Krijimi i k\u00ebsaj vakance i \u00ebsht\u00eb njoftuar Presidentit t\u00eb Republik\u00ebs nga Gjykata Kushtetuese me shkres\u00eb nr.79 prot., dat\u00eb 25.02.2019 dhe \u00ebsht\u00eb shpallur nga Presidenti p\u00ebr aplikim me dekretin\u00a0 nr. 11133, dat\u00eb 04.03.2019.<\/p>\n<p>Si\u00e7 del qart\u00eb nga informacioni i p\u00ebrcjell\u00eb nga KED-ja, rezulton se Kryetari i KED-s\u00eb, n\u00eb t\u00eb nj\u00ebjt\u00ebn dat\u00eb 08.10.2019, ka realizuar procesin administrativ t\u00eb d\u00ebrgimit t\u00eb listave pran\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr plot\u00ebsimin e 2 (dy)vakancave nj\u00ebherazi. Nuk rezulton q\u00eb KED-ja, n\u00eb m\u00ebnyr\u00eb kolegjiale, t\u00eb ket\u00eb marr\u00eb ndonj\u00eb vendim p\u00ebr m\u00ebnyr\u00ebn dhe koh\u00ebn e d\u00ebrgimit t\u00eb listave pran\u00eb organeve t\u00eb em\u00ebrtes\u00ebs, por ky veprim administrativ \u00ebsht\u00eb kryer nga Kryetari i K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, i cili sipas nenit 226 pika 2\/e, t\u00eb ligjit nr.115\/2016, ka si funksion vet\u00ebm t\u00eb n\u00ebnshkruaj\u00eb aktet e verifikimit, vler\u00ebsimit dhe t\u00eb renditjes dhe t\u2019ia p\u00ebrcjell\u00eb ato organit t\u00eb em\u00ebrtes\u00ebs.<\/p>\n<p>Procedura administrative e ndjekur nga Kryetari i KED-s\u00eb p\u00ebr d\u00ebrgimin e listave, si\u00e7 do t\u00eb sqarohet edhe m\u00eb holl\u00ebsisht m\u00eb posht\u00eb, krijon kushtet e nj\u00eb v\u00ebshtir\u00ebsie ligjore, p\u00ebr t\u00eb mos th\u00ebn\u00eb q\u00eb n\u00eb nj\u00eb vler\u00ebsim prima facie b\u00ebn logjikisht t\u00eb pamundur q\u00eb brenda 30-dit\u00ebve, Presidenti i Republik\u00ebs t\u00eb respektoj\u00eb parashikimet kushtetuese q\u00eb diktojn\u00eb radh\u00ebn dhe alternimin e p\u00ebrzgjedhjes p\u00ebr em\u00ebrimin\/zgjedhjen e gjyqtar\u00ebve t\u00eb rinj kushtetues, respektivisht nga Presidenti i Republik\u00ebs dhe Kuvendi, n\u00eb cil\u00ebsin\u00eb e organit t\u00eb em\u00ebrtes\u00ebs.<\/p>\n<p>Procesi i em\u00ebrimit t\u00eb gjyqtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese, duhet t\u00eb realizohet n\u00eb respekt t\u00eb plot\u00eb me procedur\u00ebn dhe radh\u00ebn q\u00eb p\u00ebrcakton neni 179 pikat 2 dhe 12 t\u00eb Kushtetut\u00ebs dhe nenet 7 pika 2 dhe 86 pika 4, t\u00eb ligjit nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar.<\/p>\n<p>Parashikimet kushtetuese dhe ligjore t\u00eb m\u00ebsip\u00ebrme, sakt\u00ebsojn\u00eb n\u00eb m\u00ebnyr\u00eb shteruese, kompetenc\u00ebn, radh\u00ebn kronologjike, alternanc\u00ebn dhe afatin kohor, brenda t\u00eb cilit duhet t\u00eb veproj\u00eb secili prej organeve t\u00eb em\u00ebrtes\u00ebs, n\u00eb rastet kur secilit prej tyre iu takon t\u00eb em\u00ebrojn\u00eb\/zgjedhin m\u00eb shum\u00eb se nj\u00eb an\u00ebtar t\u00eb Gjykat\u00ebs Kushtetuese, n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb.<\/p>\n<p>Neni 179 pika 2 e Kushtetut\u00ebs, p\u00ebrcakton: \u201cAn\u00ebtari i par\u00ebp\u00ebr t\u2019u z\u00ebvend\u00ebsuar n\u00eb Gjykat\u00ebn Kushtetuese em\u00ebrohet nga Presidenti i Republik\u00ebs, i dyti zgjidhet nga Kuvendi dhe i treti em\u00ebrohet nga Gjykata e Lart\u00eb. Kjo radh\u00eb ndiqet p\u00ebr t\u00eb gjitha em\u00ebrimet q\u00eb do t\u00eb b\u00ebhen pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.\u201d<\/p>\n<p>Nd\u00ebrkoh\u00eb q\u00eb, n\u00eb po k\u00ebt\u00eb nen, sa i takon kompetenc\u00ebs s\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebrgjat\u00eb faz\u00ebs tranzitore t\u00eb zbatimit t\u00eb ndryshimeve kushtetuese n\u00eb pik\u00ebn 12 sakt\u00ebsohet:<\/p>\n<p>\u201c12\u2026.. . Me krijimin e K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor, Presidenti em\u00ebron gjyqtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb, sipas nenit 136 t\u00eb Kushtetut\u00ebs. Presidenti plot\u00ebson vakanc\u00ebn e par\u00eb n\u00eb Gjykat\u00ebn Kushtetuese sipas paragrafit 2, t\u00eb k\u00ebtij neni, dhe nenit 125 t\u00eb Kushtetut\u00ebs.\u201d.