{"id":410213,"date":"2024-12-10T13:29:11","date_gmt":"2024-12-10T12:29:11","guid":{"rendered":"https:\/\/zjarr.tv\/?p=410213"},"modified":"2024-12-10T13:29:11","modified_gmt":"2024-12-10T12:29:11","slug":"zbardhet-opinioni-i-venecias-per-mandatin-e-olta-xhackes-deputetet-nuk-mund-te-detyrohen-si-duhet-te-votojne","status":"publish","type":"post","link":"https:\/\/zjarr.tv\/sq\/zbardhet-opinioni-i-venecias-per-mandatin-e-olta-xhackes-deputetet-nuk-mund-te-detyrohen-si-duhet-te-votojne\/","title":{"rendered":"Zbardhet opinioni i Venecias p\u00ebr mandatin e Olta Xha\u00e7k\u00ebs: Deputet\u00ebt nuk mund t\u00eb detyrohen si duhet t\u00eb votojn\u00eb"},"content":{"rendered":"<p>Komisioni i Venacias ka b\u00ebr\u00eb publik opinionin n\u00eb lidhje me mandatin e Olta Xha\u00e7k\u00ebs.<\/p>\n<p>Sipas Venecias, deputet\u00ebt e Kuvendit jan\u00eb t\u00eb lir\u00eb dhe nuk mund t\u00eb detyrohen p\u00ebr m\u00ebnyr\u00ebn se si duhet t\u00eb votojn\u00eb.<\/p>\n<p>\u201cParlamenti nuk detyrohet t\u00eb votoj\u00eb n\u00eb nj\u00eb m\u00ebnyr\u00eb t\u00eb caktuar, por \u00ebsht\u00eb i kufizuar t\u00eb votoj\u00eb vet\u00ebm p\u00ebr \u00e7\u00ebshtjet q\u00eb hyjn\u00eb n\u00eb kompetenc\u00ebn e tij\u201d, thuhet nd\u00ebr t\u00eb tjera n\u00eb mendimin e Venecias.<\/p>\n<p>Konkluzionet e Komisionit t\u00eb Venecias:<\/p>\n<p>Komisioni i Venecias \u00ebsht\u00eb ftuar nga Kryetari i Kuvendit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb q\u00eb t\u00eb jap\u00eb opinionin e tij \u201cmbi marr\u00ebdh\u00ebnien midis demokracis\u00eb p\u00ebrfaq\u00ebsuese parlamentare dhe vendimeve detyruese t\u00eb Gjykat\u00ebs Kushtetuese n\u00eb kontekstin e rolit t\u00eb Kuvendit n\u00eb shqyrtimin e mocioneve mbi papajtueshm\u00ebrin\u00eb me mandatin e nj\u00eb deputeti\u201d, duke trajtuar k\u00ebshtu zbatimin e vendimeve t\u00eb Gjykat\u00ebs Kushtetuese nga Parlamenti.<\/p>\n<p>Ky Opinion nuk synon t\u00eb mbaj\u00eb q\u00ebndrim n\u00eb lidhje me vendime specifike t\u00eb Gjykat\u00ebs Kushtetuese, dhe as nuk \u00ebsht\u00eb kompetenc\u00eb e Komisionit t\u00eb interpretoj\u00eb Kushtetut\u00ebn e Shqip\u00ebris\u00eb<\/p>\n<p>Koncepti i papajtueshm\u00ebris\u00eb kuptohet si nj\u00eb penges\u00eb p\u00ebr nj\u00eb deputet q\u00eb t\u00eb ushtroj\u00eb mandatin e tij ose t\u00eb saj p\u00ebr shkak t\u00eb mbajtjes s\u00eb nj\u00eb pozicioni (privat ose publik) i cili konsiderohet i papajtuesh\u00ebm dhe n\u00eb konflikt me detyr\u00ebn e deputetit. Ai p\u00ebrqendrohet te arsyet p\u00ebr t\u00ebrheqjen e mandatit n\u00ebp\u00ebrmjet zbatimit t\u00eb ndalimit p\u00ebr t\u00eb mbajtur nj\u00eb post t\u00eb papajtuesh\u00ebm. Nj\u00eb nga k\u00ebto arsye mund t\u00eb jet\u00eb konflikti i interesit nd\u00ebrmjet funksioneve.