M\u00eb konkretisht, kreu i shtetit k\u00ebrkon rishqyrtimin e tre neneve t\u00eb k\u00ebtij, p\u00ebrkat\u00ebsisht nenin 61, 65 dhe 76.<\/p>\n<p>Sipas Presidentit, k\u00ebto paqart\u00ebsi krijon mund\u00ebsi t\u00eb intepretimit gjat\u00eb aplikimit n\u00eb praktik\u00eb, gj\u00eb e cila krijon pasiguri juridike jo vet\u00ebm p\u00ebr vet\u00eb noterin, por dhe p\u00ebr pal\u00ebt\/qytetar\u00ebt, t\u00eb cil\u00ebt kan\u00eb zgjedhur t\u00eb marrin sh\u00ebrbimet noteriale tek ai.<\/p>\n<p><strong>Relacioni i i Presidentit p\u00ebr ligjin:<\/strong><\/p>\n<ol>\n<li>P\u00ebrmbajtja e nenit 61 t\u00eb ligjit nr.110\/2018 \u201cP\u00ebr noterin\u00eb\u201d, nuk \u00ebsht\u00eb i qart\u00eb dhe n\u00eb harmoni me disa nene t\u00eb tjera t\u00eb k\u00ebtij ligji. Formulimi i k\u00ebtij neni p\u00ebrve\u00e7 se nuk parashikon procedur\u00ebn se si do t\u00eb zbatohet n\u00eb praktik\u00eb si dhe nuk p\u00ebrmban asnj\u00eb parashikim t\u00eb shprehur q\u00eb t\u2019i jap\u00eb t\u00eb drejt\u00eb Ministrit t\u00eb Drejt\u00ebsis\u00eb q\u00eb n\u00eb bashk\u00ebpunim me Dhom\u00ebn Komb\u00ebtare t\u00eb Noteris\u00eb t\u00eb nxjerrin aktet n\u00ebnligjore me q\u00ebllim parashikimin e gjith\u00eb procedur\u00ebs s\u00eb holl\u00ebsishme p\u00ebr realizimin e k\u00ebtij procesi.<\/li>\n<\/ol>\n<p>Kjo paqart\u00ebsi krijon mund\u00ebsi t\u00eb intepretimit gjat\u00eb aplikimit n\u00eb praktik\u00eb, gj\u00eb e cila krijon pasiguri juridike jo vet\u00ebm p\u00ebr vet\u00eb noterin, por dhe p\u00ebr pal\u00ebt\/qytetar\u00ebt, t\u00eb cil\u00ebt kan\u00eb zgjedhur t\u00eb marrin sh\u00ebrbimet noteriale tek ai.<\/p>\n<p>Neni 61, bie ndesh me parashikimet e nenit 3\/f dhe 66, 75 t\u00eb k\u00ebtij ligji. Neni 61 nuk parashikon aspak se cilat jan\u00eb t\u00eb drejtat dhe detyrimet q\u00eb merr p\u00ebrsip\u00ebr z\u00ebvend\u00ebsnoteri gjat\u00eb periudh\u00ebs s\u00eb pezullimit t\u00eb noterit, se n\u00eb cil\u00ebn m\u00ebnyr\u00eb ai e ushtron k\u00ebt\u00eb veprimtari. \u00cbsht\u00eb krejt\u00ebsisht e paqart\u00eb n\u00ebse z\u00ebvend\u00ebsnoteri n\u00eb k\u00ebto kushte si administrator zyre i nj\u00eb noteri t\u00eb pezulluar do t\u00eb veproj\u00eb me licens\u00ebn e noterit t\u00eb pezulluar dhe me NUIS-in e tij, dhe n\u00ebse po, cili nga k\u00ebto do t\u00eb jet\u00eb p\u00ebrgjegj\u00ebs p\u00ebr veprimtarin\u00eb ekonomike, financiare, tregtare p\u00ebrball\u00eb detyrimeve tatimore dhe taksave lokale p\u00ebrkundrejt organeve tatimore q\u00ebndrore apo atyre vendore.