<\/p>\n<p>I gjendur para k\u00ebsaj situate, me q\u00ebllim respektimin e urdh\u00ebrimeve kushtetuese dhe ligjore, pas administrimit t\u00eb t\u00eb dy listave nj\u00ebherazi nga KED-ja q\u00eb i p\u00ebrkasin plot\u00ebsimit (em\u00ebrimit) t\u00eb an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr 2 (dy) vakanca t\u00eb shpallura nga Presidentit t\u00eb Republik\u00ebs, me shkres\u00ebn nr. 3571 prot., dat\u00eb 10.10.2019, Institucioni i Presidentit t\u00eb Republik\u00ebs iu drejtua K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, me nj\u00eb k\u00ebrkes\u00eb p\u00ebr informacion mbi faktin n\u00ebse ky organ (KED)-ja i ka p\u00ebrcjell\u00eb ose jo Kuvendit t\u00eb Shqip\u00ebris\u00eb \u201cList\u00ebn P\u00ebrfundimtare t\u00eb Renditjes s\u00eb Kandidat\u00ebve p\u00ebr Gjyqtar n\u00eb Gjykat\u00ebn Kushtetuese, p\u00ebr vendin vakant, t\u00eb shpallur nga Kuvendi, n\u00eb dat\u00ebn 12.02.2018\u201d, si dhe \u201cList\u00ebn P\u00ebrfundimtare t\u00eb Renditjes s\u00eb Kandidat\u00ebve p\u00ebr Gjyqtar n\u00eb Gjykat\u00ebn Kushtetuese, p\u00ebr vendin vakant t\u00eb shpallur nga Kuvendi n\u00eb dat\u00ebn 04.03.2019\u201d.<\/p>\n<p>Presidenti i Republik\u00ebs vler\u00ebsoi se ky informacion paraprak ishte i domosdosh\u00ebm me q\u00ebllim:<\/p>\n<p>S\u00eb pari, t\u00eb fillonte sa m\u00eb par\u00eb procesi i plot\u00ebsimit t\u00eb vendeve vakante n\u00eb Gjykat\u00ebn Kushtetuese;<\/p>\n<p>s\u00eb dyti, rip\u00ebrt\u00ebritja e Gjykat\u00ebs Kushtetues me gjyqtar\u00ebt e rinj, t\u00eb ndjek\u00eb radh\u00ebn kronologjike t\u00eb diktuar nga Kushtetuta dhe ligji, ku Presidenti i Republik\u00ebs t\u00eb em\u00ebronte gjyqtarin e par\u00eb kushtetues, vet\u00ebm pasi Kuvendi t\u00eb kishte administruar nga KED-ja list\u00ebn p\u00ebrfundimtare me numrin e nevojsh\u00ebm t\u00eb kandidaturave (jo m\u00eb pak se tre);<\/p>\n<p>s\u00eb treti, sepse respektimi i k\u00ebsaj radhe kronologjike t\u00eb plot\u00ebsimit, do t\u00eb sh\u00ebrbej\u00eb edhe si rregull baz\u00eb p\u00ebr p\u00ebrt\u00ebritjen e tyre n\u00eb t\u00eb ardhmen.<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebtyre arsyeve, ka edhe nj\u00eb arsye tjet\u00ebr, se p\u00ebrse ishte i domosdosh\u00ebm ky informacion.<\/p>\n<p>N\u00eb t\u00eb gjitha vakancat aktuale p\u00ebr t\u00eb cilat KED-ja ka zhvilluar procedur\u00ebn e verifikimit, vler\u00ebsimit dhe renditjes, ka aplikant\u00eb, t\u00eb cil\u00ebt gjenden nj\u00ebkoh\u00ebsisht n\u00eb cil\u00ebsin\u00eb e kandidatit qoft\u00eb n\u00eb vakancat q\u00eb i p\u00ebrkasin p\u00ebr plot\u00ebsim Presidentit e qoft\u00eb n\u00eb vakancat q\u00eb plot\u00ebsohen nga Kuvendi. Em\u00ebrimi eventual i nj\u00ebrit aplikant n\u00eb list\u00ebn e Presidentit, afekton domosdoshm\u00ebrisht edhe numrin e aplikant\u00ebve q\u00eb gjenden n\u00eb list\u00ebn\/at e Kuvendit.<\/p>\n<p>Duke qen\u00eb se Kushtetuta parashikon q\u00eb Kuvendi duhet t\u00eb ket\u00eb n\u00eb dispozicion apo administruar 3 (tre) kandidatura p\u00ebr t\u00eb b\u00ebr\u00eb p\u00ebrzgjedhjen e vet, Presidenti duhej t\u00eb vihej n\u00eb kushtet, q\u00eb em\u00ebrimi q\u00eb ai duhet t\u00eb b\u00ebj\u00eb, t\u00eb mos cenoj\u00eb hap\u00ebsir\u00ebn vler\u00ebsuese t\u00eb Kuvendit, n\u00eb p\u00ebrzgjedhjen e tij.<\/p>\n<p>Fakti q\u00eb t\u00eb nj\u00ebjt\u00ebt aplikant\u00eb gjenden edhe n\u00eb list\u00ebn e Kuvendit, komplikon kompetenc\u00ebn kushtetuese t\u00eb zgjedhjes s\u00eb an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese. Organet e em\u00ebrtes\u00ebs (President, Kuvend) e kan\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje K\u00ebshillin e Em\u00ebrimeve n\u00eb Drejt\u00ebsi, p\u00ebr plot\u00ebsimin e vakancave q\u00eb u p\u00ebrkasin atyre p\u00ebr plot\u00ebsim si organ em\u00ebrtese, n\u00eb momente kohore t\u00eb ndryshme, sipas nj\u00eb radhe kronologjike, e cila duhej respektuar edhe nga KED-ja.<\/p>\n<p>Kjo radh\u00eb kronologjike e investimit t\u00eb KED-s\u00eb, \u00ebsht\u00eb e nj\u00ebjta me radh\u00ebn kronologjike q\u00eb k\u00ebrkon edhe ligji. Konkretisht:<\/p>\n<p>Plot\u00ebsimi i vakanc\u00ebs s\u00eb krijuar nga p\u00ebrfundimi mandatit t\u00eb ish-gjyqtarit Sokol Berberi (2016), shpallur nga Presidenti i Republik\u00ebs me dekretin e dat\u00ebs 07.02.2018 dhe d\u00ebrguar listat e kandidad\u00ebve pran\u00eb KED-s\u00eb me shkres\u00ebn nr.2668\/2 prot, dat\u00eb 28.02.2018.