{"id":315773,"date":"2023-03-12T10:25:48","date_gmt":"2023-03-12T09:25:48","guid":{"rendered":"https:\/\/zjarr.tv\/?p=315773"},"modified":"2023-03-12T10:25:48","modified_gmt":"2023-03-12T09:25:48","slug":"opinion-nga-avokati-erald-aga-per-ceshtjen-e-auditimit-te-banesave-mbi-50-vjecare-cfare-parashikohet-ne-projekt-vendim","status":"publish","type":"post","link":"https:\/\/zjarr.tv\/sq\/opinion-nga-avokati-erald-aga-per-ceshtjen-e-auditimit-te-banesave-mbi-50-vjecare-cfare-parashikohet-ne-projekt-vendim\/","title":{"rendered":"Opinion nga Avokati Erald Aga p\u00ebr \u00e7\u00ebshtjen e auditimit t\u00eb banesave mbi  50 vjecare. \u00c7far\u00eb parashikohet n\u00eb projekt vendim?"},"content":{"rendered":"<p>Opinion nga Avokati Erald Aga p\u00ebr \u00e7\u00ebshtjen e auditimit t\u00eb banesave mbi 50 vjecare.<br \/>\n\u00c7far\u00eb parashikohet n\u00eb projekt vendim?<br \/>\n\u2022 T\u00eb gjith\u00eb objektet t\u00eb cilat kan\u00eb mbi 50 vjet q\u00eb jan\u00eb nd\u00ebrtuar do t\u00eb duhet q\u00eb t\u2019i n\u00ebnshtrohen auditimit teknik.<br \/>\n\u2022 Auditim teknik do t\u00eb konsistoj\u00eb n\u00eb kryerjen e ekspertiz\u00ebs s\u00eb thelluar p\u00ebr t\u00eb vler\u00ebsuar gjendjen teknike aktuale dhe kapacitetin mbajt\u00ebs t\u00eb objekteve.<br \/>\n\u2022 N\u00eb rast se vler\u00ebsohet se objekti nuk p\u00ebrmbush kushtet teknike, at\u00ebher\u00eb i hapet rruga e riparimit ose e prishjes s\u00eb objektit.<br \/>\n\u2022 Subjektet q\u00eb do t\u00eb b\u00ebjn\u00eb auditimin teknik t\u00eb objekteve do p\u00ebrzgjidhen nga nj\u00ebsit\u00eb e vet\u00ebqeverisjes vendore dhe jo nga vet\u00eb pronar\u00ebt e objekteve.<br \/>\n\u2022 Auditimi teknik do i vihet n\u00eb dispozicion Institutit t\u00eb Nd\u00ebrtimit p\u00ebr kryerjen e oponenc\u00ebs.\u201cInstituti i Nd\u00ebrtimit me kryerjen e oponenc\u00ebs jep mendimin e tij, i cili mbizot\u00ebron mbi aktauditimin teknik dhe zbatohet nga nj\u00ebsit\u00eb e vet\u00ebqeverisjes vendore ose autoritetet p\u00ebrgjegj\u00ebse.<br \/>\n\u2022 Pas kryerjes s\u00eb oponenc\u00ebs dhe analizimit ekonomiko-financiar mbi mund\u00ebsin\u00eb m\u00eb optimale p\u00ebr t\u00eb riparuar apo prodhuar dhe rind\u00ebrtuar objektin, Instituti i Nd\u00ebrtimit informon ministrin\u00eb q\u00eb ka n\u00eb p\u00ebrgjegj\u00ebsin\u00eb e saj fush\u00ebn e nd\u00ebrtimit apo bashkin\u00eb n\u00ebn juridiksionin e t\u00eb cilit ndodhet territori ku ngrihet objekti, mbi konkluzionin e arritur.<br \/>\n\u2022 Vendimi p\u00ebr prishje t\u00eb objektit mund t\u00eb merret n\u00eb rast se vlera p\u00ebr riparim \u00ebsht\u00eb e barazvlefshme ose m\u00eb e madhe se vlera p\u00ebr nd\u00ebrtimin e tij.