\u00ebshtetet jo vet\u00ebm n\u00eb nenin 92\/h t\u00eb Kushtetut\u00ebs, por dhe referuar kompetencave q\u00eb ka Presidenti i Republik\u00ebs sipas nenit 136 t\u00eb saj, n\u00eb t\u00eb cilin parashikohet e drejta e Presidentit t\u00eb Republik\u00ebs n\u00eb procesin e em\u00ebrimit t\u00eb gjyqtar\u00ebve t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, q\u00eb eventualisht po cenohen nga mosveprimi apo nga vonesat e K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor (KLGJ).<\/p>\n<p>K\u00ebto vonesa n\u00eb kryerjen e procedurave p\u00ebrkat\u00ebse cenojn\u00eb drejtp\u00ebrdrejt\u00eb funksionalitetin e Gjykat\u00ebs s\u00eb Lart\u00eb dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb edhe stabilitetin e sistemit gjyq\u00ebsor n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p>Mungesa e funksionalitetit t\u00eb Gjykat\u00ebs t\u00eb Lart\u00eb, ve\u00e7 t\u00eb tjerave, p\u00ebrb\u00ebn shkelje t\u00eb drejt\u00ebp\u00ebrdrejt\u00eb t\u00eb nenit 42\/2 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb cil\u00ebsis\u00eb s\u00eb dh\u00ebnies s\u00eb drejt\u00ebsis\u00eb p\u00ebr qytetar\u00ebt q\u00eb kan\u00eb t\u00eb drejt\u00eb t\u00eb shqyrtojn\u00eb pretendimet e tyre n\u00ebp\u00ebrmjet mb\u00ebshtetje t\u00eb nenit 92\/h dhe n\u00eb zbatim t\u00eb nenit 136 t\u00eb Kushtetut\u00ebs, k\u00ebrkon nga K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor nj\u00eb informacion shterues dhe t\u00eb plot\u00eb p\u00ebr \u00e7\u00ebshtjet e parashtruara m\u00eb sip\u00ebr dhe angazhimin maksimal t\u00eb k\u00ebtij organi p\u00ebr t\u00eb p\u00ebrmbushur q\u00ebllimin kushtetues.<\/p>\n<p>S\u00eb dyti,\u00a0referuar p\u00ebrmbajtjes s\u00eb dokumentit \u201cOpinion Ligjor\u201d, \u201cMbi situat\u00ebn emergjente n\u00eb Gjykat\u00ebn e Lart\u00eb\u201d t\u00eb dat\u00ebs 29 maj 2019, t\u00eb hartuar nga ekspert\u00ebt e Misionit \u201cEURALIUS V\u201d, Presidenti i Republik\u00ebs vler\u00ebson t\u00eb domosdoshme t\u00eb paraqes\u00eb vler\u00ebsimin e Tij si m\u00eb posht\u00eb.<\/p>\n<p>Dokumenti \u201cOpinion Ligjor\u201d, \u201cMbi situat\u00ebn emergjente n\u00eb Gjykat\u00ebn e Lart\u00eb\u201d i dat\u00ebs 29 maj 2019, i hartuar nga ekspert\u00ebt e misionit \u201cEURALIUS V\u201d Grzegorz Borko\u00ebski dhe Klodian Rado, rezulton se \u00ebsht\u00eb dh\u00ebn\u00eb n\u00eb kuad\u00ebr t\u00eb k\u00ebrkes\u00ebs s\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor drejtuar misionit \u201cEuralius\u201d, p\u00ebr t\u2019iu p\u00ebrgjigjur pyetjes n\u00ebse ka baz\u00eb ligjore p\u00ebr t\u2019i dh\u00ebn\u00eb zgjidhje m\u00eb t\u00eb shpejta situat\u00ebs emergjente (nd\u00ebrkoh\u00eb q\u00eb hartimi i akteve n\u00ebnligjore p\u00ebr procedur\u00ebn e ngritjes n\u00eb detyr\u00eb t\u00eb gjyqtar\u00ebve dhe p\u00ebr em\u00ebrimin e jo-gjyqtar\u00ebve \u00ebsht\u00eb ende n\u00eb proces).