<\/p>\n<p>Plot\u00ebsimi i vakanc\u00ebs s\u00eb krijuar nga p\u00ebrfundimi mandatit t\u00eb ish-gjyqtarit Vladimir Kristo (2016), shpallur nga Kuvendi i Shqip\u00ebris\u00eb n\u00eb dat\u00ebn 12.02.2018 dhe d\u00ebrguar listat e kandidat\u00ebve pran\u00eb KED-s\u00eb me shkres\u00ebn nr.1031\/2 prot, dat\u00eb 25.04.2018.<\/p>\n<p>Plot\u00ebsimi i vakanc\u00ebs s\u00eb krijuar nga p\u00ebrfundimi mandatit t\u00eb ish-gjyqtares Altina Xhoxhaj (2019), shpallur nga Presidenti i Republik\u00ebs me dekretin e dat\u00ebs 04.03.2019 dhe d\u00ebrguar listat e kandidat\u00ebve pran\u00eb KED-s\u00eb me shkres\u00ebn nr.930 prot, dat\u00eb 27.03.2019.<\/p>\n<p>Plot\u00ebsimi i vakanc\u00ebs s\u00eb krijuar nga p\u00ebrfundimi mandatit t\u00eb ish-gjyqtarit Bashkim Dedja (2019), shpallur nga Kuvendi i Shqip\u00ebris\u00eb n\u00eb dat\u00ebn 04.03.2019 dhe d\u00ebrguar listat e kandidat\u00ebve pran\u00eb KED-s\u00eb me shkres\u00eb nr.1446 pro., dat\u00eb 04.04.2019.<\/p>\n<p>N\u00eb zbatim t\u00eb nenit 179 pika 2 t\u00eb Kushtetut\u00ebs, neneve 7 pika 2, dhe 86 pika 4 t\u00eb ligjit nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar, K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi, domosdoshm\u00ebrisht, n\u00eb faz\u00ebn p\u00ebrfundimtare t\u00eb miratimit dhe d\u00ebrgimit t\u00eb listave p\u00ebrfundimtare, duhet t\u00eb respektonte k\u00ebrkesat e m\u00ebsip\u00ebrme t\u00eb Kushtetut\u00ebs dhe ligjit.<\/p>\n<p>Duke i miratuar dhe p\u00ebrcjell\u00eb listat tek secili organ em\u00ebrtese sipas k\u00ebsaj radhe dhe t\u00eb diferencuara n\u00eb koh\u00eb KED-ja do t\u00eb shmangte situat\u00ebn paradoksale procedurale t\u00eb krijuar.<\/p>\n<p>KED-ja me p\u00ebrcjelljen e nj\u00ebkohshme t\u00eb listave t\u00eb kandidat\u00ebve p\u00ebr plot\u00ebsimin e t\u00eb dy vakancave q\u00eb i p\u00ebrkasin Presidentit t\u00eb Republik\u00ebs, e ka vendosur Institucionin e Presidentit t\u00eb Republik\u00ebs n\u00eb v\u00ebshtir\u00ebsi, duke u p\u00ebrpjekur t\u00eb krijoj\u00eb nj\u00eb gjendje fakti ku Presidenti sipas KED-s\u00eb do t\u00eb duhet t\u00eb shprehet brenda afatit ligjor 30-ditor edhe p\u00ebr em\u00ebrimin e gjyqtarit tjet\u00ebr p\u00ebr plot\u00ebsimin e vakanc\u00ebs tjet\u00ebr, eventualisht p\u00ebrpara se Kuvendi t\u00eb shprehet p\u00ebr em\u00ebrimin e gjyqtarit t\u00eb dyt\u00eb kushtetues.<\/p>\n<p>N\u00ebse Presidenti i Republik\u00ebs, do t\u00eb ndjek\u00eb k\u00ebt\u00eb logjik\u00eb si\u00e7 ka vepruar administrativisht Kryetari i KED-s\u00eb, kjo do t\u00eb \u00e7onte domosdoshm\u00ebrisht n\u00eb shkelje t\u00eb parashikimeve t\u00eb dispozitave t\u00eb Kushtetut\u00ebs\u00a0 dhe t\u00eb ligjit nr.8577\/2000, p\u00ebr sa i takon respektimit t\u00eb radh\u00ebs s\u00eb em\u00ebrimit apo zgjedhjes s\u00eb gjyqtar\u00ebve t\u00eb rinj kushtetues.<\/p>\n<p>Duhet theksuar se k\u00ebto parashikime kushtetuese dhe ligjore jan\u00eb t\u00eb r\u00ebnd\u00ebsishme, pasi lidhen me mekanizmin e p\u00ebrt\u00ebritjes s\u00eb Gjykat\u00ebs Kushtetuese, i cili u reformua n\u00eb vitin 2016 me an\u00eb t\u00eb ndryshimeve kushtetuese, p\u00ebr shkak t\u00eb d\u00ebshtimit n\u00eb zbatim q\u00eb pati formulimi fillestar i k\u00ebtij mekanizmi.<\/p>\n<p>Ndryshimet kushtetuese t\u00eb realizuara n\u00eb kuad\u00ebr t\u00eb reform\u00ebs n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb 21-22 korrik 2016, i kushtuan r\u00ebnd\u00ebsi t\u00eb lart\u00eb m\u00ebnyr\u00ebs sesi do rip\u00ebrt\u00ebrihej p\u00ebrb\u00ebrja e Gjykat\u00ebs Kushtetuese. N\u00eb nenin 179 pika 2 t\u00eb Kushtetut\u00ebs, p\u00ebrcaktohet:<\/p>\n<p>\u201cAn\u00ebtari i par\u00ebp\u00ebr t\u2019u z\u00ebvend\u00ebsuar n\u00eb Gjykat\u00ebn Kushtetuese em\u00ebrohet nga Presidenti i Republik\u00ebs, i dyti zgjidhet nga Kuvendi dhe i treti em\u00ebrohet nga Gjykata e Lart\u00eb. Kjo radh\u00eb ndiqet p\u00ebr t\u00eb gjitha em\u00ebrimet q\u00eb do t\u00eb b\u00ebhen pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.\u201d<\/p>\n<p>Pra, sipas k\u00ebsaj dispozite t\u00eb Kushtetut\u00ebs, Presidenti i Republik\u00ebs, nuk mund t\u00eb em\u00ebroj\u00eb dy gjyqtar\u00eb nj\u00ebherazi,apo dy gjyqtar\u00eb njeri pas tjetrit, por vet\u00ebm an\u00ebtarin e par\u00eb, nd\u00ebrkoh\u00eb q\u00eb an\u00ebtari i dyt\u00eb i Gjykat\u00ebs Kushtetues duhet t\u00eb em\u00ebrohet nga Kuvendi dhe i treti nga Gjykata e Lart\u00eb.