K\u00ebto jan\u00eb p\u00ebrllogaritje t\u00eb b\u00ebra nga vet\u00eb KLGJ, n\u00ebp\u00ebrmjet aplikacioneve online, q\u00eb si\u00e7 e tham\u00eb m\u00eb lart\u00eb v\u00ebshtir\u00eb se mund t\u00eb merren p\u00ebr referenc\u00eb n\u00eb kushtet infrastrukturore t\u00eb Shqip\u00ebris\u00eb\u201d,<\/em>\u00a0tha ajo.<\/p>\n<p>Deklarata e plot\u00eb e Dhurata \u00c7upit<\/p>\n<p>N\u00eb dat\u00ebn 10.06.2022, KLGJ ka miratuar Har\u00ebn e Re Gjyq\u00ebsore, e cila sjell riorganizimin e gjykatave t\u00eb shkall\u00ebs s\u00eb par\u00eb t\u00eb juridiksionit t\u00eb p\u00ebrgjithsh\u00ebm nga 22 gjykata t\u00eb rretheve gjyq\u00ebsore n\u00eb 13 t\u00eb tilla (pra mbyllen 9 gjykata t\u00eb shkall\u00ebs s\u00eb par\u00eb). Harta sjell riorganizimin e gjykatave t\u00eb apelit, nga 6 gjykata n\u00eb nj\u00eb gjykat\u00eb t\u00eb vetme me seli n\u00eb Tiran\u00eb (mbyllen 5 gjykata t\u00eb apelit), si dhe 6 gjykatat administrative t\u00eb shkall\u00ebs s\u00eb par\u00eb do t\u00eb riorganizohen n\u00eb dy t\u00eb tilla, p\u00ebrkat\u00ebsisht n\u00eb Tiran\u00eb dhe Lushnj\u00eb (mbyllen 4 gjykata administrative). N\u00eb total pra, do t\u00eb mbyllen 18 gjykata, cka do t\u00eb thot\u00eb se qytetar\u00ebt e k\u00ebtyre qyteteve do t\u00eb duhet q\u00eb p\u00ebr c\u00ebshtjet e tyre t\u2019u drejtohen qyteteve t\u00eb tjera, duke rritur kostot n\u00eb koh\u00eb dhe para.<\/p>\n<p>N\u00eb fund t\u00eb vitit 2021, Gjykata e Apelit Tiran\u00eb kishte 6.348 c\u00ebshtje penale dhe 7.507 c\u00ebshtje civile t\u00eb pagjykuara, pra n\u00eb total 13.855 c\u00ebshtje. Nga 31 gjyqtar\u00eb q\u00eb duhet t\u00eb ket\u00eb kjo gjykat\u00eb, aktualisht ka vet\u00ebm n\u00ebnt\u00eb. Tendenca aktuale p\u00ebr zgjidhjen e nj\u00eb c\u00ebshtjeje shkon deri n\u00eb 5820.1 dit\u00eb ose 15.95 vjet. Pra, nj\u00eb qyteti apo biznesi q\u00eb ka marr\u00eb nj\u00eb vendim t\u00eb shkall\u00ebs s\u00eb par\u00eb mund t\u2019i duhen deri n\u00eb 15 vite q\u00eb vendimi t\u00eb marr\u00eb form\u00eb t\u00eb prer\u00eb, rrjedhimisht t\u00eb b\u00ebhet i ekzekutuesh\u00ebm. T\u00eb dh\u00ebnat e m\u00ebsip\u00ebrme jan\u00eb ekstraktuar nga raporti vjetor i K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor.<\/p>\n<p>Megjithat\u00eb, projekti i Hart\u00ebs s\u00eb re Gjyq\u00ebsore parashikon mbylljen e pes\u00eb gjykatave t\u00eb apelit dhe transferimin e t\u00eb gjitha c\u00ebshtjeve p\u00ebr t\u2019u gjykuar n\u00eb Gjykat\u00ebn e Apelit Tiran\u00eb. Sipas t\u00eb dh\u00ebnave t\u00eb KLGJ-s\u00eb, aktualisht n\u00eb rang vendi jan\u00eb 28.671 c\u00ebshtje q\u00eb pritet t\u00eb gjykohen n\u00eb Apel. P\u00ebr p\u00ebrballimin e k\u00ebsaj ngarkese, projekti i KLGJ-s\u00eb parashikon gjithsej 78 gjyqtar\u00eb, cka me gjendjen aktuale do t\u00eb thot\u00eb 368 c\u00ebshtje p\u00ebr gjyqtar. Megjithat\u00eb, kjo shif\u00ebr \u00ebsht\u00eb marr\u00eb n\u00eb kushtet kur organika e Gjykat\u00ebs s\u00eb Apelit Tiran\u00eb do t\u00eb ishte e plot\u00eb, pasi n\u00eb kushtet aktuale p\u00ebr shkak t\u00eb procesit t\u00eb rivler\u00ebsimit nuk \u00ebsht\u00eb as gjysma e k\u00ebsaj trupe n\u00eb detyr\u00eb, nd\u00ebrkoh\u00eb q\u00eb t\u00eb tjer\u00eb gjyqtar\u00eb jan\u00eb akoma n\u00eb proces rivler\u00ebsimi dhe mund t\u00eb largohen nga detyra.