<\/p>\n<p>Pyetjet n\u00eb lidhje me mandatin e nj\u00eb deputeti (pyetjet 1 dhe 3) kuptohen si m\u00eb posht\u00eb:<\/p>\n<p>&#8220;\u00c7far\u00eb standardesh rregullojn\u00eb mandatin e nj\u00eb deputeti n\u00eb nj\u00eb demokraci parlamentare p\u00ebrfaq\u00ebsuese dhe n\u00eb \u00e7far\u00eb rrethanash mund t\u00eb detyrohet nj\u00eb deputet t\u00eb votoj\u00eb n\u00eb nj\u00eb m\u00ebnyr\u00eb t\u00eb caktuar?&#8221; Nga kjo mund t\u00eb p\u00ebrfundohet: Respektimi nga t\u00eb gjitha autoritetet i vendimeve t\u00eb Gjykat\u00ebs Kushtetuese bazohet n\u00eb parimin e besnik\u00ebris\u00eb kushtetuese si nj\u00eb element i shtetit t\u00eb s\u00eb drejt\u00ebs. Ky respektim nuk duhet t\u00eb kusht\u00ebzohet nga vota e nj\u00eb shumice parlamentare, por p\u00ebrb\u00ebn nj\u00eb k\u00ebrkes\u00eb thelb\u00ebsore t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs. Kur nj\u00eb vendim i Gjykat\u00ebs Kushtetuese interpreton Kushtetut\u00ebn si kufizim t\u00eb pushtetit vendimmarr\u00ebs t\u00eb Parlamentit, ky i fundit duhet t\u00eb miratoj\u00eb nj\u00eb vendim t\u00eb p\u00ebrputhur me gjykimin e Gjykat\u00ebs dhe t\u00eb votoj\u00eb vet\u00ebm p\u00ebr \u00e7\u00ebshtjet e kufizuara si\u00e7 p\u00ebrcaktohen nga Gjykata Kushtetuese, dhe jo edhe p\u00ebr mund\u00ebsin\u00eb e referimit t\u00eb \u00e7\u00ebshtjes n\u00eb Gjykat\u00eb. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, Parlamenti nuk detyrohet t\u00eb votoj\u00eb n\u00eb nj\u00eb m\u00ebnyr\u00eb t\u00eb caktuar, por \u00ebsht\u00eb i kufizuar t\u00eb votoj\u00eb vet\u00ebm p\u00ebr \u00e7\u00ebshtjet q\u00eb hyjn\u00eb n\u00eb kompetenc\u00ebn e tij.<\/p>\n<p>Sa i p\u00ebrket pyetjeve mbi standardet p\u00ebr dispozitat e papajtueshm\u00ebris\u00eb dhe rolin e organeve legjislative dhe gjyq\u00ebsore (pyetjet 2 dhe 4, pjesa e par\u00eb), mund t\u00eb p\u00ebrfundohet si m\u00eb posht\u00eb:<\/p>\n<p>N\u00eb p\u00ebrgjith\u00ebsi, parimi i ndarjes s\u00eb pushteteve shtet\u00ebrore imponon q\u00eb disa pozicione nuk mund t\u00eb mbahen nga i nj\u00ebjti person n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, duke garantuar k\u00ebshtu integritetin dhe funksionimin e duhur t\u00eb secilit pushtet (legjislativ, ekzekutiv ose gjyq\u00ebsor). N\u00eb disa raste, standardet nd\u00ebrkomb\u00ebtare parashikojn\u00eb nj\u00eb papajtueshm\u00ebri absolute (p.sh., t\u00eb qenit deputet dhe nj\u00ebkoh\u00ebsisht gjyqtar). N\u00eb raste t\u00eb tjera, lejohen p\u00ebrjashtime (p.sh., nj\u00eb deputet q\u00eb \u00ebsht\u00eb pjes\u00eb e qeveris\u00eb). Normalisht, kur nj\u00eb person gjendet duke mbajtur dy funksione q\u00eb jan\u00eb t\u00eb papajtueshme me nj\u00ebri-tjetrin, situata mund t\u00eb rregullohet nga vet\u00eb personi \u2013 zakonisht duke zgjedhur nj\u00ebrin nga pozicionet dhe duke hequr dor\u00eb nga tjetri. Megjithat\u00eb, n\u00eb rastet kur situata nuk rregullohet, pasoja e zakonshme \u00ebsht\u00eb q\u00eb personi n\u00eb fjal\u00eb humbet mandatin e tij ose t\u00eb saj. Sa i p\u00ebrket procedur\u00ebs p\u00ebr vendosjen e papajtueshm\u00ebris\u00eb, nuk ka standarde t\u00eb qarta.