<\/p>\n<p>Ky rregullim ka qen\u00eb me shum\u00eb r\u00ebnd\u00ebsi p\u00ebr Kushtetut\u00ebb\u00ebr\u00ebsin, aq sa, n\u00eb t\u00eb nj\u00ebjt\u00ebn dispozit\u00eb t\u00eb nenit 179, n\u00eb pik\u00ebn 12, paragrafi i fundit, e ka p\u00ebrs\u00ebritur s\u00ebrish k\u00ebt\u00eb rregull duke sakt\u00ebsuar:<\/p>\n<p>\u201c12. Presidenti i Republik\u00ebs vazhdon t\u00eb q\u00ebndroj\u00eb Kryetar i K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb deri n\u00eb krijimin e K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor brenda 8 muajve nga hyrja n\u00eb fuqi e k\u00ebtij ligji. Me krijimin e K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor, Presidenti em\u00ebron gjyqtar\u00ebt e Gjykat\u00ebs s\u00eb Lart\u00eb, sipas nenit 136 t\u00eb Kushtetut\u00ebs. Presidenti plot\u00ebson vakanc\u00ebn e par\u00eb n\u00eb Gjykat\u00ebn Kushtetuese sipas paragrafit 2, t\u00eb k\u00ebtij neni, dhe nenit 125 t\u00eb Kushtetut\u00ebs.\u201d<\/p>\n<p>P\u00ebr sa m\u00eb sip\u00ebr, n\u00eb kushtet aktuale t\u00eb plot\u00ebsimit t\u00eb vakancave n\u00eb p\u00ebrmbushje t\u00eb p\u00ebrcaktimeve kushtetuese, Presidenti i Republik\u00ebs, nuk mund t\u00eb em\u00ebroj\u00eb gjyqtarin tjet\u00ebr t\u00eb Gjykat\u00ebs Kushtetuese, s\u00eb paku pa u shprehur m\u00eb par\u00eb Kuvendi i Shqip\u00ebris\u00eb, p\u00ebr zgjedhjen e gjyqtarit t\u00eb dyt\u00eb.<\/p>\n<p>K\u00ebto rregullime kushtetuese, kan\u00eb gjetur zb\u00ebrthim n\u00eb ligjin nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar, ku pasqyrohet me holl\u00ebsi sesi k\u00ebto detyrime duhen p\u00ebrmbushur.<\/p>\n<p>N\u00eb nenin 7 pika 2, t\u00eb ligjit nr. 8577, dat\u00eb 10.02.2000 p\u00ebrcaktohet:<\/p>\n<p>\u201cP\u00ebrb\u00ebrja e Gjykat\u00ebs Kushtetuese p\u00ebrt\u00ebrihet \u00e7do 3 vjet, me nj\u00eb t\u00eb tret\u00ebn e saj. An\u00ebtar\u00ebt e rinj caktohen sipas radh\u00ebs, p\u00ebrkat\u00ebsisht nga Presidenti i Republik\u00ebs,nga Kuvendi dhe nga Gjykata e Lart\u00eb. Ky detyrim kushtetues dhe ligjor duhet t\u00eb zbatohet jo vet\u00ebm nga organet e em\u00ebrtes\u00ebs,\u00a0 por dhe duhet t\u00eb ndiqet n\u00eb veprimet administrative t\u00eb fundit t\u00eb KED-s\u00eb.<\/p>\n<p>P\u00ebr sa m\u00eb sip\u00ebr, me q\u00ebllim p\u00ebrt\u00ebritjen e rregullt dhe sipas parashikimeve kushtetuese, t\u00eb p\u00ebrb\u00ebrjes s\u00eb Gjykat\u00ebs Kushtetuese, nisur nga fakti q\u00eb \u00e7do organ em\u00ebrtese n\u00eb k\u00ebt\u00eb rast (Presidenti, Kuvendi) ka n\u00eb dispozicion 30 dit\u00eb koh\u00eb, p\u00ebr t`u shprehur n\u00eb lidhje me em\u00ebrimin\/zgjedhjen e an\u00ebtarit t\u00eb Gjykat\u00ebs Kushtetuese, Presidenti i Republik\u00ebs, ka analizuar shkres\u00ebn nr.553 prot, dat\u00eb 08.10.2019 t\u00eb d\u00ebrguar nga KED-ja, n\u00ebn drit\u00ebn e rregullimeve t\u00eb Kodit t\u00eb Procedur\u00ebs Administrative (KPrA) dhe rregullave kushtetuese e ligjore t\u00eb p\u00ebrshkruara m\u00eb sip\u00ebr.<\/p>\n<p>Sipas nenit 3 pika 9 t\u00eb KPrA-s\u00eb, procesi q\u00eb kryen Presidenti i Republik\u00ebs pasi i \u00ebsht\u00eb paraqitur shkresa p\u00ebrkat\u00ebse nga KED-ja, \u00ebsht\u00eb nj\u00eb procedur\u00eb e mir\u00ebfillt\u00eb administrative. Kjo procedur\u00eb merr shkas nga \u00e7asti q\u00eb formalisht paraqitet nj\u00eb praktik\u00eb dokumentare nga ana e K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi. N\u00eb vetvete, praktika dokumentare e paraqitur nga KED-ja, si veprimtari administrative fundore e saj, merr vler\u00ebn e nj\u00eb k\u00ebrkese p\u00ebr t\u00eb filluar k\u00ebt\u00eb procedur\u00eb n\u00eb kuptim t\u00eb nenit 41 t\u00eb KPrA-s\u00eb.<\/p>\n<p>Bazuar n\u00eb nenin 44\/2 t\u00eb KPrA-s\u00eb, Institucioni i Presidentit, ka shqyrtuar paraprakisht praktik\u00ebn dokumentare t\u00eb paraqitur nga ana e KED-s\u00eb, duke marr\u00eb n\u00eb analiz\u00eb secilin prej elementeve t\u00eb parashikuara nga kjo dispozit\u00eb apo nga ligje t\u00eb tjera.