<\/p>\n<p>Me paqart\u00ebsin\u00eb q\u00eb p\u00ebrmban ky nen, referuar mjeteve identifikuese q\u00eb p\u00ebrdoren nga z\u00ebvend\u00ebsnoteri pa p\u00eblqimin dhe autorizimin e noterit tij, krijohet nj\u00eb konfuzion, duke krijuar terren t\u00eb p\u00ebrshtatsh\u00ebm p\u00ebr keqkuptime dhe lindjen e mosmarr\u00ebveshjeve, midis organeve shtet\u00ebrore dhe noterit t\u00eb pezulluar, apo brenda vet sistemit noterial. Gjithashtu krjohen mund\u00ebsi abuzimi, ku pal\u00ebt t\u00eb cilat kan\u00eb p\u00ebrfituar apo kund\u00ebrshtojn\u00eb veprime noteriale t\u00eb kryera nga z\u00ebvend\u00ebsnoteri, mund t\u00eb kund\u00ebrshtojn\u00eb p\u00ebrmbajtjen e akteve duke v\u00ebn\u00eb n\u00eb dyshim v\u00ebrtet\u00ebsin\u00eb e tyre.<\/p>\n<p>Paqart\u00ebsia e parashikimeve t\u00eb nenit 61 t\u00eb ligjit nr. 110\/2018 krijon mund\u00ebsi q\u00eb t\u00eb cenohet parimi i liris\u00eb s\u00eb veprimtaris\u00eb ekonomike t\u00eb shtetasve, parim ky i cili g\u00ebzon mbrojtje t\u00eb ve\u00e7ant\u00eb nga neni 11 dhe 18 i Kushtetut\u00ebs. Nga analiza q\u00eb i b\u00ebhet p\u00ebrmbajtjes s\u00eb nenit 61 t\u00eb ligjit rezulton se n\u00eb form\u00ebn q\u00eb \u00ebsht\u00eb miratuar ai krijon terren q\u00eb n\u00eb praktik\u00eb k\u00ebto dy parime t\u00eb cenohen.<\/p>\n<p>N\u00eb rast se neni 61 i ligjit nr. 110\/2018, do t\u00eb aplikohet sipas p\u00ebrmbajtjes s\u00eb miratuar ku nj\u00eb tjet\u00ebr noter do t\u00eb administroj\u00eb zyr\u00ebn e nj\u00eb noteri t\u00eb pezulluar, \u00ebsht\u00eb e pritshme dhe ekziston rreziku q\u00eb gjith\u00eb at\u00eb marr\u00ebdh\u00ebnie besimi q\u00eb noteri i pezulluar ka krijuar, noteri administrator i zyr\u00ebs s\u00eb tij mund t\u00eb p\u00ebrpiqet ta transferoj\u00eb n\u00eb zyr\u00ebn e tij noteriale.<\/p>\n<p>Pra, krijohet rreziku q\u00eb nj\u00eb administrim i till\u00eb nga nj\u00eb noter tjet\u00ebr q\u00eb \u00ebsht\u00eb n\u00eb kushte konkurence t\u00eb krijoj\u00eb nd\u00ebrhyrje t\u00eb hapur n\u00eb aktivitetin e noterit t\u00eb pezulluar, por edhe tek raporti mes klientit dhe noterit, duke prishur hapur konkurenc\u00ebn e lir\u00eb dhe t\u00eb ndershme n\u00eb k\u00ebt\u00eb treg sh\u00ebrbimesh.<\/p>\n<p>Pik\u00ebrisht p\u00ebr k\u00ebto shkaqe neni 61 i ligjit nr. 110\/2018, referuar m\u00ebnyr\u00ebs se si ka p\u00ebrcaktuar t\u00eb trajtohet zyra e nj\u00eb noteri t\u00eb pezulluar gjat\u00eb koh\u00ebzgjatjes s\u00eb shkakut t\u00eb pezullimit duket se krijon terren q\u00eb n\u00eb praktik\u00eb t\u00eb shkelen nj\u00ebkoh\u00ebsisht t\u00eb dy parimet e \u201cbarazis\u00eb p\u00ebrpara ligjit\u201d dhe \u201cparimin e liris\u00eb s\u00eb veprimtaris\u00eb ekonomike t\u00eb shtetasve\u201d.