<\/p>\n<p>Shifrat e paraqitura n\u00eb raportin vjetor t\u00eb KLGJ-s\u00eb rezultojn\u00eb t\u00eb pap\u00ebrputhshme me t\u00eb dh\u00ebna q\u00eb gjenden n\u00eb faqen zyrtare t\u00eb gjykatave t\u00eb apelit www.gjykata.gov.al, sipas t\u00eb cilave deri n\u00eb dat\u00ebn 30.06.2022 ka 40.305 c\u00ebshtje n\u00eb shqyrtim t\u00eb pagjykuara, dhe kjo shif\u00ebr n\u00eb rang vendi arrin 92.453 c\u00ebshtje. Diferenca nd\u00ebrmjet shifrave n\u00eb raportin vjetor t\u00eb KLGJ-s\u00eb me shifrat n\u00eb faqen zyrtare t\u00eb gjykatave jan\u00eb n\u00eb mas\u00ebn mbi 60%. N\u00ebse kjo do t\u00eb ishte gjendja reale e gjykatave, at\u00ebher\u00eb problemi q\u00eb krijohet p\u00ebr shkak t\u00eb kompozimit t\u00eb ri gjyq\u00ebsor, do t\u00eb ishte akoma m\u00eb i r\u00ebnd\u00eb pasi cdo qytetari apo biznesi do t\u2019i duheshin disa dhjet\u00ebra vite q\u00eb c\u00ebshtja e tij t\u00eb gjykohej dhe merrej nj\u00eb vendim p\u00ebrfundimtar.<\/p>\n<p>P\u00ebr t\u00eb pasur nj\u00eb projeksion se si do t\u00eb jet\u00eb gjendja n\u00eb Gjykat\u00ebn e Apelit Tiran\u00eb, n\u00ebse 5 gjykatat e tjera do t\u00eb mbyllen, vler\u00ebsojm\u00eb se \u00ebsht\u00eb me vend t\u2019i hedhim nj\u00eb sy Gjykat\u00ebs Administrative t\u00eb Apelit gjat\u00eb vitit 2021. Kjo Gjykat\u00eb ka n\u00eb organik\u00ebn e saj 13 gjyqtar\u00eb, nga t\u00eb cil\u00ebt vet\u00ebm 5 jan\u00eb n\u00eb detyr\u00eb. Sa i p\u00ebrket c\u00ebshtjeve t\u00eb pashqyrtuara, nga t\u00eb dh\u00ebnat zyrtare t\u00eb KLGJ-s\u00eb rezulton se n\u00eb vitin 2021 mbeteshin 18.415 c\u00ebshtje p\u00ebr t\u2019u gjykuar. P\u00ebr zgjidhjen e nj\u00eb c\u00ebshtjeje, tendenca \u00ebsht\u00eb, q\u00eb n\u00eb kushtet aktuale, duhen mesatarisht 7577.8 dit\u00eb ose 20.7 vjet. K\u00ebto shifra jan\u00eb mjaft dometh\u00ebn\u00ebse p\u00ebr t\u00eb treguar se krijimi i nj\u00eb gjykate apeli n\u00eb nivel komb\u00ebtar, mund t\u00eb sjell\u00eb vonesa dhe zvarritje t\u00eb proceseve aq t\u00eb gjata deri n\u00eb humbjen e interesit t\u00eb qytetar\u00ebve dhe bizneseve p\u00ebr ndjekjen e tyre.<\/p>\n<p>Neni 14 i ligjit nr. 98\/2016 \u201cP\u00ebr Organizimin e Pushtetit Gjyq\u00ebsor n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, p\u00ebrcakton se harta e re gjyq\u00ebsore duhet t\u00eb p\u00ebrmbush\u00eb tre objektiva: (i) garantimi i aksesit n\u00eb drejt\u00ebsi, q\u00eb lidhet me af\u00ebrsin\u00eb e individit me gjykat\u00ebn; (ii) uljen e kostove, me q\u00ebllim p\u00ebrdorimin me efektshm\u00ebri t\u00eb burimeve publike; dhe (iii) rritjen e cil\u00ebsis\u00eb dhe p\u00ebrshtatshm\u00ebris\u00eb s\u00eb sh\u00ebrbimeve t\u00eb ofruara. Projekti i propozuar duket t\u00eb ket\u00eb probleme me secilin prej tre kritereve, pasi c\u00ebnon af\u00ebrsin\u00eb e individit me gjykat\u00ebn, rrit kostot n\u00eb koh\u00eb dhe para p\u00ebr qytetar\u00ebt, si dhe c\u00ebnon efektivisht cil\u00ebsin\u00eb e sh\u00ebrbimit p\u00ebr qytetar\u00ebt nisur nga vonesat e shumta q\u00eb t\u00eb prodhohen p\u00ebr gjykimin e nj\u00eb c\u00ebshtjeje.