{"id":122095,"date":"2020-02-14T15:59:56","date_gmt":"2020-02-14T14:59:56","guid":{"rendered":"https:\/\/zjarr.tv\/?p=122095"},"modified":"2020-02-14T15:59:56","modified_gmt":"2020-02-14T14:59:56","slug":"ligji-per-policine-godet-pavaresine-e-gjyqesorit-shoqeria-civile-kercenon-jeten-private-te-qytetareve","status":"publish","type":"post","link":"https:\/\/zjarr.tv\/sq\/ligji-per-policine-godet-pavaresine-e-gjyqesorit-shoqeria-civile-kercenon-jeten-private-te-qytetareve\/","title":{"rendered":"&#8216;Ligji p\u00ebr Policin\u00eb godet pavar\u00ebsin\u00eb e gjyq\u00ebsorit&#8217;, shoq\u00ebria civile: K\u00ebrc\u00ebnon jet\u00ebn private t\u00eb qytetar\u00ebve"},"content":{"rendered":"<p>Organizatat m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb shoq\u00ebris\u00eb civile n\u00eb Shqip\u00ebri kan\u00eb reaguar ashp\u00ebr ndaj projektit t\u00eb qeveris\u00eb p\u00ebr ndryshimet n\u00eb Policin\u00eb e Shtetit. 22 organizata mes t\u00eb cilave, Komiteti Shqiptar i Helsinkit, K\u00ebshilli Shqiptar i Medias, etj, deklarojn\u00eb se me ndryshimet n\u00eb ligj qeveria godet pavar\u00ebsin\u00eb e institucioneve t\u00eb drejt\u00ebsis\u00eb.<\/p>\n<p>Organizatat v\u00ebn\u00eb n\u00eb dukje se dh\u00ebnia e leje e policis\u00eb p\u00ebr t\u00eb kryer p\u00ebrgjime pa miratimin e Prokuroris\u00eb \u00ebsht\u00eb nj\u00eb k\u00ebrc\u00ebnim p\u00ebr jet\u00ebn private t\u00eb \u00e7do shqiptari.<\/p>\n<p>\u201cOrganizatat e shoq\u00ebris\u00eb civile v\u00ebrejn\u00eb se projektligji \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.108\/2014 \u201cP\u00ebr policin\u00eb e shtetit\u201d, ashtu sikurse akti normativ p\u00ebrmban dispozita q\u00eb ngren\u00eb dyshime serioze p\u00ebr c\u00ebnimin e parimeve t\u00eb r\u00ebnd\u00ebsishme kushtetuese si parimin e ndarjes dhe balancimit t\u00eb pushteteve, parimin e pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit, si dhe t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut\u201c,- thuhet n\u00eb deklarat\u00eb.<\/p>\n<p><strong>Deklarata e plot\u00eb e 22 organizatave t\u00eb shoq\u00ebris\u00eb civile:<\/strong><\/p>\n<p>Nj\u00eb grup organizatash t\u00eb shoq\u00ebris\u00eb civile, n\u00eb mb\u00ebshtetje t\u00eb reagimeve t\u00eb m\u00ebparshme, pasi u njoh\u00ebn me projektligjin \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.108\/2014 \u201cP\u00ebr policin\u00eb e shtetit\u201d, t\u00eb depozituar nga K\u00ebshilli i Ministrave n\u00eb Kuvendin e RSH dhe t\u00eb publikuar n\u00eb faqen zyrtare t\u00eb Kuvendit (pjes\u00eb e paket\u00ebs ligjore\u00a0ANTI-K\u00c7K), shprehin shqet\u00ebsimin si vijon:<\/p>\n<p>Organizatat e shoq\u00ebris\u00eb civile, ashtu si n\u00eb t\u00eb kaluar\u00ebn mb\u00ebshtesin \u00e7do nism\u00eb q\u00eb synon t\u00eb intensifikoj\u00eb luft\u00ebn kund\u00ebr terrorizmit, krimit t\u00eb organizuar, krimet e r\u00ebnda dhe t\u00eb konsolidoj\u00eb sigurin\u00eb publike n\u00eb vendin ton\u00eb. Mb\u00ebshtetja jon\u00eb n\u00eb k\u00ebt\u00eb drejtim \u00ebsht\u00eb pasqyruar edhe me kontributin q\u00eb \u00ebsht\u00eb