<\/p>\n<p>Nga informacioni q\u00eb jepet n\u00eb dokumentin e prodhuar nga misioni Euralius dhe referuar p\u00ebrmbajtjes s\u00eb p\u00ebrgjigjes s\u00eb KLGJ-s\u00eb dh\u00ebn\u00eb me shkres\u00eb nr. 3061\/1 prot, dat\u00eb 18.06.2019 rezulton se, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor deri m\u00eb dat\u00eb 29 maj 2019, ende nuk ka hartuar dhe miratuar t\u00eb gjitha aktet e nevojshme n\u00ebnligjore p\u00ebr procedurat e ngritjes n\u00eb detyr\u00eb t\u00eb gjyqtar\u00ebve dhe p\u00ebr em\u00ebrimin e an\u00ebtar\u00ebve jomagjistrat\u00eb, n\u00eb Gjykat\u00ebn e Lart\u00eb.<\/p>\n<p>Presidenti i Republik\u00ebs, referuar p\u00ebrmbajtjes s\u00eb k\u00ebtij opinioni ligjor dhe tejkalimit t\u00eb afatit nga KLGJ-ja p\u00ebr hartimin e akteve n\u00ebnligjore t\u00eb nevojshme, konstaton t\u00eb paarsyetuar faktin se p\u00ebrse nuk \u00ebsht\u00eb vepruar n\u00eb koh\u00ebn e duhur p\u00ebr t\u2019i k\u00ebrkuar EURALIUS-it t\u00eb gjith\u00eb ndihm\u00ebn dhe asistenc\u00ebn p\u00ebr t\u00eb hartuar dhe miratuar aktet n\u00ebnligjore t\u00eb nevojshme,\u00a0nd\u00ebrkoh\u00eb q\u00eb, i k\u00ebrkohet opinion p\u00ebr zgjidhjen e nj\u00eb situate \u201cemergjente\u201d, t\u00eb krijuar s\u00eb fundmi, kur Gjykata e Lart\u00eb ka ngelur vet\u00ebm me dy an\u00ebtar\u00eb.<\/p>\n<p>Si\u00e7 u p\u00ebrmend edhe m\u00eb sip\u00ebr, KLGJ-ja ka tejkaluar edhe me 3-muaj t\u00eb tjer\u00eb, afatin fillestar 3-mujor t\u00eb p\u00ebrcaktuar nga neni 174, pika 1\/a, t\u00eb ligjit nr.96\/2016, p\u00ebr miratimin e aktit n\u00ebnligjor q\u00eb do t\u00eb b\u00ebnte t\u00eb mundur nisjen e procedurave t\u00eb plot\u00ebsimit t\u00eb vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb.<\/p>\n<p>Pra n\u00eb kushtet kur kan\u00eb kaluar 6-muaj e 20 dit\u00eb nga momenti i krijimit t\u00eb KLGJ-s\u00eb dhe ende nuk jan\u00eb hartuar t\u00eb gjitha aktet n\u00ebnligjore p\u00ebr k\u00ebt\u00eb proces, paraqitja e gj\u00ebndjes s\u00eb emergjenc\u00ebs nga KLGJ dhe Euralius \u00ebsht\u00eb t\u00ebr\u00ebsisht e pajustifikuar.<\/p>\n<p>N\u00ebse K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor do t\u00eb kishte p\u00ebrmbyllur miratimin e akteve n\u00ebnligjore brenda afatit t\u00eb p\u00ebrcaktuar nga ligji (12 mars 2019), at\u00ebher\u00eb pas k\u00ebsaj periudhe q\u00eb ka kaluar do t\u00eb mund t\u00eb ishin hapur dhe procedurat p\u00ebr plot\u00ebsimin e vakancave n\u00eb Gjykat\u00ebn e Lart\u00eb dhe rrjedhimisht kjo gjykat\u00eb mund t\u00eb ishte sot funksionale.<\/p>\n<p>Referuar k\u00ebsaj gjendjeje, Presidenti i Republik\u00ebs shpreh q\u00ebndrimin se Kushtetuta dhe ligjet parashikojn\u00eb nj\u00eb mekaniz\u00ebm t\u00eb qart\u00eb p\u00ebr plot\u00ebsimin n\u00eb m\u00ebnyr\u00eb p\u00ebrhershme t\u00eb trup\u00ebs gjyq\u00ebsore t\u00eb Gjykat\u00ebs Lart\u00eb dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor ka p\u00ebrgjegj\u00ebsin\u00eb q\u00eb t\u00eb veproj\u00eb pa asnj\u00eb vones\u00eb p\u00ebr hartimin dhe miratimin e akteve n\u00ebnligjore me q\u00ebllim q\u00eb t\u00eb shpall\u00eb thirrjet p\u00ebr plot\u00ebsimin e t\u00eb gjitha vakancave n\u00eb k\u00ebt\u00eb gjykat\u00eb.