<\/p>\n<p>Sipas k\u00ebsaj dispozite, si dhe nenit 66\/1 po t\u00eb KPrA-s\u00eb, rezulton se e drejta e Presidentit t\u00eb Republik\u00ebs p\u00ebr t\u00eb operuar me p\u00ebrzgjedhjen dhe em\u00ebrimin e nj\u00eb kandidati p\u00ebr vakanc\u00ebn aktuale n\u00eb shqyrtim, fillon dhe b\u00ebhet operative vet\u00ebm pasi nj\u00eb organ tjet\u00ebr, n\u00eb k\u00ebt\u00eb rast Kuvendi, t\u00eb shteroj\u00eb \u00e7\u00ebshtjen q\u00eb ai ka n\u00eb kompetenc\u00eb dhe aktualisht n\u00eb shqyrtim; pra, zgjedhjen e an\u00ebtarit t\u00eb dyt\u00eb t\u00eb Gjykat\u00ebs Kushtetuese q\u00eb, sipas radh\u00ebs, i takon ta zgjedh\u00eb ky organ.<\/p>\n<p>Vet\u00ebm pasi t\u00eb shterohet dhe t\u00eb zgjidhet kjo \u00e7\u00ebshtje paraprake, (pra, em\u00ebrimi i an\u00ebtarit t\u00eb dyt\u00eb nga Kuvendi) e cila sipas afatit kushtetues, duhet t\u00eb p\u00ebrfundoj\u00eb brenda dat\u00ebs 13 n\u00ebntor 2019, at\u00ebher\u00eb Presidentit t\u00eb Republik\u00ebs i lind detyrimi dhe mund t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn e tij kushtetuese p\u00ebr em\u00ebrimin e an\u00ebtarit tjet\u00ebr t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Presidenti ka arritur n\u00eb p\u00ebrfundimin se shqyrtimi n\u00eb themel i propozimeve t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi nuk mund t\u00eb realizohet n\u00eb k\u00ebt\u00eb moment, pasi aktualisht sipas nenit 179, pikat 2 dhe 12 t\u00eb Kushtetut\u00ebs, si dheneneve 7 pika 2 dhe 86 pika 4 t\u00eb ligjit nr. 8577, dat\u00eb 10.02.2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar,\u00ebsht\u00eb radha e Kuvendit t\u00eb Shqip\u00ebris\u00eb q\u00eb duhet t\u00eb shprehet p\u00ebr zgjedhjen e an\u00ebtarit t\u00eb dyt\u00eb t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>P\u00ebr k\u00ebt\u00eb shkak, Presidenti i Republik\u00ebs, bazuar edhe ne nenin 66 t\u00eb KPrA-s\u00eb, pezullon procedur\u00ebn administrative, pasi \u00ebsht\u00eb n\u00eb penges\u00eb kushtetuese dhe ligjore t\u00eb veproj\u00eb deri n\u00eb marrjen e nj\u00eb vendimi p\u00ebrfundimtar nga ana e Kuvendit mbi \u00e7\u00ebshtjen e zgjedhjes s\u00eb an\u00ebtarit t\u00eb dyt\u00eb t\u00eb Gjykat\u00ebs Kushtetuese, sipas nenit 125 pika 2 dhe 179 pika 2 t\u00eb Kushtetut\u00ebs, dhe nenit 86 pika 4 t\u00eb ligjit nr.8577\/2000.<\/p>\n<p>Bazuar n\u00eb k\u00ebt\u00eb arsyetim, si dhe n\u00eb situat\u00ebn faktike t\u00eb krijuar prej shkeljeve administrative t\u00eb KED-s\u00eb, Presidenti i Republik\u00ebs fton me k\u00ebt\u00eb rast Kuvendin, q\u00eb brenda kalendarit t\u00eb punimeve dhe programit t\u00eb pun\u00ebs, t\u00eb veproj\u00eb n\u00eb nj\u00eb koh\u00eb sa m\u00eb t\u00eb shpejt\u00eb t\u00eb mundshme me zgjedhjen e an\u00ebtarit t\u00eb dyt\u00eb t\u00eb Gjykat\u00ebs Kushtetuese, me q\u00ebllim q\u00eb Presidenti i Republik\u00ebs t\u00eb veproj\u00eb pas k\u00ebsaj me em\u00ebrimin e an\u00ebtarit tjet\u00ebr t\u00eb Gjykat\u00ebs, p\u00ebr vakanc\u00ebn respektive.<\/p>\n<p>Presidenti me k\u00ebt\u00eb vendim paraprak, synon respektimin e norm\u00ebs kushtetuese t\u00eb zbatimit t\u00eb radh\u00ebs n\u00eb em\u00ebrimin e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese dhe rregullimin e nj\u00eb situate jo t\u00eb zakonshme t\u00eb krijuar nga veprimtaria administrative e d\u00ebrgimit t\u00eb listave t\u00eb keqmenduar nga Kryetari i K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi.<\/p>\n<p>Ky vendim p\u00ebr pezullimin e vijimit t\u00eb procesit administrativ t\u00eb shqyrtimit t\u00eb list\u00ebs dhe dokumentacionit t\u00eb p\u00ebrcjell\u00eb nga KED-ja, deri n\u00eb realizimin e zgjedhjes nga Kuvendi t\u00eb an\u00ebtarit t\u00eb dyt\u00eb (dat\u00eb 13 n\u00ebntor 2019), ka p\u00ebr q\u00ebllim ruajtjen e kushtetutshm\u00ebris\u00eb t\u00eb em\u00ebrimit\/zgjedhjes s\u00eb an\u00ebtar\u00ebve t\u00eb rinj t\u00eb k\u00ebsaj Gjykate dhe evidenton qart\u00eb vullnetin e Presidentit t\u00eb Republik\u00ebs, se n\u00eb cil\u00ebsin\u00eb e organit t\u00eb em\u00ebrtes\u00ebs, Presidenti do t\u00eb shprehet p\u00ebr t\u00eb em\u00ebruar an\u00ebtarin e radh\u00ebs t\u00eb Gjykat\u00ebs Kushtetuese nga lista e kandidaturave t\u00eb p\u00ebrcjella nga KED-ja.