<br \/>\n\u2022 P\u00ebr kryerjen e prishjes, riparimit ose nd\u00ebrtimit t\u00eb objekteve, nga nisja e k\u00ebtyre proceseve, deri n\u00eb procesin p\u00ebrfundimtar t\u00eb certifikimit t\u00eb punimeve, institucionet p\u00ebrgjegj\u00ebse zbatojn\u00eb procedur\u00ebn dhe rregullat sipas legjislacionit n\u00eb fuqi.<br \/>\nProblematikat ligjore dhe kushtetuese t\u00eb projekt vendimit.<br \/>\n\u200bReferuar projekt vendimit konstatohet se bazohet n\u00eb ligjin \u201cP\u00ebr kontrollin dhe disiplinimin e punimeve t\u00eb nd\u00ebrtimit\u201d por gjithsesi n\u00eb asnj\u00eb nen t\u00eb k\u00ebtij ligji nuk parashikohet nj\u00eb proces i till\u00eb. Po ashtu projekt vendimi nuk specifikon se \u00e7far\u00eb do t\u00eb ndodh\u00eb me truallin e godin\u00ebs dhe pronar\u00ebt e tyre.<br \/>\n\u200bProblematikat kryesore t\u00eb k\u00ebtij projekt vendimi jan\u00eb kryesisht kushtetuese dhe ligjore. Kushtetuese p\u00ebr shkak se c\u00ebnohet r\u00ebnd\u00eb e drejta e pron\u00ebs e parashikuar dhe mbrojtur nga Kushtetuta n\u00eb nenin 41 dhe 42 t\u00eb saj.<br \/>\nNeni 41<br \/>\n1. E drejta e pron\u00ebs private \u00ebsht\u00eb e garantuar.<br \/>\n2. Prona fitohet me dhurim, me trash\u00ebgimi, me blerje dhe me \u00e7do m\u00ebnyr\u00eb tjet\u00ebr klasike t\u00eb parashikuar n\u00eb Kodin Civil.<br \/>\n3. Ligji mund t\u00eb parashikoj\u00eb shpron\u00ebsime ose kufizime n\u00eb ushtrimin e s\u00eb drejt\u00ebs s\u00eb pron\u00ebs vet\u00ebm p\u00ebr interesa publik\u00eb.<br \/>\n4. Shpron\u00ebsimet ose ato kufizime t\u00eb s\u00eb drejt\u00ebs s\u00eb pron\u00ebs q\u00eb barazohen me shpron\u00ebsimin, lejohen vet\u00ebm p\u00ebrkundrejt nj\u00eb shp\u00ebrblimi t\u00eb drejt\u00eb.<br \/>\n5. P\u00ebr mosmarr\u00ebveshjet lidhur me mas\u00ebn e shp\u00ebrblimit mund t\u00eb b\u00ebhet ankim n\u00eb gjykat\u00eb.<br \/>\nNeni 42<br \/>\n1. Liria, prona dhe t\u00eb drejtat e njohura me Kushtetut\u00eb dhe me ligj nuk mund t\u00eb cenohen pa nj\u00eb proces t\u00eb rregullt ligjor.<br \/>\n2. Kushdo, p\u00ebr mbrojtjen e t\u00eb drejtave, t\u00eb lirive dhe t\u00eb interesave t\u00eb tij kushtetues dhe ligjor\u00eb, ose n\u00eb rastin e akuzave t\u00eb ngritura kund\u00ebr tij, ka t\u00eb drejt\u00ebn e nj\u00eb gjykimi t\u00eb drejt\u00eb dhe publik brenda nj\u00eb afati t\u00eb arsyesh\u00ebm nga nj\u00eb gjykat\u00eb e pavarur dhe e paanshme e caktuar me ligj.