<\/p>\n<p>Procesi i p\u00ebrzgjedhjes s\u00eb gjyqtar\u00ebve apo kandidaturave p\u00ebr t\u00eb qen\u00eb an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e drejtp\u00ebrdrejt\u00eb e KLGJ-s\u00eb. N\u00eb cil\u00ebsin\u00eb e organit p\u00ebrfitues t\u00eb ndihm\u00ebs nd\u00ebrkomb\u00ebtare KLGJ-ja, ka t\u00eb drejtat e plota t\u00eb k\u00ebrkoj\u00eb opinione mendime nga ekspertiza n\u00eb dispozicion, por n\u00eb zbatim t\u00eb Kushtetut\u00ebs dhe ligjit, \u00ebsht\u00eb KLGJ-ja organi i vet\u00ebm q\u00eb ka p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr suksesin apo d\u00ebshtimin n\u00eb zbatimin e tyre.<\/p>\n<p>Presidenti i Republik\u00ebs e mb\u00ebshtet rekomandimin e \u201cEURALIUS V\u201d, n\u00eb faqen e 7 t\u00eb dokumentit, n\u00eb kapitullin IV \u201cP\u00ebrfundim\u201d ku citohet se:<\/p>\n<p>\u201cNgritja n\u00eb detyr\u00eb e gjyqtar\u00ebve p\u00ebr n\u00eb Gjykat\u00ebn e Lart\u00eb dhe em\u00ebrimi i kandidat\u00ebve jogjyqtar\u00eb n\u00eb k\u00ebt\u00eb Gjykat\u00eb p\u00ebrb\u00ebjn\u00eb nj\u00eb p\u00ebrpar\u00ebsi themelore. KLGJ-s\u00eb i rekomandohet q\u00eb t\u00eb p\u00ebrshpejtoj\u00eb sa m\u00eb shum\u00eb q\u00eb t\u00eb jet\u00eb e mundur procesin e p\u00ebrpilimit t\u00eb akteve n\u00ebnligjore t\u00eb nevojshme, si dhe t\u00eb shpall\u00eb njoftimet p\u00ebr promovimin e gjyqtar\u00ebve p\u00ebr n\u00eb Gjykat\u00ebn e Lart\u00eb si dhe p\u00ebr em\u00ebrimin e kandidat\u00ebve q\u00eb vijn\u00eb nga jasht\u00eb gjyq\u00ebsorit\u201d.<\/p>\n<p>Sipas k\u00ebtij Opinioni Ligjor t\u00eb EURALIUS-it, evidentohet se, KLGJ-ja deri m\u00eb tani nuk ka arritur t\u00eb respektoj\u00eb detyrimin kushtetues dhe ligjor, n\u00eb drejtim t\u00eb afatit dhe p\u00ebrcaktimit t\u00eb rregullave p\u00ebr t\u00eb b\u00ebr\u00eb t\u00eb mundur propozimin e kandidaturave p\u00ebr em\u00ebrimin e gjyqtar\u00ebve t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb.<\/p>\n<p>P\u00ebrsa i takon pjes\u00ebs s\u00eb opinionit t\u00eb \u201cEURALIUS V\u201d, q\u00eb p\u00ebrmbyllet me rekomandim se:<\/p>\n<p>\u201cMe q\u00ebllim q\u00eb t\u00eb kalohet kjo periudh\u00eb tranzitore, nd\u00ebrkoh\u00eb q\u00eb procesi i ngritjes n\u00eb detyr\u00eb dhe i em\u00ebrimit n\u00eb Gjykat\u00ebn e Lart\u00eb nuk ka p\u00ebrfunduar ende, KLGJ-ja mund t\u00eb konsideroj\u00eb t\u00eb p\u00ebrdor\u00eb skem\u00ebn e delegimit dhe caktimin e gjyqtar\u00ebve t\u00eb p\u00ebrkohsh\u00ebm n\u00eb Gjykat\u00ebn e Lart\u00eb. P\u00ebrve\u00e7 k\u00ebsaj, n\u00ebse n\u00eb skem\u00ebn e delegimit nuk ka magjistrat\u00eb t\u00eb p\u00ebrshtatsh\u00ebm q\u00eb plot\u00ebsojn\u00eb kushtet p\u00ebr n\u00eb Gjykat\u00ebn e Lart\u00eb, at\u00ebher\u00eb referimi tek Neni 46 i Ligjit p\u00ebr Statusin do t\u00eb ishte i argumentuar dhe i mundsh\u00ebm, duke transferuar p\u00ebr nj\u00eb afat t\u00eb p\u00ebrkohsh\u00ebm, dhe me p\u00eblqimin e tyre n\u00eb Gjykat\u00ebn e Lart\u00eb, gjyqtar\u00eb me performanc\u00eb shum\u00eb t\u00eb mir\u00eb profesionale\u201d,\u00a0Presidenti