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, nga shqyrtimi paraprak i praktik\u00ebs dokumentare t\u00eb komunikuar administrativisht nga KED-ja, rezulton se bazuar n\u00eb nenin 44\/2 shkronja \u201dc\u201d t\u00eb KPrA-s\u00eb, \u00ebsht\u00eb e nevojshme kryerja e veprimeve t\u00eb tjera administrative prej k\u00ebsaj t\u00eb fundit (KED), p\u00ebrpara shqyrtimit p\u00ebrfundimtar lidhur me k\u00ebt\u00eb praktik\u00eb.<\/p>\n<p>K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi i ka vendosur n\u00eb dispozicion Presidentit t\u00eb Republik\u00ebs, vet\u00ebm aktet e formuara\/krijuara nga K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi. P\u00ebr vler\u00ebsimin e disa rrethanave, Presidenti i Republik\u00ebs, n\u00eb zbatim t\u00eb nenit 92\/h t\u00eb Kushtetut\u00ebs dhe nenit 44\/2 shkronja \u201cc\u201d e KPrA-s\u00eb, k\u00ebrkon nga KED-ja q\u00eb t\u00eb njihet me kopje t\u00eb dokumentacionit t\u00eb administruar e t\u00eb shqyrtuar nga KED-ja q\u00eb p\u00ebrmban dosja e kandidimit e secilit prej 4 (kat\u00ebr) kandidat\u00ebve t\u00eb\u00a0 lejuar dhe t\u00eb listuar nga KED-ja p\u00ebr plot\u00ebsimin e k\u00ebsaj vakance.<\/p>\n<p>KED n\u00eb faqen 10, paragrafi i fundit i Raportit P\u00ebrfundimtar t\u00eb renditjes s\u00eb kandidat\u00ebve ka shprehur gadishm\u00ebrin\u00eb p\u00ebr v\u00ebnien n\u00eb dispozicion t\u00eb nj\u00eb kopje t\u00eb plot\u00eb t\u00eb dokumentacionit. Referuar edhe k\u00ebtij fakti, k\u00ebto t\u00eb dh\u00ebna dhe ky informacion k\u00ebrkohet t\u00eb p\u00ebrcillet sa m\u00eb par\u00eb, por jo m\u00eb von\u00eb se 5 dit\u00eb nga administrimi i k\u00ebsaj shkrese me q\u00ebllim q\u00eb Presidenti i Republik\u00ebs t\u00eb alternoj\u00eb me Kuvendin e Shqip\u00ebris\u00eb respektimin e parashikimeve kushtetuese. N\u00eb rast se KED nuk do t\u00eb p\u00ebrcjell\u00eb t\u00eb dh\u00ebnat e k\u00ebrkuara Presidenti i Republik\u00ebs do t\u00eb procedoj\u00eb me shqyrtimin e \u00e7\u00ebshtjes me informacionin q\u00eb ka dispozicion.<\/p>\n<p>N\u00eb lidhje me sa u parashtrua m\u00eb sip\u00ebr, Presidenti i Republik\u00ebs, k\u00ebrkon angazhimin e Kryetarit t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi, pasi kjo \u00e7\u00ebshtje q\u00eb \u00ebsht\u00eb vler\u00ebsuar me kaq pak r\u00ebnd\u00ebsi po krijon shteg p\u00ebr pasoja t\u00eb pariparueshme p\u00ebr organet e em\u00ebrtes\u00ebs dhe vet\u00eb procesin n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p>M\u00eb duhet t\u2019Ju sjell n\u00eb v\u00ebmendje se p\u00ebr Presidentin e Republik\u00ebs, em\u00ebrimi\/zgjedhja e an\u00ebtar\u00ebve t\u00eb rinj t\u00eb Gjykat\u00ebs Kushtetuese, n\u00eb p\u00ebrputhje me kushtet dhe kriteret kushtetuese dhe ligjore, ka qen\u00eb nj\u00eb k\u00ebrkes\u00eb e vazhdueshme dhe e p\u00ebrs\u00ebritur ndaj K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi.<\/p>\n<p>P\u00ebr k\u00ebt\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme, p\u00ebrfaq\u00ebsuesi i Institucionit t\u00eb Presidentit t\u00eb Republik\u00ebs dhe Avokati i Popullit, kan\u00eb ngritur n\u00eb mbledhjet e K\u00ebshillit jo vet\u00ebm k\u00ebt\u00eb shqet\u00ebsim, por edhe \u00e7\u00ebshtje t\u00eb tjera q\u00eb lidhen me transparenc\u00ebn e veprimtaris\u00eb s\u00eb K\u00ebshillit, apo problematik\u00ebs q\u00eb kan\u00eb n\u00eb disa aspekte aktet n\u00ebnligjore mbi procesin e verifikimit dhe vler\u00ebsimit t\u00eb miratuara prej K\u00ebshillit mbi disa kritere ligjore p\u00ebr lejimin dhe ndalimin e kandidat\u00ebve q\u00eb konkurrojn\u00eb p\u00ebr an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Duke par\u00eb me shqet\u00ebsim disa \u00e7\u00ebshtje t\u00eb veprimtaris\u00eb dhe vendimmarrjes s\u00eb K\u00ebshillit me shkres\u00eb nr. 2941\/1 prot, dat\u00eb 31.08.2019, Presidenti i Republik\u00ebs, i ka k\u00ebrkuar K\u00ebshillit nd\u00ebr t\u00eb tjera:<\/p>\n<p>\u201c.. t\u00eb realizoj\u00eb n\u00eb nj\u00eb koh\u00eb sa m\u00eb t\u00eb shpejt\u00eb p\u00ebrmbushjen e detyrave funksionale p\u00ebr verifikimin, vler\u00ebsimin dhe pik\u00ebzimin e kandidat\u00ebve, sipas k\u00ebrkesave t\u00eb Kushtetut\u00ebs dhe ligjit, duke p\u00ebrcjell\u00eb pran\u00eb Institucionit t\u00eb Presidentit t\u00eb Republik\u00ebs dhe Kuvendit t\u00eb Shqip\u00ebris\u00eb, listat me numrin e nevojsh\u00ebm t\u00eb kandidaturave t\u00eb vler\u00ebsuara dhe renditura p\u00ebr secil\u00ebn vakanc\u00eb, p\u00ebr t\u00eb