ofert\u00ebs m\u00eb t\u00eb ul\u00ebt t\u00eb skualifikuar dhe ofert\u00ebs ekonomike t\u00eb shpallur fituese\u201d,<\/em>\u00a0thuhet ne njoftimin e KLSH.<\/p>\n<p><strong>Ja njoftimi i n\u00eb Bashkit\u00eb Dropull, Puk\u00eb dheMatp\u00ebr periudh\u00ebn 01.01.2017 deri m\u00eb 31.12.2018, me objekt: 01.01.2017-31.12.2017 (auditim financiar) dhe p\u00ebr periudh\u00ebn 01.01.2017-31.12.2018 (auditim p\u00ebrputhshm\u00ebrie p\u00ebr prokurimet dhe t\u00eb ardhurat).<\/p>\n<p>Me Vendimet respektivenr. 84, dat\u00eb 25.09.2019,nr. 49, dat\u00eb 19.08.2019 dhe nr. 53, dat\u00eb 22.08.2019, t\u00eb Kryetarit t\u00eb KLSH-s\u00eb, jan\u00eb miratuar Raportet P\u00ebrfundimtaret\u00eb Auditimit dhe me shkresatnr. 368\/7, dat\u00eb 28.09.2019,nr.1432\/8, dat\u00eb 19.08.2019 dhe nr. 1434\/6, dat\u00eb 22.08.2019, me q\u00ebllim p\u00ebrmir\u00ebsimin e gjendjesu jan\u00eb rekomanduar BashkiveDropull, Puk\u00eb dhe Mat,masa me karakter organizativ; masa p\u00ebr shp\u00ebrblimin e d\u00ebmit ekonomik t\u00eb shkaktuar n\u00eb vler\u00ebn totale 17.5 milion lek\u00eb dhe munges\u00eb t\u00eb ardhurash p\u00ebr vler\u00ebn prej 45 milion lek\u00eb.<\/p>\n<p>Gjat\u00eb auditimit p\u00ebr t\u00ebtri bashkit\u00ebu konstatuan shkelje dhe parregullsi t\u00eb dispozitave ligjore n\u00eb fuqi n\u00eb fush\u00ebn e prokurimit publik, veprime me efekte negative n\u00eb administrimin dhe menaxhimin me ekonomicitet, eficence dhe efektivitet t\u00eb fondeve publike (3-E) p\u00ebr vler\u00ebn prej 271,798,000 lek\u00ebdhe d\u00ebm ekonomik n\u00eb vler\u00ebn prej 2.7 milion lek\u00eb, shkaktuar si diferenc\u00eb e ofert\u00ebs m\u00eb t\u00eb ul\u00ebt t\u00eb skualifikuar dhe ofert\u00ebs ekonomike t\u00eb shpallur fituese.<\/p>\n<p>I.Bashkia Dropull \u00ebsht\u00eb d\u00ebrguar p\u00ebr vler\u00ebsim n\u00eb organin e Prokuris\u00eb, p\u00ebr sa i p\u00ebrket zhvillimit t\u00eb procedur\u00ebs t\u00eb prokurimit ku \u00ebsht\u00eb konstatuar se:<\/p>\n<p>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cNd\u00ebrtim i rrjetit rrugor \u201cUnaza e Pogonit\u201d, Faza e Par\u00eb\u201d, viti 2017, me vler\u00eb t\u00eb prokuruar prej 116,666,666 lek\u00eb pa tvsh, procedur\u00eb p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb shpallur fitues BOE me ofert\u00ebn m\u00eb t\u00eb disfavorshme ekonomike, p\u00ebr vler\u00ebn prej 114,343,197 lek\u00eb, ose m\u00eb pak se fondi limit n\u00eb shum\u00ebn prej 2,323,469 lek\u00eb, procedur\u00eb e pezulluar m\u00eb par\u00eb nga Komisioni i Prokurimit Publik (KPP), pasi:<\/p>\n<p>Nj\u00ebsia e Prokurimit, me shtyrjen e afatit kohor 1 (nj\u00eb) ditor ka qen\u00eb jasht\u00eb p\u00ebrcaktimeve t\u00eb afateve kohore procedurale p\u00ebr paraqitjen dhe ngarkimin n\u00eb SEP t\u00eb ofertave dhe dokumenteve t\u00eb k\u00ebrkuara nga DST, duke kusht\u00ebzuar numrin e Operator\u00ebve Ekonomik pjes\u00ebmarr\u00ebs n\u00eb k\u00ebt\u00eb procedur\u00eb (vet\u00ebm 2); mos u dh\u00ebn\u00eb mund\u00ebsi atyre p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb prokurim; ulur konkurrenc\u00ebn, dhe p\u00ebr rrjedhoj\u00eb p\u00ebrjashtuar mund\u00ebsin\u00eb e marrjes t\u00eb ofertave ekonomike m\u00eb t\u00eb favorshme.