<\/p>\n<ol>\n<li>Parashikimet e nenit 65 t\u00eb ligjit nr. 110\/2018 \u201cP\u00ebr noterin\u00eb\u201d, nuk garantojn\u00eb trajtim t\u00eb barabart\u00eb t\u00eb noter\u00ebve p\u00ebrball\u00eb kostos q\u00eb do t\u00eb duhet t\u00eb p\u00ebrballojn\u00eb p\u00ebr sigurimin e veprimtaris\u00eb s\u00eb tyre, si dhe mund t\u00eb krijoj\u00eb nj\u00eb deformim n\u00eb tregun e sigurimeve referuar sigurimit t\u00eb veprimtaris\u00eb s\u00eb noter\u00ebve.<\/li>\n<\/ol>\n<p>M\u00ebnyra se si \u00ebsht\u00eb formuluar p\u00ebrmbajtja e pik\u00ebs 1 t\u00eb k\u00ebtij neni, krijon shteg p\u00ebr interpretim. Konkretisht nuk del qart\u00eb kuptimi apo q\u00ebllimi i dispozit\u00ebs n\u00ebse noteri kontrat\u00ebn e sigurimit individual p\u00ebr sigurimin e veprimtaris\u00eb s\u00eb tij do t\u00eb duhet t\u00eb lidh\u00eb me t\u00eb nj\u00ebjt\u00ebn kompani sigurimi q\u00eb do t\u00eb p\u00ebrzgjedh\u00eb Dhoma Komb\u00ebtare e Noteris\u00eb n\u00eb rastin e sigurimit kolektiv apo \u00ebsht\u00eb i lir\u00eb ta p\u00ebrzgjedh\u00eb vet\u00eb kompanin\u00eb siguruese? Pra formulimi i pik\u00ebs 1 t\u00eb k\u00ebtij neni, krijon mund\u00ebsi interpretimi q\u00eb n\u00eb t\u00eb dy rastet, qoft\u00eb p\u00ebr sigurimin kolektiv, apo p\u00ebr lidhjen e nj\u00eb kontrate sigurimi individual kompania p\u00ebrzgjidhet nga Dhoma Komb\u00ebtare e Noteris\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, nga ana e teknik\u00ebs legjislative pika 1 e nenit 65 ka nevoj\u00eb p\u00ebr p\u00ebrmir\u00ebsim, duke qart\u00ebsuar n\u00eb m\u00ebnyr\u00eb eksplicite se noteri ka t\u00eb drejt\u00eb t\u00eb zgjedh\u00eb n\u00eb tregun e lir\u00eb kompanin\u00eb e sigurimeve ku ai d\u00ebshiron t\u00eb siguroj\u00eb aktivitetin e tij, n\u00ebse Asambleja e P\u00ebrgjithshme nuk ka miratuar me vendim lidhjen e nj\u00eb kontrate kolektive. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb do t\u00eb mund t\u00eb bjer\u00eb \u00e7do dyshim apo do t\u00eb shmanget \u00e7do mund\u00ebsin\u00eb e intepretimit n\u00eb praktik\u00eb t\u00eb k\u00ebsaj dispozite.<\/p>\n<p>N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, n\u00ebse do t\u00eb aplikohet dhe do t\u00eb vendoset nga Asambleja e P\u00ebrgjithshme e Noter\u00ebve nj\u00eb kontrat\u00eb sigurimi kolektiv, dispozitat e nenit 65 t\u00eb ligjit, duhet t\u00eb rishikohen n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb parashikojn\u00eb n\u00eb m\u00ebnyr\u00eb shteruese m\u00ebnyr\u00ebn edhe t\u00eb p\u00ebrballimit t\u00eb kostos s\u00eb k\u00ebtij primi sigurimi, n\u00eb p\u00ebrputhje me nivelin e transaksioneve t\u00eb realizuar n\u00eb vitin paraardh\u00ebs, gjithashtu duke iu referuar historikut t\u00eb procedimit disiplinor t\u00eb secilit noter.