b\u00ebr\u00eb t\u00eb mundur q\u00eb organet e em\u00ebrtes\u00ebs t\u00eb ken\u00eb mund\u00ebsi t\u00eb zgjedhin sa m\u00eb shpejt dhe sipas radh\u00ebs, an\u00ebtar\u00ebt e rinj t\u00eb Gjykat\u00ebs Kushtetuese, n\u00eb m\u00ebnyr\u00eb q\u00eb kjo Gjykat\u00eb t\u00eb jet\u00eb sa m\u00eb shpejt funksionale p\u00ebr t\u00eb marr\u00eb vendime dhe p\u00ebr t\u2019u dh\u00ebn\u00eb zgjidhje nj\u00eb s\u00ebr\u00eb \u00e7\u00ebshtjeve q\u00eb shqet\u00ebsojn\u00eb t\u00eb gjith\u00eb jet\u00ebn shoq\u00ebrore n\u00eb vend. \u201c<\/p>\n<p>Edhe pse shqet\u00ebsimi mbi m\u00ebnyr\u00ebn dhe koh\u00ebn sesi do t\u00eb paraqiteshin listat e kandidat\u00ebve nga K\u00ebshilli p\u00ebrkundrejt organeve t\u00eb em\u00ebrtes\u00ebs, \u00ebsht\u00eb shprehur m\u00eb par\u00eb nga Presidenti, s\u00ebrish Kryetari i K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi nuk e ka respektuar k\u00ebt\u00eb detyrim kushtetues.<\/p>\n<p>Ndjekja e procesit nga Presidenti i Republik\u00ebs sipas propozimit t\u00eb KED-s\u00eb, do t\u00eb p\u00ebrb\u00ebnte nj\u00eb shkelje t\u00eb hapur t\u00eb nenit 179 pikat 2 dhe 12 t\u00eb Kushtetut\u00ebs, si dhe nenit 7 pika 2, 86 pika 4, t\u00eb ligjit nr. 8577\/2000 \u201cP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, t\u00eb ndryshuar.<\/p>\n<p>\u00cbsht\u00eb e papranueshme p\u00ebr Presidentin e Republik\u00ebs, q\u00eb t\u00eb pranoj\u00eb shkeljen e dispozitave kushtetuese, p\u00ebr shkak t\u00eb veprimtaris\u00eb s\u00eb gabuar administrative t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi n\u00eb p\u00ebrcjelljen e listave.<\/p>\n<p>Kjo \u00e7\u00ebshtje nuk do t\u00eb kishte lindur, n\u00ebse K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi do t\u2019u ishte p\u00ebrmbajtur parashikimeve kushtetuese, apo do t\u00eb kishte vler\u00ebsuar efektet q\u00eb sjell veprimtaria fundore administrative e KED-s\u00eb p\u00ebrball\u00eb veprimtaris\u00eb dhe detyrimeve kushtetuese, q\u00eb kan\u00eb organet e tjera t\u00eb p\u00ebrfshira n\u00eb k\u00ebt\u00eb proces (President, Kuvend).<\/p>\n<p>Sistemi i ri i em\u00ebrimit\/zgjedhjes s\u00eb gjyqtar\u00ebve kushtetues ku tre an\u00ebtar\u00eb em\u00ebrohen nga Presidenti i Republik\u00ebs, tre an\u00ebtar\u00eb zgjidhen nga Kuvendi dhe tre an\u00ebtar\u00eb zgjidhen nga Gjykata e Lart\u00eb, t\u00eb cil\u00ebt\u00a0 p\u00ebrzgjidhen nd\u00ebrmjet kandidat\u00ebve t\u00eb renditur nga K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi, sipas kushtetut\u00ebs dhe ligjit, i vendos institucionet q\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb proces p\u00ebrpara k\u00ebrkes\u00ebs s\u00eb respektimit t\u00eb parimit t\u00eb luajalitetit kushtetues, i cili n\u00eb thelb k\u00ebrkon respektin e nd\u00ebrsjell\u00eb nga secili institucion ndaj kompetencave t\u00eb tjetrit, si dhe n\u00ebnkupton krijimin e nj\u00eb raporti bashk\u00ebpunimi midis tyre.<\/p>\n<p>N\u00eb rastin konkret, respektimi i k\u00ebtij parimi k\u00ebrkonte q\u00eb K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi, n\u00eb procesin fundor administrativ t\u00eb p\u00ebrcjelljes s\u00eb listave n\u00eb adres\u00eb t\u00eb Presidentit t\u00eb Republik\u00ebs dhe Kuvendit t\u00eb Shqip\u00ebris\u00eb duhet t\u00eb udh\u00ebhiqej, ve\u00e7 t\u00eb tjerave, edhe nga objektivi p\u00ebr t\u00eb siguruar q\u00eb em\u00ebrimi\/zgjedhja e an\u00ebtar\u00ebve t\u00eb rinj t\u00eb Gjykat\u00ebs Kushtetuese jo vet\u00ebm t\u00eb siguronte nj\u00eb p\u00ebrb\u00ebrje cil\u00ebsore dhe mund\u00ebsi p\u00ebr zgjedhje nga organet e em\u00ebrtes\u00ebs, por edhe q\u00eb i gjith\u00eb ky proces t\u00eb p\u00ebrmbyllej, duke ndjekur radh\u00ebn e em\u00ebrimit\/zgjedhjes s\u00eb gjyqtar\u00ebve n\u00eb p\u00ebrputhje me p\u00ebrcaktimet e kushtetut\u00ebs dhe t\u00eb ligjit.<\/p>\n<p>Presidenti i Republik\u00ebs, gjen rastin t\u00eb sjell\u00eb n\u00eb v\u00ebmendje t\u00eb K\u00ebshillit t\u00eb Em\u00ebrimeve n\u00eb Drejt\u00ebsi dhe Kuvendit t\u00eb Shqip\u00ebris\u00eb se Gjykata Kushtetuese e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, nd\u00ebr vite ka trajtuar me vendimmarrje \u00e7\u00ebshtje pik\u00ebrisht t\u00eb k\u00ebsaj natyre, q\u00eb lidhen me m\u00ebnyr\u00ebn sesi duhet t\u00eb sillen e nd\u00ebrveprojn\u00eb me njeri-tjetrin institucionet kushtetuese p\u00ebrgjat\u00eb procesit t\u00eb em\u00ebrimit\/zgjedhjes s\u00eb gjyqtar\u00ebve t\u00eb nivelit m\u00eb t\u00eb lart\u00eb p\u00ebrfshi edhe gjyqtar\u00ebt kushtetues.