<\/p>\n<p>Mbyllja e gjykatave nuk \u00ebsht\u00eb nj\u00eb proces q\u00eb ndodh p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb Shqip\u00ebri. M\u00eb par\u00eb, ky proces ka ndodhur n\u00eb Librazhd dhe Gramsh, dhe \u00ebsht\u00eb arsyetuar me faktin se zhvillimet infrastrukturore dhe zhvendosja e popullsis\u00eb nd\u00ebr vite, e ka b\u00ebr\u00eb t\u00eb panevojshme vazhdimin e funksionimit t\u00eb k\u00ebtyre gjykatave. Megjithat\u00eb, projekti i propozuar \u00ebsht\u00eb ndryshimi m\u00eb drastik i ndodhur n\u00eb 32 vite i organizimit gjyq\u00ebsor. Metodat e p\u00ebrdorura nga KLGJ p\u00ebr riorganizimin gjyq\u00ebsor jan\u00eb t\u00eb tilla q\u00eb krijojn\u00eb mjaft probleme sa i p\u00ebrket besueshm\u00ebris\u00eb s\u00eb tyre. Fjala vjen, KLGJ e ka b\u00ebr\u00eb matjen e af\u00ebrsis\u00eb s\u00eb individit me gjykat\u00ebn bazuar n\u00eb aplikacionet \u201cORSM\u201d dhe \u201cGoogle Map\u201d, dhe jo me matje reale, cka do t\u00eb mjaftonte p\u00ebr t\u2019i v\u00ebn\u00eb kapak k\u00ebtij diskutimi sa i p\u00ebrket seriozitetit dhe cil\u00ebsis\u00eb s\u00eb k\u00ebtij sh\u00ebrbimi. Aplikacionet mund t\u00eb funksionojn\u00eb n\u00eb vende si Gjermania dhe Franca, por n\u00eb nj\u00eb vend si Shqip\u00ebria ku infrastruktura \u00ebsht\u00eb shum\u00eb e dob\u00ebt, nj\u00eb distanc\u00eb 4 km nga Lapraka n\u00eb Gjykat\u00ebn e Apelit Tiran\u00eb do 40 minuta koh\u00eb dhe jo 10 min t\u00eb jep aplikacioni.<\/p>\n<p>Sot q\u00eb flasim nj\u00eb qytetari p\u00ebr t\u00eb shkuar n\u00eb Gjykat\u00ebn e Shkall\u00ebs s\u00eb Par\u00eb mund t\u2019i duhen nga 1 \u2013 1.5 or\u00eb, nd\u00ebrsa sipas riorganizimit gjyq\u00ebsor qytetar\u00ebve do t\u2019iu duhen 2.5 \u2013 3.5 or\u00eb p\u00ebr t\u00eb arritur n\u00eb gjykat\u00eb. K\u00ebto jan\u00eb p\u00ebrllogaritje t\u00eb b\u00ebra nga vet\u00eb KLGJ, n\u00ebp\u00ebrmjet aplikacioneve online, q\u00eb sic e tham\u00eb m\u00eb lart\u00eb v\u00ebshtir\u00eb se mund t\u00eb merren p\u00ebr referenc\u00eb n\u00eb kushtet infrastrukturore t\u00eb Shqip\u00ebris\u00eb.<\/p>\n<p>N\u00eb projektin e propozuar nga KLGJ, mungon nj\u00eb studim fizibiliteti sa i p\u00ebrket: (i) kostove t\u00eb blerjes s\u00eb hap\u00ebsira, projektimit inxhinierik, nd\u00ebrtimit t\u00eb godinave t\u00eb reja, sallave t\u00eb gjyqeve, mobilimit, nd\u00ebrtimit t\u00eb sistemeve IT; (ii) kostot e m\u00ebsip\u00ebrme p\u00ebr prokurorit\u00eb; (iii) kostot vjetore t\u00eb Drejtoris\u00eb s\u00eb Burgjeve p\u00ebr t\u2019i sjell\u00eb t\u00eb paraburgosurit n\u00eb gjykatat e shkall\u00ebs s\u00eb par\u00eb apo Apelin e Tiran\u00eb; (iv) kostot e gjyqtar\u00ebve dhe prokuror\u00ebve q\u00eb do t\u00eb transferohen n\u00eb Tiran\u00eb, shpenzimet e tyre p\u00ebr akomodim, transport etj.<\/p>\n<p>Duke par\u00eb pak situat\u00ebn n\u00eb rajon, rezulton se p\u00ebrvec Kosov\u00ebs, e cila ka nj\u00eb territor dhe popullsi shum\u00eb m\u00eb t\u00eb vog\u00ebl se e jona, asnj\u00eb prej vendeve t\u00eb tjera t\u00eb rajonit nuk ka nj\u00eb gjykat\u00eb unike apeli. P\u00ebr shembull, Kroacia ka 21 gjykata apeli dhe synon t\u2019i ul\u00eb n\u00eb 15; Sllovakia ka 8 gjykata apeli; Bosnja ka 16 gjykata apeli; Sllovenia dhe Maqedonia kan\u00eb nga 4 gjykata apeli.