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, p\u00ebr t\u00eb mos krijuar nj\u00eb situat\u00eb disi monopolizuese apo q\u00eb t\u00eb mund t\u00eb deformoj\u00eb konkurenc\u00ebn n\u00eb shoq\u00ebrit\u00eb e sigurimit, p\u00ebr sigurimin e aktivitetit t\u00eb t\u00eb gjith\u00eb noter\u00ebve me nj\u00eb shoq\u00ebri sigurimi, si dhe p\u00ebr t\u00eb garantuar plot\u00ebsisht t\u00eb drejtat e noter\u00ebve si persona t\u00eb siguruar, \u00ebsht\u00eb e nevojshme q\u00eb neni 65 i ligjit, t\u00eb riformulohet ku ve\u00e7 t\u00eb tjerave t\u00eb parashikohet roli asistues dhe mbikqyr\u00ebs i Byros\u00eb Shqiptare t\u00eb Sigurimeve dhe Autoritetit t\u00eb Mbikqyrjes Financiare, me q\u00ebllim aplikimin e nj\u00eb kontrate kolektive apo individuale sigurimesh q\u00eb t\u00eb garantoj\u00eb trajtim objektiv t\u00eb secilit noter, si dhe asnj\u00eb deformim n\u00eb tregun e sigurimeve.<\/p>\n<ol>\n<li>Neni 76 i ligjit nr. 110\/2018, nuk \u00ebsht\u00eb i qart\u00eb, nuk ofron siguri ligjore p\u00ebr mbrojtjen dhe mb\u00ebshtetjen e shtresave t\u00eb pamunduara t\u00eb shoq\u00ebris\u00eb p\u00ebr t\u00eb p\u00ebrballuar tarifat dhe shpenzimet noteriale, apo t\u00eb kategorive t\u00eb ve\u00e7anta t\u00eb shoq\u00ebris\u00eb.<\/li>\n<\/ol>\n<p>Sh\u00ebrbimi noterial sipas legjislacionit ton\u00eb \u00ebsht\u00eb i domosdosh\u00ebm dhe n\u00eb disa raste \u00ebsht\u00eb i detyruesh\u00ebm p\u00ebr t\u00eb konfirmuar v\u00ebrtet\u00ebsin\u00eb e fakteve, rrethanave, apo vullnetit t\u00eb shtetasve gjat\u00eb kryerjes s\u00eb nj\u00eb veprimi juridik, apo p\u00ebrgjat\u00eb ndjekjes s\u00eb nj\u00eb procesi ligjor, qoft\u00eb ky civil, administrativ, apo penal.<\/p>\n<p>N\u00eb k\u00ebto kushte, klient apo konsumator t\u00eb k\u00ebtij sh\u00ebrbimi n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb, jan\u00eb t\u00eb gjitha shtresat e shoq\u00ebris\u00eb, si shtetasit me t\u00eb ardhura t\u00eb mira dhe me aft\u00ebsi paguese, shoq\u00ebrit\u00eb tregtare, institucionet publike, ashtu dhe shtresat m\u00eb nevojtare, apo kategori t\u00eb ve\u00e7anta t\u00eb shoq\u00ebris\u00eb t\u00eb cilat mund t\u00eb gjenden n\u00eb pamund\u00ebsi, apo n\u00eb nj\u00eb sforcim p\u00ebr t\u00eb p\u00ebrballuar tarifat e sh\u00ebrbimeve noteriale q\u00eb n\u00eb raste t\u00eb caktuara jan\u00eb t\u00eb detyrueshme.