{"id":428928,"date":"2026-05-27T12:53:53","date_gmt":"2026-05-27T10:53:53","guid":{"rendered":"https:\/\/zjarr.tv\/?p=428928"},"modified":"2026-05-27T12:53:58","modified_gmt":"2026-05-27T10:53:58","slug":"begaj-mori-pjese-ne-ritualin-e-haxhit-ne-meke-luan-rama-provokim-kushtetues","status":"publish","type":"post","link":"https:\/\/zjarr.tv\/sq\/begaj-mori-pjese-ne-ritualin-e-haxhit-ne-meke-luan-rama-provokim-kushtetues\/","title":{"rendered":"Begaj mori pjes\u00eb n\u00eb ritualin e Haxhit n\u00eb Mek\u00eb, Luan Rama: Provokim Kushtetues"},"content":{"rendered":"\n<p>Ish-ministri dhe ish-deputeti i LSI-s\u00eb Luan Rama n\u00eb nj\u00eb postim t\u00eb gjat\u00eb n\u00eb Facebook, ka shp\u00ebrthyer n\u00eb kritika ndaj Presidentit t\u00eb Republik\u00ebs Bajram Begaj, pasi ky i fundit mori pjes\u00eb n\u00eb nj\u00eb ritual fetar n\u00eb Haxhi t\u00eb Arabis\u00eb Saudite.<\/p>\n\n\n\n<p>Rama shkruan se shfaqja e Begajt n\u00eb k\u00ebt\u00eb ritual feta \u00ebsht\u00eb provokim Kushtetues, pasi sipas tij, ka c\u00ebnuar hapur laicitetin dhe m\u00ebnyr\u00ebn e p\u00ebrfaq\u00ebsimit t\u00eb shtetit nga Presidenti i tij.<\/p>\n\n\n\n<p>M\u00eb tej ish-ministri shkruan se problemi i k\u00ebsaj vizite, lidhet me faktin q\u00eb besimi shfaqet p\u00ebrmes Kryetarit t\u00eb Shtetit dhe fillon t\u00eb lexohet si shenj\u00eb e shtetit.<\/p>\n\n\n\n<p><strong>Postimi i plot\u00eb i Luan Ram\u00ebs:<\/strong><\/p>\n\n\n\n<p><strong>Analiz\u00eb:<\/strong><\/p>\n\n\n\n<p>KUR PRESIDENTI I REPUBLIK\u00cbS<\/p>\n\n\n\n<p>B\u00cbHET HAXHI<\/p>\n\n\n\n<p>Shfaqja publike e Presidentit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb n\u00eb Haxh, brenda nj\u00eb rituali fetar t\u00eb strukturuar dhe me ngarkes\u00eb t\u00eb plot\u00eb fetare, p\u00ebrb\u00ebn nj\u00eb provokim kushtetues n\u00eb kuptimin m\u00eb t\u00eb thell\u00eb t\u00eb fjal\u00ebs, pasi shfaqet si c\u00ebnim i hapur i parimit t\u00eb laicitetit dhe m\u00ebnyr\u00ebs s\u00eb p\u00ebrfaq\u00ebsimit simbolik t\u00eb shtetit prej Kryetarit t\u00eb Shtetit.<\/p>\n\n\n\n<p>N\u00eb nj\u00eb republik\u00eb kushtetuese, Presidenti nuk \u00ebsht\u00eb individ privat q\u00eb q\u00ebndron paralel me funksionin e tij institucional.<\/p>\n\n\n\n<p>Ai \u00ebsht\u00eb figura q\u00eb mish\u00ebron unitetin e popullit dhe unitaritetin e shtetit p\u00ebrtej dallimeve politike, shoq\u00ebrore dhe fetare.