<br \/>\n\u200bReferuar projekt vendimit dhe nenit 41 dhe 42 t\u00eb Kushtetut\u00ebs rezulton q\u00eb projekt vendimi si akt \u00ebsht\u00eb anti kushtetues p\u00ebr shkak se kushtetuta \u00ebsht\u00eb ajo q\u00eb ka sanksionuar q\u00eb e drejta e pron\u00ebs private \u00ebsht\u00eb e garantuar dhe i vetmi rast q\u00eb pronari mund t\u00eb zhvihet nga cil\u00ebsia e t\u00eb q\u00ebnit i till\u00eb \u00ebsht\u00eb n\u00eb rastin e \u201cshpron\u00ebsimit p\u00ebr interes publik\u201d. N\u00eb rastin konkret, ky projekt vendim nuk \u00ebsht\u00eb p\u00ebr interes publik p\u00ebr shkak se e drejta e pron\u00ebs dhe g\u00ebzimit t\u00eb saj \u00ebsht\u00eb t\u00ebr\u00ebsisht private e lidhur ngusht\u00ebsisht me pronar\u00ebt e banesave dhe askush p\u00ebrvec tyre nuk do t\u00eb kishte interes p\u00ebr m\u00ebnyr\u00ebn e g\u00ebzimit, posedimit apo p\u00ebrdorimit t\u00eb pron\u00ebs.<br \/>\n\u200bPor edhe sikur p\u00ebr nj\u00eb moment t\u00eb merrej e mir\u00ebq\u00ebn\u00eb se do t\u00eb ishim p\u00ebrpara nj\u00eb interesi publik s\u00ebrish n\u00eb nenin 8 pika \u00eb e ligjit p\u00ebr shpron\u00ebsimi p\u00ebr interes publik citoj: \u201cP\u00ebr rastet kur objekte t\u00eb luajtshme e t\u00eb paluajtshme, p\u00ebr shkaqe objektive, n\u00eb kushtet e degradimit ose forc\u00ebs madhore, krijojn\u00eb rrezik t\u00eb p\u00ebrhersh\u00ebm p\u00ebr sigurin\u00eb dhe sh\u00ebndetin publik ose krijojn\u00eb rreziqe p\u00ebr zhvillimin e q\u00ebndruesh\u00ebm, n\u00eb at\u00eb shkall\u00eb q\u00eb me gjith\u00eb ndihm\u00ebn e shtetit, k\u00ebto rreziqe nuk mund t\u00eb parandalohen nga pronari i tyre\u201d.<br \/>\nE p\u00ebrs\u00ebris: \u201c&#8230;kur k\u00ebto rreziqe nuk mund t\u00eb parandalohen nga pronari i tyre\u201d. M\u00eb thjesht\u00eb akoma: \u00cbsht\u00eb pronari i pasuris\u00eb s\u00eb paluajtshme q\u00eb me gjith\u00eb ndihm\u00ebn e shtetit do t\u00eb marr\u00eb vendimin p\u00ebr ta parandaluar degradimin e pron\u00ebs s\u00eb tij. E n\u00ebse pronari nuk ka mund\u00ebsi t\u00eb parandaloj\u00eb degradimin e pron\u00ebs s\u00eb tij \u00ebsht\u00eb shteti q\u00eb e ndihmon por n\u00eb asnj\u00eb moment shteti nuk mundet t\u00eb tja marr\u00eb pron\u00ebn pronarit, tja shemb\u00eb e tja jap\u00eb m\u00eb pas ndonj\u00eb firme nd\u00ebrtimi p\u00ebr t\u00eb nd\u00ebrtuar pallat apo komplekse pallatesh t\u00eb reja n\u00eb pronat e k\u00ebtyre pronar\u00ebve.<br \/>\nPra, shteti nuk mundet t\u00eb marr\u00eb rolin e pronarit e t\u00eb sillet si pronar por t\u00eb gjith\u00eb k\u00ebto t\u00eb drejta kushtetuta dhe ligji shpron\u00ebsimit p\u00ebr interes publik ja ka njohur vet\u00ebm pronarit. \u00cbsht\u00eb pronari ai q\u00eb mundet t\u00eb negocioj\u00eb p\u00ebr pron\u00ebn e tij me t\u00eb tret\u00eb. Por n\u00eb asnj\u00eb rast edhe sikur shteti t\u00eb vendos\u00eb t\u00eb shkel\u00eb edhe kushtetut\u00ebn edhe ligjin e shpron\u00ebsimit nuk mund t\u2019i p\u00ebrvet\u00ebsohet prona pronar\u00ebve t\u00eb k\u00ebtyre banesave pa u kompesuar me vler\u00ebn e tregut prona e tij. N\u00eb rastin konkret t\u00eb k\u00ebtij projekt vendimi n\u00eb asnj\u00eb hallk\u00eb t\u00eb procesit nuk \u00ebsht\u00eb p\u00ebrfshir\u00eb pronari si pjes\u00eb e k\u00ebtij procesi.