<\/p>\n<p>Neni 71 i ligjit n\u00eb form\u00ebn e miratuar, mund t\u00eb ngelet n\u00eb praktik\u00eb nj\u00eb dispozit\u00eb deklarative dhe e pazbatueshme, pasi nuk parashikon asnj\u00eb detyrim p\u00ebr noterin p\u00ebr t\u00eb ofruar nj\u00eb sh\u00ebrbim me tarifa t\u00eb ulura. Sipas p\u00ebrmbajtjes s\u00eb ketij neni duket sikur ulja e tarifave do t\u00eb ngelet rast p\u00ebr rasti n\u00eb diskrecion t\u00eb vullnetit t\u00eb noterit dhe jo si nj\u00eb detyrim p\u00ebr t\u00eb. Pik\u00ebrisht ky parashikim i paqart\u00eb, nuk garanton se shtresat n\u00eb nevoj\u00eb dhe respekivisht kategorit\u00eb e personave p\u00ebrfitues t\u00eb ndihm\u00ebs juridike do t\u00eb mund t\u00eb p\u00ebrfitojn\u00eb ndonj\u00ebher\u00eb ulje t\u00eb tarifave. P\u00ebr m\u00eb tep\u00ebr edhe vet shprehja \u201cdhe vet\u00ebm n\u00eb rast nevoje\u201d, \u00ebsht\u00eb shum\u00eb evazive, pasi kjo do t\u00eb ngelet n\u00eb kuptueshm\u00ebrin\u00eb dhe nd\u00ebrgjegj\u00ebsimin e secilit noter p\u00ebr ta vler\u00ebsuar dhe jo si detyrim, \u00e7ka krijon terren q\u00eb n\u00eb praktik\u00eb kjo dispozit\u00eb t\u00eb ngelet nj\u00eb dispozit\u00eb e pa aplikuar.<\/p>\n<p>P\u00ebr arsyet e parashtruara m\u00eb sip\u00ebr, n\u00eb bindje t\u00eb Kushtetut\u00ebs, dhe n\u00eb ushtrim t\u00eb s\u00eb drejt\u00ebs t\u00eb parashikuar n\u00eb pik\u00ebn 1 t\u00eb nenit 85 t\u00eb saj, Presidenti i Republik\u00ebs, ka vler\u00ebsuar se p\u00ebr ta b\u00ebr\u00eb k\u00ebt\u00eb norm\u00eb t\u00eb re ligjore edhe m\u00eb t\u00eb mir\u00eb, dhe p\u00ebr t\u00eb mos krijuar asnj\u00eb hap\u00ebsir\u00eb q\u00eb n\u00ebp\u00ebrmjet intepretimeve t\u00eb ndryshme, apo keqzbatimit n\u00eb praktik\u00eb ky ligj i ri t\u00eb cenoj\u00eb parimet kushtetutese, me Dekretin nr. 11 0154, dat\u00eb 14.01.2019, Presidenti ka vendosur kthimin p\u00ebr rishqyrtim t\u00eb ligjit nr.110\/2018 \u201cP\u00ebr noterin\u00eb\u201d, me q\u00ebllim rishikimin nga Kuvendi t\u00eb neneve 61, 65, 76 t\u00eb k\u00ebtij ligji.<\/p>\n<p>Argumentet e shtjelluara mbi kthimin p\u00ebr rishqyrtim t\u00eb neneve 61, 65 dhe 76 t\u00eb ligjit nr. 110\/2018 \u201cP\u00ebr noterin\u00eb\u201d, mund t\u2019i gjeni t\u00eb botuara n\u00eb faqen zyrtare t\u00eb Institucionit t\u00eb Presidentit t\u00eb Republik\u00ebs.<\/p>\n<h1><\/h1>\n","protected":false},"excerpt":{"rendered":"<p>Presidenti i Ilir Meta ka dekretuar kthimin p\u00ebr rishqyrtim n\u00eb Kuvend t\u00eb ligjit p\u00ebr Noter\u00ebt.