<\/p>\n<p>N\u00eb lidhje me praktik\u00ebn shtet\u00ebrore mbi dispozitat e papajtueshm\u00ebris\u00eb dhe rolin e organeve legjislative dhe gjyq\u00ebsore (pyetjet 2 dhe 4, pjesa 2), Komisioni i Venecias ka mbledhur informacion mbi dispozitat kushtetuese t\u00eb papajtueshm\u00ebris\u00eb n\u00eb 12 shtete an\u00ebtare dhe Bashkimin Evropian (BE).<\/p>\n<p>Gjetjet e analiz\u00ebs tregojn\u00eb se nuk ka nj\u00eb qasje t\u00eb nj\u00ebtrajtshme p\u00ebr \u00e7\u00ebshtjet e papajtueshm\u00ebris\u00eb dhe praktikat e shteteve ndryshojn\u00eb n\u00eb var\u00ebsi t\u00eb faktor\u00ebve t\u00eb ndrysh\u00ebm, si struktura e qeverisjes, numri i dhomave dhe parametra t\u00eb tjer\u00eb specifik\u00eb p\u00ebr secilin vend. Pyetjet e Kryetarit t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb mbi praktik\u00ebn shtet\u00ebrore mund t\u00eb trajtohen, me kujdes, si m\u00eb posht\u00eb:<\/p>\n<p>Bazuar n\u00eb materialin e shqyrtuar nga Komisioni i Venecias p\u00ebr k\u00ebt\u00eb Opinion, p\u00ebrcaktimi i papajtueshm\u00ebris\u00eb me mandatin e nj\u00eb deputeti \u2013 n\u00eb nivel kushtetues \u2013 n\u00eb shumic\u00ebn e rasteve bazohet n\u00eb pozicionet e tjera q\u00eb deputeti mban. N\u00eb disa vende, aktivitetet e deputetit (si ato me q\u00ebllim fitimi) mund t\u00eb konsiderohen t\u00eb papajtueshme me detyr\u00ebn e tij si deputet (edhe pse kjo nuk rregullohet gjithmon\u00eb n\u00eb nivel kushtetues). N\u00eb shumic\u00ebn e shteteve, subjektet q\u00eb kan\u00eb t\u00eb drejt\u00ebn t\u00eb referojn\u00eb nj\u00eb \u00e7\u00ebshtje n\u00eb nj\u00eb organ gjyq\u00ebsor jan\u00eb organe politike ose persona q\u00eb jan\u00eb pjes\u00eb e nj\u00eb organi politik; dhe n\u00eb shumic\u00ebn e rasteve shqyrtimi b\u00ebhet nga nj\u00eb Gjykat\u00eb Kushtetuese ose nj\u00eb gjykat\u00eb e zakonshme. Vet\u00ebm n\u00eb disa vende \u00e7\u00ebshtja e papajtueshm\u00ebris\u00eb vendoset nga organi legjislativ.<\/p>\n<p>Pyetja mbi Gjykat\u00ebn Kushtetuese dhe krijimin e normave t\u00eb reja kushtetuese (pyetja 5) kuptohet si m\u00eb posht\u00eb:<\/p>\n<p>N\u00eb parim, a mund t\u00eb krijoj\u00eb nj\u00eb Gjykat\u00eb Kushtetuese norma t\u00eb reja? Mund t\u00eb konkludohet se pushteti p\u00ebr t\u00eb krijuar norma t\u00eb reja kushtetuese i p\u00ebrket pushtetit legjislativ, nd\u00ebrsa pushteti p\u00ebr t\u00eb interpretuar n\u00eb m\u00ebnyr\u00eb autoritative nj\u00eb norm\u00eb kushtetuese ekzistuese i p\u00ebrket Gjykat\u00ebs Kushtetuese, e cila merr parasysh parime t\u00eb p\u00ebrgjithshme kushtetuese, si qasja n\u00eb drejt\u00ebsi, kur interpreton dispozita specifike kushtetuese.