<\/p>\n<p>Komisioni i Vler\u00ebsimit t\u00eb Ofertave dhe Titullarit t\u00eb Autoritetit Kontraktor, me heqjen e pezullimit t\u00eb procedur\u00ebs nga KPP e daton 1 (nj\u00eb) dit\u00eb m\u00eb para se data e zhvillimit t\u00eb prokurimit, ka rezutuar se ka realizuar procedur\u00ebn p\u00ebr vet\u00ebm nj\u00eb dit\u00eb pas zhbllokimit nga KPP, duke u mund\u00ebsuar OE t\u00eb interesuar pjes\u00ebmarrjen n\u00eb prokurim.<\/p>\n<p>II.Bashkia Puk\u00eb, p\u00ebr sa i p\u00ebrket zhvillimit t\u00eb 4 procedurave t\u00eb prokurimit ku\u00ebsht\u00eb konstatuar se:<\/p>\n<p>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cRruga auto Lumzi, Nj\u00ebsia Administrative Lumzi\u201d, me fond limit 34,594,481 lek\u00eb, Komisioni i Vler\u00ebsimit t\u00eb Ofertave (KVO) ka vepruar me dy standarde n\u00eb vler\u00ebsimin e ofertave, pasi t\u00eb 9 (n\u00ebnt\u00eb) Operator\u00ebt Ekonomik (OE) apo BOE pjes\u00ebmarr\u00ebs n\u00eb gar\u00eb (7 t\u00eb skualifikuar dhe 2 t\u00eb kualifikuar), kan\u00eb munges\u00eb e mang\u00ebsi n\u00eb plot\u00ebsimin e \u201cKritereve t\u00eb Ve\u00e7anta t\u00eb Kualifikimit\u201d, p\u00ebr rrjedhoj\u00eb tenderi duhej anuluar.<\/p>\n<p>Mos anulimi i procedur\u00ebs dhe shpallja fitues e BOE, i cili nuk i plot\u00ebson kriteret e DST, ka sjell\u00eb p\u00ebr pasoj\u00eb shkelje t\u00eb barazis\u00eb n\u00eb tendera duke shkaktuar p\u00ebrdorim t\u00eb fondeve publike pa ekonomicitet, eficenc\u00eb dhe efektivitet, n\u00eb vler\u00ebn e kontraktuar prej 33,503,495 lek\u00eb.<\/p>\n<ol start=\"2\">\n<li>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cRehabilitimi i sh\u00ebtitores Gjegjan\u201d, me fond limit 15,000,000 lek\u00eb, Komisioni i Vler\u00ebsimit t\u00eb Ofertave (KVO) ka vepruar me dy standarde n\u00eb vler\u00ebsimin e ofertave, pasi t\u00eb 9 (n\u00ebnt\u00eb) Operator\u00ebt Ekonomik (OE) apo BOE pjes\u00ebmarr\u00ebs n\u00eb gar\u00eb (6 t\u00eb skualifikuar dhe 3 t\u00eb kualifikuar), kan\u00eb munges\u00eb e mang\u00ebsi n\u00eb plot\u00ebsimin e \u201cKritereve t\u00eb Ve\u00e7anta t\u00eb Kualifikimit\u201d, p\u00ebr rrjedhoj\u00eb tenderi duhej anuluar.<\/li>\n<\/ol>\n<p>Mos anulimi i procedur\u00ebs dhe shpallja fitues e BOE, i cili nuk i plot\u00ebson kriteret e DST, ka sjell\u00eb p\u00ebr pasoj\u00eb shkelje t\u00eb barazis\u00eb n\u00eb tendera duke shkaktuar p\u00ebrdorim t\u00eb fondeve publike pa ekonomicitet, eficenc\u00eb dhe efektivitet, n\u00eb vler\u00ebn e kontraktuar prej 12,460,515 lek\u00eb.