<br \/>\n\u200bSa i p\u00ebrket problematik\u00ebs ligjore mund t\u00eb them se ky projekt vendim nuk rezulton t\u00eb jet\u00eb i mb\u00ebshtetur n\u00eb ndonj\u00eb dispozit\u00eb konkrete t\u00eb ndonj\u00eb ligji specifik q\u00eb parashikon procedur\u00ebn e auditimin t\u00eb banesave apo qoft\u00eb t\u00eb jet\u00eb i mb\u00ebshtetur te ligji p\u00ebr shpron\u00ebsimet p\u00ebr interes publik. As vet\u00eb ky projekt vendim kur citon dispozitat ligjore n\u00eb t\u00eb cilat mb\u00ebshtetet konkretisht ligji \u201cP\u00ebr kontrollin dhe disiplinimin e punimeve t\u00eb nd\u00ebrtimit\u201d nuk rezulton q\u00eb ky ligj t\u00eb ket\u00eb parashikuar nj\u00eb proces i till\u00eb.<br \/>\nPo ashtu projekt vendimi nuk specifikon se \u00e7far\u00eb do t\u00eb ndodh\u00eb me truallin e godin\u00ebs dhe pronar\u00ebt e tyre. P\u00ebr shembull \u201ctrualli\u201d \u00ebsht\u00eb privatizuar me ligj para 20 vjet\u00ebsh. Pronar\u00ebt e apartamenteve jan\u00eb bashk\u00ebpronar\u00eb t\u00eb truallit n\u00eb referim t\u00eb ligjit nr. 7652, dat\u00eb 23.12.1992 \u201cP\u00ebr privatizimin e banesave shtet\u00ebrore\u201d, Neni 10 \u201cTrualli q\u00eb z\u00eb nd\u00ebrtesa e banimit vler\u00ebsohet si z\u00eb i ve\u00e7ant\u00eb dhe kalon n\u00eb bashk\u00ebpron\u00ebsi t\u00eb pronar\u00ebve t\u00eb banes\u00ebs.\u201d Pra, p\u00ebr nj\u00eb moment shteti me funksionar\u00ebt e tij t\u00eb p\u00ebrcaktuar n\u00eb projekt vendim p\u00ebrcakon se nd\u00ebrtesa duhet shembur p\u00ebr shkak t\u00eb degradimit, pyetja q\u00eb lind \u00ebsht\u00eb po \u201ctruallin\u201d me cfar\u00eb akti do tja marr\u00eb shteti pronar\u00ebve? Sepse trualli nuk degradohet n\u00eb koh\u00eb dhe si do t\u00eb kryhet procesi rind\u00ebrtimit pa p\u00eblqimin e pronar\u00ebve? Apo shteti do t\u00eb prish\u00eb banesat e pronar\u00ebve n\u00eb kuad\u00ebr t\u00eb \u201cinteresit publik\u201d dhe do t\u2019i braktis\u00eb k\u00ebta t\u00eb fundit n\u00eb rrug\u00eb t\u00eb hapur? Sepse marrja e truallit n\u00eb pron\u00ebsi t\u00eb shtetit kundrejt pronar\u00ebve t\u00eb truallit p\u00ebr tja dh\u00ebn\u00eb m\u00eb pas nj\u00eb t\u00eb treti p\u00ebr t\u00eb nd\u00ebrtuar, nuk \u00ebsht\u00eb gj\u00eb tjet\u00ebr thjesht\u00eb: \u201cgrabitje e pron\u00ebs\u201d apo \u201ckooperativizimi kolektiv i banesave\u201d.