<\/p>\n<p>Gjykata Kushtetuese, n\u00eb vendimet e saj nr.2\/2005; nr. 24\/2011 dhe 41\/2012, ka arsyetuar gjat\u00eb mbi parimin e luajalitetit (bashk\u00ebpunimit) kushtetues, parim ky q\u00eb duhet t\u00eb udh\u00ebheq\u00eb institucionet e p\u00ebrfshira kur sistemi i p\u00ebrzgjedhjes dhe em\u00ebrimit t\u00eb kandidaturave p\u00ebr k\u00ebto pozicione t\u00eb larta n\u00eb sistemin gjyq\u00ebsor p\u00ebrmbushen nga m\u00eb shum\u00eb se nj\u00eb organ kushtetues.<\/p>\n<p>N\u00eb pik\u00ebn\u00a0 22 t\u00eb vendimit nr.24\/2011 Gjykata Kushtetuese arsyeton: \u201cKy sistem em\u00ebrimi, i pranuar nga Kushtetuta, i vendos subjektet q\u00eb p\u00ebrfshihen n\u00eb t\u00eb para k\u00ebrkes\u00ebs s\u00eb respektimit t\u00eb parimit t\u00eb luajalitetit kushtetues i cili, n\u00eb thelb, shpreh respektin e nd\u00ebrsjell\u00eb nga secili subjekt ndaj kompetencave t\u00eb tjetrit, si dhe n\u00ebnkupton krijimin e nj\u00eb raporti bashk\u00ebpunimi midis tyre\u201d.<\/p>\n<p>N\u00eb nj\u00eb tjet\u00ebr pik\u00eb t\u00eb k\u00ebtij vendimi Gjykata Kushtetuese, rithekson: \u201c37.N\u00eb zbatim t\u00eb parimit baz\u00eb t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, atij t\u00eb ndarjes dhe balancimit nd\u00ebrmjet pushteteve, kushtetut\u00ebb\u00ebr\u00ebsi ka p\u00ebrcaktuar, p\u00ebr secilin nga organet q\u00eb p\u00ebrfaq\u00ebsojn\u00eb k\u00ebto pushtete, kompetencat q\u00eb p\u00ebrputhen\/i p\u00ebrgjigjen q\u00ebllimit t\u00eb tij. P\u00ebr sa koh\u00eb k\u00ebto kompetenca jan\u00eb t\u00eb p\u00ebrcaktuara nga normat kushtetuese, \u00ebsht\u00eb e palejueshme q\u00eb nj\u00eb organ tjet\u00ebr t`i marr\u00eb ose t`i anashkaloj\u00eb ato me vullnetin e tij. \u201c<\/p>\n<p>Me procedur\u00ebn fundore administrative t\u00eb d\u00ebrgimit t\u00eb listave q\u00eb ka ndjekur Kryetari i KED-s\u00eb duket hapur se ky organ ka cenuar parimin e luajalitetit kushtetues, pasi n\u00eb veprimtarin\u00eb administrative t\u00eb tij nuk ka treguar kujdes e bashk\u00ebpunim me Institucionin e Presidentit t\u00eb Republik\u00ebs n\u00eb procedurat e em\u00ebrimit t\u00eb an\u00ebtar\u00ebve t\u00eb rinj t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Duke anashkaluar dhe mosvler\u00ebsuar thell\u00ebsisht faktin se \u00e7far\u00eb efekti do t\u00eb prodhonte veprimtaria e tij administrative n\u00eb ushtrimin e kompetencave nga Presidenti i Republik\u00ebs dhe Kuvendi i Shqip\u00ebris\u00eb, K\u00ebshilli i Em\u00ebrimeve n\u00eb Drejt\u00ebsi i ka vendosur organet n\u00eb nj\u00eb v\u00ebshtir\u00ebsi p\u00ebr t\u00eb ushtruar kompetencat sipas rregullit kushtetues.<\/p>\n<p>Pa nj\u00eb bashk\u00ebpunim midis organeve t\u00eb p\u00ebrfshira n\u00eb procesin e em\u00ebrimit t\u00eb an\u00ebtar\u00ebve t\u00eb rinj t\u00eb Gjykat\u00ebs Kushtetuese (KED-President-KED-Kuvend), ky proces nuk mund t\u00eb p\u00ebrmbyllet n\u00eb p\u00ebrputhje me nenin 179, pikat 2 dhe 12 t\u00eb Kushtetut\u00ebs si dhe parimeve t\u00eb hartuara nga\u00a0 jurisprudenca e vet\u00eb Gjykat\u00ebs Kuvendi i Shqip\u00ebris\u00eb apo deri n\u00eb p\u00ebrfundimin e afatit kushtetues, brenda t\u00eb cilit Kuvendi i Shqip\u00ebris\u00eb do t\u00eb shprehet p\u00ebr zgjedhjen e an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr plot\u00ebsimin e dy vakancave q\u00eb i p\u00ebrkasin atij si organ em\u00ebrtese dhe q\u00eb, sipas p\u00ebrllogaritjes, ky afat p\u00ebrmbushet n\u00eb p\u00ebrfshir\u00eb p\u00ebr shqyrtim n\u00eb seanc\u00eb plenare, brenda nj\u00eb kohe sa m\u00eb t\u00eb shpejt\u00eb, zgjedhjen e an\u00ebtarit t\u00eb dyt\u00eb t\u00eb Gjykat\u00ebs Kushtetuese, n\u00eb m\u00ebnyr\u00eb q\u00eb Presidenti i Republik\u00ebs, t\u00eb ushtroj\u00eb kompetenc\u00ebn e tij, sipas radh\u00ebs s\u00eb diktuar nga Kushtetuta dhe ligji ofroj\u00eb mb\u00ebshtetjen dhe bashk\u00ebpunimin maksimal me secilin prej institucioneve n\u00eb m\u00ebnyr\u00eb q\u00eb Gjykata Kushtetuese e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u00eb