<\/p>\n<ol start=\"3\">\n<li>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cRikonstruksion i shkoll\u00ebs s\u00eb mesme \u201cSabah Sinani\u201d, me fond limit 26,923,616 lek\u00eb, Komisioni i Vler\u00ebsimit t\u00eb Ofertave (KVO) ka vepruar me dy standarde n\u00eb vler\u00ebsimin e ofertave, pasi t\u00eb 5 (pest\u00eb) Operator\u00ebt Ekonomik (OE) apo BOE pjes\u00ebmarr\u00ebs n\u00eb gar\u00eb (4 t\u00eb skualifikuar dhe 1 t\u00eb kualifikuar), kan\u00eb munges\u00eb e mang\u00ebsi n\u00eb plot\u00ebsimin e \u201cKritereve t\u00eb Ve\u00e7anta t\u00eb Kualifikimit\u201d, p\u00ebr rrjedhoj\u00eb tenderi duhej anuluar.<\/li>\n<\/ol>\n<p>Mos anulimi i procedur\u00ebs dhe shpallja fitues e BOE, i cili nuk i plot\u00ebson kriteret e DST, ka sjell\u00eb p\u00ebr pasoj\u00eb shkelje t\u00eb barazis\u00eb n\u00eb tendera duke shkaktuar p\u00ebrdorim t\u00eb fondeve publike pa ekonomicitet, eficenc\u00eb dhe efektivitet, n\u00eb vler\u00ebn e kontraktuar prej 22,967,096 lek\u00eb.<\/p>\n<ol start=\"4\">\n<li>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cRehabilitim i Rrjetit Ujit\u00ebs te Uj\u00ebmbledh\u00ebsit Kukaj, Dega Luf\u201d Puk\u00eb\u201d, me fond limit 25,828,429lek\u00eb, Komisioni i Vler\u00ebsimit t\u00eb Ofertave (KVO) ka vepruar me dy standarde n\u00eb vler\u00ebsimin e ofertave, pasi t\u00eb 12 (dymb\u00ebdhjet\u00eb) Operator\u00ebt Ekonomik (OE) apo BOE pjes\u00ebmarr\u00ebs n\u00eb gar\u00eb (11 t\u00eb skualifikuar dhe 1 t\u00eb kualifikuar), kan\u00eb munges\u00eb e mang\u00ebsi n\u00eb plot\u00ebsimin e \u201cKritereve t\u00eb Ve\u00e7anta t\u00eb Kualifikimit\u201d, p\u00ebr rrjedhoj\u00eb tenderi duhej anuluar.<\/li>\n<\/ol>\n<p>Mos anulimi i procedur\u00ebs dhe shpallja fitues e BOE, i cili nuk i plot\u00ebson kriteret e DST, ka sjell\u00eb p\u00ebr pasoj\u00eb shkelje t\u00eb barazis\u00eb n\u00eb tendera duke shkaktuar p\u00ebrdorim t\u00eb fondeve publike pa ekonomicitet, eficenc\u00eb dhe efektivitet, n\u00eb vler\u00ebn e kontraktuar prej 25,333,350 lek\u00eb.<\/p>\n<p>II.Bashkia Mat, p\u00ebr sa i p\u00ebrket zhvillimit t\u00eb procedur\u00ebss\u00eb prokurimit ku \u00ebsht\u00eb konstatuar se:<\/p>\n<ol>\n<li>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt:\u201cRikonstruksion i kanalit vadit\u00ebs fshati Derjan, (i pjessh\u00ebm) Burrel\u201d, me fond limit 16,666,666 lek\u00eb, Komisioni i Vler\u00ebsimit t\u00eb Ofertave (KVO), ka vepruar me dy standarde n\u00eb vler\u00ebsimin e ofertave, duke skualifikuar pa t\u00eb dretj\u00eb OE me ofert\u00eb m\u00eb t\u00eb favorshme ekonomike dhe pa asnj\u00eb mang\u00ebsi n\u00eb dokumentacion dhe kualifikuar dhe shpallur fitues BEO me ofert\u00ebn m\u00eb t\u00eb lart\u00eb ekonomike dhe me mang\u00ebsi t\u00eb nj\u00ebjta apo t\u00eb ngjashme me\u00a0 OE e t\u00eb tjer\u00eb t\u00eb skualifikuar p\u00ebr munges\u00eb e mang\u00ebsi n\u00eb plot\u00ebsimin e \u201cKritereve t\u00eb Ve\u00e7anta t\u00eb Kualifikimit\u201d, p\u00ebr rrjedhoj\u00eb tenderi duhej anuluar.<\/li>\n<\/ol>\n<p>Kualifikimi dhe shpallja padrejt\u00ebsisht fitues BOE me vler\u00eb m\u00eb t\u00eb lart\u00eb dhe skualifikimi i padretj\u00eb i OE me ofert\u00eb m\u00eb t\u00eb favorshme ekonomike dhe pa mang\u00ebsi n\u00eb dokumentacion ka sjell p\u00ebr pasoj\u00eb keqp\u00ebrdorim t\u00eb fondeve publike me d\u00ebm ekonomik n\u00eb vler\u00ebn 2,743,534lek\u00eb,(llogaritur si diferenc\u00eb nd\u00ebrmjet ofert\u00ebs fituese dhe asaj t\u00eb s\u2019kualifikuar).