<br \/>\nShqet\u00ebsuese n\u00eb k\u00ebt\u00eb projekt vendim \u00ebsht\u00eb q\u00eb akt-ekspertiza e thelluar do t\u00eb kryhet nga nj\u00eb institucion shtet\u00ebror pra vet\u00eb shteti, vet\u00eb ai q\u00eb po i merr pron\u00ebn pronar\u00ebve po ky n\u00eb kuad\u00ebr t\u00eb \u201cinteresit publik\u201d e q\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb nuk i lejon pronar\u00ebt t\u00eb kryejn\u00eb vet\u00eb privatisht k\u00ebt\u00eb proces apo t\u00eb monitorojn\u00eb procesin. Nd\u00ebrkoh\u00eb vet\u00eb \u201cInstituti Nd\u00ebrtimit\u201d \u00ebsht\u00eb n\u00eb konflikt t\u00eb hapur me qytetarin sepse \u00ebsht\u00eb i varur t\u00ebr\u00ebsisht nga shteti sepse \u00ebsht\u00eb n\u00eb funksion t\u00eb shtetit si edhe nuk ka as kapacitetet e duhura teknike. Rasti i i t\u00ebrmetit n\u00eb Turqi e tregon qart\u00eb q\u00eb vet\u00ebm nj\u00eb institucion shtet\u00ebror nuk mund ta kontrolloj\u00eb procesin e auditimit t\u00eb banesave pasi \u201cabuzohet\u201d n\u00ebn presionin e shtetit.<br \/>\nN\u00eb asnj\u00eb pik\u00eb t\u00eb k\u00ebtij projekt vendimi pronari jo vet\u00ebm q\u00eb nuk \u00ebsht\u00eb pjes\u00eb e procesit por nuk i jepet as mund\u00ebsia m\u00eb e vog\u00ebl p\u00ebr t\u00eb kund\u00ebrshtuar gjyq\u00ebsisht aktet e \u201cInstitutit t\u00eb Nd\u00ebrtimit\u201d n\u00eb lidhje me auditimin apo cdo akt tjet\u00ebr q\u00eb ka lidhje dhe c\u00ebnon pron\u00ebsin\u00eb e tyre. E kjo \u00ebsht\u00eb nj\u00eb tjet\u00ebr shkelje flagrante e kushtetut\u00ebs dhe ligjit p\u00ebr shkak se pronar\u00ebve e drejta e pron\u00ebs q\u00eb i \u00ebsht\u00eb njohur me kushtetut\u00eb dhe me ligj nuk mund t\u2019i c\u00ebnohet pa nj\u00eb proces t\u00eb rregullt ligjor.<br \/>\nKy projekt vendim \u00ebsht\u00eb shqet\u00ebsues duke marr\u00eb n\u00eb konsiderat\u00eb se gjat\u00eb k\u00ebtyre viteve 1999 e deri m\u00eb sot sistematikisht shteti shqiptar n\u00eb kuad\u00ebr t\u00eb \u201cshpron\u00ebsimeve p\u00ebr interes publik\u201d ka p\u00ebrvet\u00ebsuar pronat e pronar\u00ebve dhe nuk i ka d\u00ebmshp\u00ebrblyer me vler\u00ebn e tregut. Por ajo q\u00eb \u00ebsht\u00eb m\u00eb e r\u00ebnda akoma \u00ebsht\u00eb se p\u00ebrvec se shteti i ka p\u00ebrvet\u00ebsuar pron\u00ebn pronarit duke e zhveshur si pronar p\u00ebr shkak t\u00eb shpron\u00ebsimit p\u00ebr interes publik p\u00ebr t\u00eb b\u00ebr\u00eb nj\u00eb lulishte, nj\u00eb trotuar apo nj\u00eb kop\u00ebsht, shkoll\u00eb, rrug\u00eb etj shteti shqiptar i ka nxjerr\u00eb nga sht\u00ebpit\u00eb e tyre pronar\u00ebt, i ka shembur banesat duke i nxjerr\u00eb n\u00eb rrug\u00eb t\u00eb madhe dhe nuk i ka dh\u00ebn\u00eb as shp\u00ebrblimin, kompesimin ndaj shpron\u00ebsimit. Madja ka shum\u00eb pronar\u00eb q\u00eb kan\u00eb fituar gjyqet me shtetin Shqiptar deri n\u00eb Gjykat\u00ebn Evropiane t\u00eb Drejtave t\u00eb Njeriut n\u00eb Strasburg dhe s\u00ebrish shteti Shqiptar refuzon t\u00eb ekzekutoj\u00eb k\u00ebto vendime e t\u00eb kompesoj\u00eb pronar\u00ebt.