i Republik\u00ebs vler\u00ebson se ky rekomandim i propozuar:<\/p>\n<p>\u2013 Cenon kompetencat kushtetuese t\u00eb Presidentit t\u00eb Republik\u00ebs;<br \/>\n\u2013 Ky propozim bie ndesh n\u00eb m\u00ebnyr\u00eb flagrante me parashikimet e nenit 136, 179 pika 4 e 12 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb;<br \/>\n\u2013 D\u00ebmton r\u00ebnd\u00eb q\u00ebllimet kryesore mbi t\u00eb cilat u nd\u00ebrmor dhe u miratua paketa kushtetuese dhe ligjore e reform\u00ebs n\u00eb sistemin e drejt\u00ebsis\u00eb;<br \/>\n\u2013 Cenon besimin e publikut tek organet e reja t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb;<br \/>\n\u2013 B\u00ebn t\u00eb mundur q\u00eb Gjykata e Lart\u00eb t\u00eb funksionoj\u00eb me gjyqtar\u00eb t\u00eb p\u00ebrkohsh\u00ebm, t\u00eb cil\u00ebt do t\u00eb ushtrojn\u00eb funksionet n\u00eb gjykat\u00ebn m\u00eb t\u00eb lar\u00eb t\u00eb vendit, pa kaluar m\u00eb par\u00eb procesin e rivler\u00ebsimit kalimtar, duke cenuar besimin tek reforma n\u00eb drejt\u00ebsi e miratuar 3-vjet m\u00eb par\u00eb.<\/p>\n<p>Ky opinion n\u00eb vetvete \u00ebsht\u00eb nj\u00eb p\u00ebrpjekje p\u00ebr t\u00eb ofruar nj\u00eb zgjidhje me mjete\u00a0ekstra ligjore\u00a0aspak kushtetuese e ligjore n\u00ebn argumentimin e situat\u00ebs emergjente. N\u00ebp\u00ebrmjet tij synohet s\u00eb pari t\u00eb fshihet problematika, apo mang\u00ebsit\u00eb q\u00eb mund t\u00eb paraqes\u00eb baza ligjore ekzistuese dhe prej s\u00eb cil\u00ebs mund t\u00eb jet\u00eb krijuar edhe kjo gjendje. P\u00ebr shkak t\u00eb p\u00ebrdorimit t\u00eb k\u00ebtij mekanizmi t\u00eb pap\u00ebrshtatsh\u00ebm t\u00eb propozuar nga Euralius mund t\u00eb b\u00ebhet i mundur promovimi p\u00ebrkoh\u00ebsisht n\u00eb karrier\u00eb i gjyqtar\u00ebve, q\u00eb nuk e meritojn\u00eb t\u00eb jen\u00eb pjes\u00eb e sistemit t\u00eb drejt\u00ebsis\u00eb dhe q\u00eb mund t\u00eb vler\u00ebsohen si t\u00eb till\u00eb nga organet e rivler\u00ebsimit kalimtar.<\/p>\n<p>Duhet t\u00eb kujtojm\u00eb q\u00eb misioni \u201cEURALIUS V\u201d, ka dh\u00ebn\u00eb ekspertiz\u00ebn e tij n\u00eb kuad\u00ebr t\u00eb hartimit dhe miratimit t\u00eb paket\u00ebs ligjore n\u00eb kuad\u00ebr t\u00eb reformimit t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, dhe n\u00ebse kjo paket\u00eb ligjore paraqet mang\u00ebsi, nj\u00eb pjes\u00eb t\u00eb k\u00ebsaj kostoje \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi edhe e k\u00ebtij misioni, i cili ka asistuar Komisionin e Posa\u00e7\u00ebm Parlamentar t\u00eb Reform\u00ebs n\u00eb Sistemin e Drejt\u00ebsis\u00eb dhe Kuvendin e Shqip\u00ebris\u00eb n\u00eb miratimin e ligjeve shoq\u00ebruese n\u00eb kuad\u00ebr t\u00eb reform\u00ebs n\u00eb sistemin e drejt\u00ebsis\u00eb.<\/p>\n<p>N\u00ebse paketa ligjore paraqet mang\u00ebsi, at\u00ebher\u00eb kjo gj\u00eb m\u00eb s\u00eb pari duhet t\u00eb pranohet, t\u00eb evidentohet dhe duhet t\u2019i b\u00ebhet menj\u00ebher\u00eb prezente p\u00ebr zgjidhje Kuvendit t\u00eb Shqip\u00ebris\u00eb.