dh\u00ebn\u00eb n\u00eb kuad\u00ebr t\u00eb reformimit t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, nj\u00eb reform\u00eb, p\u00ebr t\u00eb cil\u00ebn pati konsultime gjith\u00ebp\u00ebrfshir\u00ebse me aktor\u00eb vendas dhe nd\u00ebrkomb\u00ebtar\u00eb. Me shqet\u00ebsim v\u00ebrejm\u00eb se, projektligji i propozuar, ashtu sikurse m\u00eb her\u00ebt edhe akti normativ me fuqin\u00eb e ligjit i miratuar n\u00eb dt.31 Janar t\u00eb k\u00ebtij viti nga K\u00ebshilli i Ministrave, jan\u00eb hartuar pa transparenc\u00eb dhe pa konsultim publik paraprak me p\u00ebrfaq\u00ebsuesit e organizatave vendase t\u00eb shoq\u00ebris\u00eb civile.<\/p>\n<p>Organizatat e shoq\u00ebris\u00eb civile v\u00ebrejn\u00eb se projektligji \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.108\/2014 \u201cP\u00ebr policin\u00eb e shtetit\u201d, ashtu sikurse akti normativ p\u00ebrmban dispozita q\u00eb ngren\u00eb dyshime serioze p\u00ebr c\u00ebnimin e parimeve t\u00eb r\u00ebnd\u00ebsishme kushtetuese si parimin e ndarjes dhe balancimit t\u00eb pushteteve, parimin e pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit, si dhe t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut.<\/p>\n<p><strong>\u00a0Konkretisht:<\/strong><\/p>\n<p>Edhe pse koordimini dhe bashk\u00ebpunimi midis institucioneve \u00ebsht\u00eb i nevojsh\u00ebm, n\u00eb vler\u00ebsimin ton\u00eb, p\u00ebrb\u00ebn shkelje t\u00eb pavar\u00ebsis\u00eb s\u00eb prokuroris\u00eb neni 2 i projektligjit (nj\u00ebsoj si neni 8 i aktit normativ). N\u00eb k\u00ebt\u00eb dispozit\u00eb propozohet q\u00eb organe t\u00eb pavarura kushtetuese, sikurse \u00ebsht\u00eb Prokurori i P\u00ebrgjithsh\u00ebm dhe Drejtuesi i Prokuroris\u00eb s\u00eb Posa\u00e7me t\u00eb jen\u00eb pjes\u00eb e Komitetit Komb\u00ebtar p\u00ebr Parandalimin dhe Luft\u00ebn kund\u00ebr Krimit t\u00eb Organizuar. Ky komitet, i organizuar n\u00eb m\u00ebnyr\u00eb kolegjiale do t\u00eb kryesohet nga Ministri i Brendsh\u00ebm (pjes\u00eb e ekzekutivit). Gjithashtu, kjo struktur\u00eb ka n\u00eb p\u00ebrb\u00ebrje funksionar\u00eb t\u00eb ekzekutivit si psh Ministri i Drejt\u00ebsis\u00eb, Ministri i Financave dhe Ekonomis\u00eb q\u00eb em\u00ebrohen dhe shkarkohen direkt nga Kryeministri si dhe ka n\u00eb p\u00ebrb\u00ebrje gjithashtu Drejtorin e p\u00ebrgjithsh\u00ebm t\u00eb Policis\u00eb s\u00eb Shtetit. Komiteti Koordinues, krijon premisa p\u00ebr ndikim t\u00eb pap\u00ebrshtatsh\u00ebm nga ekzekutivi n\u00eb ushtrimin e pavarur t\u00eb funksioneve t\u00eb Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm dhe Drejtuesit t\u00eb Prokuroris\u00eb s\u00eb Posa\u00e7me. Vlen t\u00eb p\u00ebrmendim gjithashtu faktin se Prokuroria e Posa\u00e7me ushtron ndjekjen penale ndaj veprave penale t\u00eb kryera nga zyrtar\u00ebt e nivelit t\u00eb lart\u00eb, p\u00ebrfshi k\u00ebtu edhe p\u00ebrfaq\u00ebsuesit e ekzekutivit n\u00eb k\u00ebt\u00eb Komitet Koordinues (neni 148\/dh i Kushtetut\u00ebs).