<br \/>\nN\u00eb rastin konkret, ky projekt vendim pavar\u00ebsisht sesi \u00ebsht\u00eb shkruar apo sesi do t\u00eb shkruhet apo korrigjohet n\u00ebse gjithmon\u00eb do t\u00eb ket\u00eb reflektim \u00ebsht\u00eb nj\u00eb projekt vendim q\u00eb me fjal\u00eb t\u00eb thjeshta do t\u00eb shpron\u00ebsoj\u00eb shum\u00eb pronar\u00eb si n\u00eb vitet 1946 n\u00eb kuad\u00ebr t\u00eb \u201creformave\u201d dhe \u201cdashuris\u00eb e kujdesit t\u00eb shtetit p\u00ebr pronar\u00ebt\u201d, t\u00eb cil\u00ebve pasi do t\u2019ja marr\u00eb pron\u00ebn me shkakun se \u00ebsht\u00eb e degraduar, do t\u2019i nxjerr\u00eb n\u00eb rrug\u00eb t\u00eb madhe dhe qytetar\u00ebt n\u00eb rastin m\u00eb t\u00eb mir\u00eb do t\u00eb sorrollaten dyerve t\u00eb gjykatave p\u00ebr 10-20 vitet e ardhshme p\u00ebr t\u00eb k\u00ebrkuar t\u00eb marrin nj\u00eb vler\u00eb kompesimi q\u00eb nuk do t\u00eb mund t\u00eb blejn\u00eb dot as banes\u00ebn e tyre.<br \/>\n\u00c7far\u00eb duhet t\u00eb parashikoj\u00eb projekt vendimi q\u00eb t\u00eb jet\u00eb brenda kornizave kushtetuese dhe ligjore?<br \/>\n\u2022 Pronari t\u00eb jet\u00eb pjes\u00eb e procesit t\u00eb auditimit dhe t\u2019i jepet e drejta t\u00eb ankimoj\u00eb vendimet e \u201cInsitutit t\u00eb Nd\u00ebrtimit\u201d apo cdo institucioni tjet\u00ebr t\u00eb caktuar nga shteti Shqiptar;<br \/>\n\u2022 Procesi i riparimit apo nd\u00ebrtimit t\u00eb mos filloj\u00eb pa u shprehur gjykatat me vendim t\u00eb form\u00ebs s\u00eb prer\u00eb, pra pa p\u00ebrfunduar nj\u00eb proces i rregullt ligjor;<br \/>\n\u2022 Pronar\u00ebt apo bashk\u00ebpronar\u00ebt q\u00eb jan\u00eb dakort p\u00ebr riparimin apo nd\u00ebrtimin e banesave t\u00eb tyre duhet q\u00eb marr\u00ebveshjet me pal\u00ebt e treta t\u2019i realizojn\u00eb direkt k\u00ebta pa nd\u00ebrmjet\u00ebsimin e shtetit;<br \/>\n\u2022 N\u00ebse shteti vendos t\u00eb riparoj\u00eb apo nd\u00ebrtoj\u00eb banesat e degraduara duhet q\u00eb minimalisht t\u2019i riparoj\u00eb\/nd\u00ebrtoj\u00eb nj\u00eb banes\u00eb t\u00eb nj\u00ebjt\u00eb n\u00eb sip\u00ebrfaqe pronar\u00ebve dhe p\u00ebr cdo kat mbi katet q\u00eb jan\u00eb banesat n\u00eb proces auditimi t\u00eb jen\u00eb pronar\u00ebt ata q\u00eb hyjn\u00eb n\u00eb marr\u00ebveshje me pal\u00ebt e treta apo shteti tja shp\u00ebrndaj\u00eb pronar\u00ebve cdo sip\u00ebrfaqe m\u00eb shum\u00eb q\u00eb nd\u00ebrtohet n\u00eb p\u00ebrpjes\u00ebtim me pron\u00ebsin\u00eb e secilit e pronar.<br \/>\nTre problematika q\u00eb fshihen te projekt vendimi i auditimit t\u00eb banesave:<br \/>\n\u200b1- Kur p\u00ebrmendet se procesi i auditimit t\u00eb banesave \u00ebsht\u00eb realizuar dhe realizohet n\u00eb gjith\u00eb europ\u00ebn, a mundet shteti t\u00eb paraqes\u00eb, prezantoj\u00eb gjith\u00eb legjislacionin dhe praktikat europiane?