<\/p>\n<ol start=\"2\">\n<li>N\u00eb procedur\u00ebn e prokurimit t\u00eb realizuar, me objekt: \u201cRikonstruksion i kanalit vadit\u00ebs fshati Derjan, (i pjessh\u00ebm) Burrel\u201d, me fond limit 16,666,666 lek\u00eb, shpallur fitues OE me ofert\u00ebn m\u00eb t\u00eb disfavorshme ekonomike p\u00ebr vler\u00ebn prej 16,458,763 lek\u00eb, me diferenc\u00eb nga fondi limit prej 207,903 lek\u00eb, nga ku ka rezultuar se nj\u00eb OE pjes\u00ebmarr\u00ebs ndodhet n\u00eb kushtet e keqinformimit p\u00ebr q\u00ebllime kualifikimi pasi ka ngarkuar n\u00eb Sistemin Elektronik t\u00eb Prokurimit (SEP) dokumente t\u00eb rreme apo pa v\u00ebrteta.<\/li>\n<\/ol>\n<p>Vendimet e marra nga Nj\u00ebsia e Prokurimit, Komisioni i Vler\u00ebsimit t\u00eb Ofertave dhe Titullari i Autoritetit Kontraktor,p\u00ebr shpalljen fitues t\u00eb operator\u00ebve ekonomik\u00eb me mang\u00ebsi n\u00eb dokumentacionin e paraqitur, jo sipas k\u00ebrkesave t\u00eb DST-ve t\u00eb miratuara nga Autoriteti Kontraktor dhe Nj\u00ebsia e Hartimit t\u00eb Dokumenteve t\u00eb Tenderit, duke mos anuluar procedurat, apo mos shpallur fitues OE me ofert\u00eb m\u00eb t\u00eb favorshme ekonomike, si dhe n\u00eb nj\u00eb rast duke mos shpallur fitues ofert\u00ebn ekonomike t\u00eb vlefshme, kan\u00eb sjell impakt negativ n\u00eb buxhtet respektive, trajtim diskriminues dhe t\u00eb pabarabart\u00eb t\u00eb ofertuesve, sidhe dokumentacioni i ngarkuar n\u00eb sistem nga Operatori Ekonomik p\u00ebr procedur\u00ebn e prokurimit t\u00eb realizuar nga Bashkia Mat, jan\u00eb veprime n\u00eb kund\u00ebrshtim me dispozitat e ligjit nr. 9643, dat\u00eb 20.11.2006 \u201cP\u00ebr prokurimin publik\u201d, i ndryshuar dhe VKM nr. 914, dat\u00eb 29.12.2014 \u201cP\u00ebr miratimin e rregullave t\u00eb prokurimit publik\u201d, i ndryshuar.<\/p>\n<p>P\u00ebr k\u00ebto shkelje, KLSH me shkres\u00ebn nr. 368\/8 dat\u00eb 02.10.2019, ka d\u00ebrguar p\u00ebr vler\u00ebsim dhe analiz\u00eb pran\u00eb Prokuroris\u00eb s\u00eb Rrethit Gjyq\u00ebsor Gjirokast\u00ebr, Nj\u00ebsin\u00eb e Prokurimit, Komisionin e Vler\u00ebsimit t\u00eb Ofertave dhe Titullarin e Autoritetit Kontraktor, t\u00eb Bashkis\u00eb Dropull dhe me shkresat respektive,nr. 1432\/10 dat\u00eb 19.08.2019 dhe nr. 1434\/10, dat\u00eb 22.09.2019,pran\u00eb Prokuroris\u00eb s\u00eb Rrethit Gjyq\u00ebsor Puk\u00eb dhe Mat,Indicie penalendaj punonj\u00ebsve t\u00eb ngarkuar me realizimin e procedurave t\u00eb prokurimit t\u00eb Bashkive, sidhe 1 (nj\u00eb) Eperatori Ekonomik.<\/p>\n<p>KLSH, me q\u00ebllim p\u00ebrmir\u00ebsimin e situat\u00ebs u ka rekomanduar BashkiveDropull,Puk\u00eb dhe Mat masa me karakter organizativ n\u00eb lidhje me eleminimin e praktikave q\u00eb kan\u00eb sjell\u00eb impakt negativ n\u00eb buxhet,