<\/p>\n\n\n\n<p>Pik\u00ebrisht p\u00ebr k\u00ebt\u00eb arsye, ai nuk p\u00ebrfaq\u00ebson vet\u00ebm veten, por nj\u00eb hap\u00ebsir\u00eb t\u00eb p\u00ebrbashk\u00ebt ku asnj\u00eb qytetar nuk duhet t\u00eb ndihet i p\u00ebrjashtuar p\u00ebr shkak t\u00eb bindjeve t\u00eb tij.<\/p>\n\n\n\n<p>Laiciteti i shtetit, i sanksionuar n\u00eb Kushtetut\u00eb, nuk \u00ebsht\u00eb nj\u00eb formul\u00eb neutrale deklarative, por nj\u00eb parim strukturor q\u00eb organizon marr\u00ebdh\u00ebnien midis pushtetit publik dhe fes\u00eb. Ai nuk k\u00ebrkon vet\u00ebm mosnd\u00ebrhyrje t\u00eb fes\u00eb n\u00eb shtet, por edhe mosidentifikim t\u00eb shtetit me asnj\u00eb form\u00eb fetare n\u00eb hap\u00ebsir\u00ebn e p\u00ebrfaq\u00ebsimit t\u00eb tij. N\u00eb k\u00ebt\u00eb kuptim, neni 10 i Kushtetut\u00ebs dhe neni 86 i saj, q\u00eb e p\u00ebrcakton Presidentin si p\u00ebrfaq\u00ebsues t\u00eb unitetit t\u00eb popullit, funksionojn\u00eb si pjes\u00eb t\u00eb nj\u00eb t\u00ebr\u00ebsie t\u00eb vetme normative: garantimit t\u00eb neutralitetit simbolik t\u00eb shtetit.<\/p>\n\n\n\n<p>Haxhi nuk \u00ebsht\u00eb nj\u00eb ngjarje neutrale kulturore, por nj\u00eb ritual i strukturuar fetar i Islamit, nj\u00eb nga pes\u00eb shtyllat e tij, ku p\u00ebrmes riteve t\u00eb standardizuara n\u00eb Mek\u00eb shprehet devocioni dhe barazia e besimtar\u00ebve p\u00ebrpara Zotit.<\/p>\n\n\n\n<p>\u00cbsht\u00eb nj\u00eb akt me densitet t\u00eb lart\u00eb fetar, ku forma dhe kuptimi nuk mund t\u00eb ndahen pa e zbrazur vet\u00eb p\u00ebrmbajtjen e tij.<\/p>\n\n\n\n<p>Pyetja kushtetuese lind pik\u00ebrisht n\u00eb k\u00ebt\u00eb pik\u00eb: \u00e7far\u00eb ndodh kur figura e Kryetarit t\u00eb Shtetit q\u00eb p\u00ebrfaq\u00ebson shtetin laik jo vet\u00ebm shfaqet, por edhe b\u00ebhet bart\u00ebs i besimit brenda nj\u00eb hap\u00ebsire t\u00eb till\u00eb simbolike fetare?<\/p>\n\n\n\n<p>N\u00eb t\u00eb drejt\u00ebn kushtetuese moderne, ve\u00e7an\u00ebrisht n\u00eb traditat q\u00eb i kushtojn\u00eb r\u00ebnd\u00ebsi neutralitetit shtet\u00ebror, nuk \u00ebsht\u00eb vet\u00ebm q\u00ebllimi subjektiv i aktit ai q\u00eb ka r\u00ebnd\u00ebsi, por edhe efekti i tij objektiv n\u00eb hap\u00ebsir\u00ebn publike.<\/p>\n\n\n\n<p>Presidenti nuk \u00ebsht\u00eb thjesht individ biologjik, por trup institucional i ekspozuar, ku \u00e7do gjest, prani dhe shfaqje prodhon kuptim shtet\u00ebror.<\/p>\n\n\n\n<p>K\u00ebtu lind edhe provokim kushtetues, i cili nuk \u00ebsht\u00eb nj\u00eb kategori juridike e mbyllur, por m\u00ebnyr\u00eb analitike p\u00ebr t\u00eb p\u00ebrshkruar momentin kur Kushtetuta nuk respektohet.