<\/p>\n<p>Kuvendi ka t\u00eb gjitha mund\u00ebsit\u00eb dhe nj\u00ebkoh\u00ebsisht detyrimin q\u00eb t\u00eb p\u00ebrmir\u00ebsoj\u00eb kuadrin ligjor ekzistues p\u00ebr t\u2019i dh\u00ebn\u00eb zgjidhje qoft\u00eb emergjenc\u00ebs s\u00eb krijuar p\u00ebr formimin e trupave gjyq\u00ebsore, ashtu dhe afati t\u00eb arsyesh\u00ebm t\u00eb 32 000 \u00e7\u00ebshtjeve t\u00eb mbartura, q\u00eb presin p\u00ebr t\u2019u shqyrtuar n\u00eb Gjykat\u00ebn e Lart\u00eb.<\/p>\n<p>Nuk \u00ebsht\u00eb logjike dhe aspak e drejt\u00eb q\u00eb duke argumentuar nj\u00eb situat\u00eb \u201cemergjence\u201d \u201cEURALIUS\u201d t\u00eb propozoj\u00eb zgjidhje t\u00eb tilla ekstraligjore q\u00eb cenojn\u00eb r\u00ebnd\u00eb parashikimet e Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/p>\n<p>Kjo, p\u00ebrve\u00e7se ul besimin tek reforma, vendos nj\u00ebkoh\u00ebsisht n\u00eb pik\u00ebpyetje serioze nivelin profesional dhe paanshm\u00ebrin\u00eb e k\u00ebtij misioni n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n<p>\u201cEURALIUS V\u201d \u00ebsht\u00eb mision ekspertize q\u00eb asiston t\u00eb gjitha organet e reja t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb ashtu dhe Kuvendin e Shqip\u00ebris\u00eb, dhe p\u00ebr k\u00ebt\u00eb duhet q\u00eb t\u00eb jap\u00eb opinione objektive p\u00ebr zgjidhje t\u00eb p\u00ebrshtatshme dhe t\u00eb koordinuara me t\u00eb gjith\u00eb aktor\u00ebt n\u00eb p\u00ebrputhje me Kushtetut\u00ebn, dhe jo t\u00eb keqintepretueshme.<\/p>\n<p>Nuk duhet t\u00eb harrojm\u00eb q\u00eb paketa kushtetuese e reform\u00ebs n\u00eb sistemin e drejt\u00ebsis\u00eb jo vet\u00ebm q\u00eb \u00ebsht\u00eb hartuar dhe miratuar nga Kuvendi i Shqip\u00ebris\u00eb me konsensus absolut, por ajo u realizua bazuar n\u00eb rekomandimet e vyera t\u00eb Komisionit prestigjioz t\u00eb Venecias, t\u00eb studiuara dhe t\u00eb konsultuara p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb me k\u00ebt\u00eb organiz\u00ebm k\u00ebshillimor t\u00eb K\u00ebshillit t\u00eb Evrop\u00ebs.<\/p>\n<p>Sistemi i drejt\u00ebsis\u00eb n\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb \u00ebsht\u00eb reformuar t\u00ebr\u00ebsisht duke nd\u00ebrtuar nj\u00eb mekaniz\u00ebm q\u00eb promovon funksionimin e tij me gjyqtar\u00eb dhe prokuror\u00eb t\u00eb zgjedhur n\u00eb m\u00ebnyr\u00eb p\u00ebrfundimtare me integritet t\u00eb lart\u00eb moral dhe profesional, t\u00eb cil\u00ebt meritojn\u00eb t\u00eb jen\u00eb pjes\u00eb e tij dhe kurrsesi me funksionar\u00eb t\u00eb caktuar dhe promovuar p\u00ebrkoh\u00ebsisht n\u00eb gjykatat e nivelit m\u00eb t\u00eb lart\u00eb t\u00eb vendit.<\/p>\n<p>Nuk \u00ebsht\u00eb aspak logjike parashikimet Kushtetuese.<br \/>\nT\u00eb drejtat themelore t\u00eb qytetar\u00ebve t\u00eb Shqip\u00ebris\u00eb p\u00ebr t\u00eb patur nj\u00eb shqyrtim gjyq\u00ebsor brenda nj\u00eb afati t\u00eb arsyesh\u00ebm dhe nga nj\u00eb gjykat\u00eb e caktuar me ligj, po cenohen haptazi nga grumbullimi i \u00e7\u00ebshtjeve t\u00eb mbartura n\u00eb Gjykat\u00ebn e Lart\u00eb, p\u00ebr t\u00eb cilat