<\/p>\n<p>\u00c7do rregullim i ri ligjor \u00ebsht\u00eb vler\u00ebsuar nga Gjykata Kushtetuese se nuk \u00ebsht\u00eb i mjaftuesh\u00ebm dhe jo kushtetues, n\u00ebse nuk garanton shmangien e ndikimeve q\u00eb mund t\u00eb ushtroj\u00eb pushteti ekzekutiv n\u00eb \u00e7\u00ebshtje q\u00eb lidhen me dh\u00ebnien e drejt\u00ebsis\u00eb nga gjykata.[1]\u201d.<\/p>\n<p>Neni 4 i projektligjit ndryshon nenin 131 t\u00eb ligjit n\u00eb fuqi p\u00ebr policin\u00eb e shtetit, ku parashikohet se gjat\u00eb veprimtaris\u00eb informative-gjurmuese ose t\u00eb nj\u00eb procedimi policor, me q\u00ebllim parandalimin dhe zbulimin e veprave penale, Policia p\u00ebrdor masat e parashikuara n\u00eb shkronjat \u201ca\u201d \u2013 P\u00ebrgjimi ambiental, \u201cb\u201d \u2013 P\u00ebrdorimi i pajisjeve teknike p\u00ebr fotografim, filmim, video, \u201cc\u201d \u2013 p\u00ebrgjimin e bisedave telefonike ose telekomunikimeve\u201d dhe \u201c\u00e7\u201d mbikqyrjen e fsheht\u00eb. N\u00eb ndryshim nga ligji n\u00eb fuqi, p\u00ebr t\u00eb zbatuar k\u00ebto masa, nuk k\u00ebrkohet autorizim nga prokurori. Nd\u00ebrkoh\u00eb q\u00eb p\u00ebr masat e parashikuara n\u00eb g\u00ebrmat \u201ca\u201d, \u201cb\u201d dhe \u201c\u00e7\u201d,\u00a0 mund t\u00eb zbatohen bazuar thjesht n\u00eb miratimin nga titullar\u00ebt e strukturave t\u00eb policis\u00eb, n\u00eb nivel drejtorie qendrore e vendore. Parashikimet e nenit 131 t\u00eb projektligjit, dhe heqja e autorizimit t\u00eb prokuroris\u00eb p\u00ebr t\u00eb dh\u00ebn\u00eb k\u00ebto masa, n\u00eb vler\u00ebsimin ton\u00eb bien ndesh me nenet 221-226 t\u00eb Kodit t\u00eb Procedur\u00ebs Penale. Kodi i Procedur\u00ebs Penale \u00ebsht\u00eb ligj i miratuar me shumic\u00eb t\u00eb cil\u00ebsuar, bazuar n\u00eb nenin 81 pika 2 t\u00eb Kushtetut\u00ebs dhe dispozitat e tij kan\u00eb ep\u00ebrsi ndaj dispozitave t\u00eb ligjeve q\u00eb jan\u00eb miratuar me shumic\u00eb t\u00eb thjesht\u00eb, sikurse \u00ebsht\u00eb Ligji \u201cP\u00ebr Policin\u00eb e Shtetit\u201d.<\/p>\n<p>Lidhur me masat e propozuara n\u00eb nenin 131, d\u00ebshirojm\u00eb t\u00eb sjellim n\u00eb v\u00ebmendje vendimin e Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut (GJEDNJ) q\u00eb ka penalizuar n\u00eb nj\u00eb rast t\u00eb ngjash\u00ebm Hungarin\u00eb (vendim i dt.12 Janar 2016, n\u00eb \u00e7\u00ebshtjen\u00a0Szabo dhe Vissy kund\u00ebr Hungaris\u00eb). N\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje, Gjykata e Strasburgut (GJEDNJ) vler\u00ebsoi se aktivitetet e gjera t\u00eb p\u00ebrgjimit sekret q\u00eb ishin kryer nga Task Forca Hungareze Anti-Terror kishin shkelur t\u00eb drejtat e aplikant\u00ebve. Task Forca Hungareze u krijua n\u00ebn ombrell\u00ebn e strukturave t\u00eb policis\u00eb, bazuar n\u00eb legjislacionin antiterror t\u00eb vitit 2011. GJEDNJ konstatoi shkelje t\u00eb Konvent\u00ebs Evropiane e n\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb t\u00eb s\u00eb drejt\u00ebs p\u00ebr privat\u00ebsi, pasi Hungaria nuk kishte garantuar mbik\u00ebqyrje apo kontroll gjyq\u00ebsor mbi veprimet p\u00ebrgjuese t\u00eb Task Forc\u00ebs si dhe nuk kishte garantuar masa t\u00eb tjera mbrojt\u00ebse t\u00eb sakta dhe efektive.
