Presidenti Meta ka dekretuar kthimin p\u00ebr shqyrtim t\u00eb dekretit. Sipas Presidentit, ligji shkel parimet e barazis\u00eb dhe nuk \u00ebsht\u00eb n\u00eb harmoni me parimet kushtetuese.<\/p>\n<p>Ligji c\u00ebnon parimet e Konvent\u00ebs evropiane t\u00eb trash\u00ebgimis\u00eb kulturore, thuhet mes t\u00eb tjerave n\u00eb njoftim.<\/p>\n<p>Presidenti Meta ka renditur 9 pika sipas t\u00eb cilave, projektligji p\u00ebr teatrin duhet rishqyrtuar n\u00eb parlament. Presidenti ka ngritur si shqet\u00ebsim edhe munges\u00ebn e Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Njoftimi i plot\u00eb i Presidenc\u00ebs:<\/p>\n<p>N\u00eb respekt t\u00eb ushtrimit t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1 t\u00eb nenit 85 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, si dhe n\u00eb funksion t\u00eb transparenc\u00ebs dhe informimit t\u00eb opinionit publik, Presidenti i Republik\u00ebs b\u00ebn me dije se sot m\u00eb dat\u00eb 27 korrik 2018, ka dekretuar kthimin p\u00ebr rishqyrtim n\u00eb Kuvend t\u00eb ligjit nr. 37\/2018 P\u00ebr p\u00ebrcaktimin e procedur\u00ebs s\u00eb ve\u00e7ant\u00eb p\u00ebr negocimin dhe lidhjen e kontrat\u00ebs me objekt: Projektimi dhe realizimi i projektit urban dhe godin\u00ebs s\u00eb re t\u00eb Teatrit Komb\u00ebtar\u201d, mb\u00ebshtetur n\u00eb argumentet e m\u00eb poshtme:<\/p>\n<p>1. S\u00eb pari, ky ligj shkel parimet e \u201cbarazis\u00eb p\u00ebrpara ligjit\u201d dhe \u201cliris\u00eb s\u00eb veprimtaris\u00eb ekonomike t\u00eb shtetasve\u201d, parime k\u00ebto t\u00eb cilat g\u00ebzojn\u00eb nj\u00eb mbrojtje t\u00eb ve\u00e7ant\u00eb nga Kushtetuta.<\/p>\n<p>2. S\u00eb dyti, ligji nr. 37\/2018 nuk \u00ebsht\u00eb n\u00eb harmoni me parimet themelore kushtetuese t\u00eb identitetit komb\u00ebtar dhe trash\u00ebgimis\u00eb komb\u00ebtare mbi t\u00eb cilat qytetar\u00ebt e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb kan\u00eb vendosur t\u00eb ngren\u00eb dhe zhvillojn\u00eb shtetin e tyre.<\/p>\n<p>3. S\u00eb treti, ligji nr. 37\/2018 bie ndesh me parimet e Konvent\u00ebs Evropiane t\u00eb Trash\u00ebgimis\u00eb Kulturore Jomateriale, miratuar n\u00eb Paris n\u00eb vitin 2003, duke b\u00ebr\u00eb k\u00ebshtu q\u00eb veprimtaria legjislative t\u00eb bjer\u00eb ndesh edhe me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare t\u00eb detyrueshme p\u00ebr zbatim.<\/p>\n<p>4. S\u00eb kat\u00ebrti, ligji nr.37\/2018 cenon r\u00ebnd\u00eb parimet kushtetuese t\u00eb nd\u00ebrtimit dhe funksionimit t\u00eb organeve t\u00eb pushtetit vendor t\u00eb \u201cdecentralizimit\u201d dhe \u201cautonomis\u00eb vendore\u201d, duke r\u00ebn\u00eb ndesh, nj\u00ebkoh\u00ebsisht edhe me parimin e ndarjes dhe balancimit t\u00eb pushteteve.<\/p>\n<p>5. S\u00eb pesti, ligji nr. 37\/2018 vjen n\u00eb kund\u00ebrshtim me standardet dhe vlerat e Bashkimit Evropian dhe parashikimet e Marr\u00ebveshjes s\u00eb Stabilizim-Asociimit (MSA), plot\u00ebsimi i t\u00eb cilave \u00ebsht\u00eb detyrim par\u00ebsor p\u00ebr Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n<p>6. S\u00eb gjashti, propozimi i projektligjit, por edhe vet\u00eb ligji i miratuar nr. 37\/2018\u2033>2018 nuk mb\u00ebshtetet n\u00eb nj\u00eb vler\u00ebsim gjith\u00ebp\u00ebrfshir\u00ebs dhe t\u00eb plot\u00eb p\u00ebr tjet\u00ebrsimin e pron\u00ebs publike, krahasuar me p\u00ebrfitimet ekonomike t\u00eb shtetit shqiptar dhe interesin publik.<\/p>\n<p>7. S\u00eb shtati, ky ligj nuk \u00ebsht\u00eb n\u00eb harmoni me parimet dhe standardet e vendosura tashm\u00eb n\u00eb legjislacionin n\u00eb fuqi n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n<p>8. S\u00eb teti, miratimi i ligjit nr.37\/2018 nuk \u00ebsht\u00eb bazuar n\u00eb nj\u00eb verifikim dhe vler\u00ebsim t\u00eb thelluar t\u00eb statusit t\u00eb pasurive t\u00eb paluajtshme q\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb projekt, si dhe dispozitat e k\u00ebtij ligji krijojn\u00eb pasiguri juridike n\u00eb ushtrimin e t\u00eb drejtave pron\u00ebsore qoft\u00eb p\u00ebr pasurin\u00eb publike, por dhe mbi t\u00eb drejtat private t\u00eb pron\u00ebsis\u00eb.<\/p>\n<p>9. S\u00eb fundmi, n\u00eb kushtet aktuale, kur Gjykata Kushtetuese e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb nuk \u00ebsht\u00eb funksionale p\u00ebr t\u00eb verifikuar k\u00ebto konstatime, apo p\u00ebr t\u00eb zgjidhur \u00e7do mosmarr\u00ebveshje kushtetuese q\u00eb mund t\u00eb prodhoj\u00eb hyrja n\u00eb fuqi e k\u00ebsaj norme t\u00eb ve\u00e7ant\u00eb ligjore, ftoj Kuvendin e Shqip\u00ebris\u00eb, t\u00eb rishqyrtoj\u00eb n\u00eb t\u00ebr\u00ebsi ligjin nr.37\/2018 \u201cP\u00ebr p\u00ebrcaktimin e procedur\u00ebs s\u00eb ve\u00e7ant\u00eb p\u00ebr negocimin dhe lidhjen e kontrat\u00ebs me objekt: Projektimi dhe realizimi i projektit urban dhe godin\u00ebs s\u00eb re t\u00eb Teatrit Komb\u00ebtar\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Presidenti Ilir Meta ka kthyer n\u00eb Kuvend ligjin p\u00ebr Teatrin Komb\u00ebtar.