<\/p>\n\n\n\n<p>Sepse Kushtetuta nuk \u00ebsht\u00eb vet\u00ebm tekst normativ; ajo \u00ebsht\u00eb edhe rend simbolik. Dhe ky rend k\u00ebrkon q\u00eb pushteti publik t\u00eb mos prodhoj\u00eb identifikim fetar n\u00eb asnj\u00eb form\u00eb t\u00eb dukshme p\u00ebrfaq\u00ebsimi. Kur ky kufi b\u00ebhet i paqart\u00eb, edhe pa nj\u00eb akt t\u00eb shprehur juridik t\u00eb ndaluar, at\u00ebher\u00eb nuk kemi thjesht debat interpretimi, por nj\u00eb zhvendosje t\u00eb ngadalt\u00eb t\u00eb kuptimit t\u00eb vet\u00eb neutralitetit.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kuptim, problemi nuk \u00ebsht\u00eb besimi i Presidentit, as e drejta e tij p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb nj\u00eb ritual fetar si qytetar.<\/p>\n\n\n\n<p>Problemi \u00ebsht\u00eb kur ky besim shfaqet p\u00ebrmes Kryetarit t\u00eb Shtetit dhe fillon t\u00eb lexohet si shenj\u00eb e shtetit. Sepse n\u00eb at\u00eb moment, shteti b\u00ebhet i diskutuesh\u00ebm n\u00eb simbolik\u00ebn e tij. Nga ky moment, \u00e7\u00ebshtja nuk mbetet e izoluar.<\/p>\n\n\n\n<p>N\u00ebse sot normalizohet kjo form\u00eb e shfaqjes simbolike fetare n\u00eb figur\u00ebn e Presidentit te Republik\u00ebs, at\u00ebher\u00eb nuk kemi t\u00eb b\u00ebjme me nj\u00eb rast, por krijojm\u00eb precedent. Dhe n\u00eb logjik\u00ebn e shtetit kushtetues, precedenti nuk \u00ebsht\u00eb thjesht p\u00ebrs\u00ebritje, por transformim i standardit t\u00eb norm\u00eb.<\/p>\n\n\n\n<p>N\u00ebse ky kufi relativizohet p\u00ebr nj\u00eb form\u00eb t\u00eb caktuar besimi, at\u00ebher\u00eb hapet shtegu q\u00eb n\u00eb t\u00eb ardhmen t\u00eb kemi shfaqje t\u00eb ngjashme simbolike edhe n\u00eb raport me forma t\u00eb tjera besimi. K\u00ebsisoj, nj\u00eb President mund t\u00eb perceptohet si i mang\u00ebt n\u00eb p\u00ebrfaq\u00ebsim n\u00ebse nuk shfaqet simbolikisht af\u00ebr nj\u00eb tradite t\u00eb caktuar fetare, ose mund t\u00eb gjendet n\u00ebn presion p\u00ebr t\u00eb prodhuar ekuilibra t\u00eb dukshm\u00ebris\u00eb fetare p\u00ebr hir t\u00eb nj\u00eb neutraliteti t\u00eb keqkuptuar si simetri simbolike.<\/p>\n\n\n\n<p>N\u00eb nj\u00eb zhvillim t\u00eb till\u00eb, neutraliteti shtet\u00ebror humbet p\u00ebrmbajtje. Ai pushon s\u00eb qeni p\u00ebrjashtim i identifikimit fetar dhe fillon t\u00eb b\u00ebhet administrim i tij. Shteti nuk q\u00ebndron m\u00eb jasht\u00eb simbolik\u00ebs fetare, por fillon ta menaxhoj\u00eb at\u00eb p\u00ebrmes figur\u00ebs s\u00eb vet m\u00eb t\u00eb lart\u00eb, Presidentit t\u00eb Republik\u00ebs.
