The Prosecutor’s Office of Tirana has appointed foreign experts to determine the cause of death of 3-year-old Brian Spahiu, as according to her the first forensic expertise was incomplete.
The minor died after dental intervention in the private clinic of doctor Roland Xhaxho a few months ago.
After News24 became aware of this fact, it addressed an official letter to the Prosecutor’s Office of Tirana, which confirmed this and explained the reasons why such a decision was made.
According to the prosecutors, the first act of expertise was incomplete and the conclusion was incorrect, while there are no experts in the field to provide answers to all the questions.
It is also clarified that specialist doctors in our country are in a conflict of interest with the persons under investigation, including the doctor Roland Xhaxho.
“On the part of the prosecutor of the case, it has been decided to carry out a forensic re-examination and an additional forensic examination, appointing a group of foreign experts, for the following reasons:
1-The act of forensic examination carried out by the experts of the IML is incomplete, unfounded and there are significant deficiencies in the conclusions reached regarding the cause of death of the minor B.S.;
2- From the investigations and questioning of the experts who undertook and carried out this act, it was found that they are not specialized and do not have special knowledge in the subject areas of the expertise, and in reaching the conclusion that they presented in the act of expertise did not carry out consultations with other doctors specialized in these fields.
3- The performance of the forensic re-examination that determines the cause of death is a necessary condition for the performance of additional forensic expertise, to determine if there is a violation of the rules of medical protocol and deontology by all doctors and medical staff (dentist, anesthetist, etc.) who performed the relevant interventions, treated and treated the minor B.S.
4- In order to verify the circumstances of the commission of the criminal offense and the individualization of concrete criminal responsibilities, and based on the fact that in this case the research and evaluations are very complex and require different knowledge in several branches of medicine, it is necessary to appoint several experts for the execution of forensic re-expertise and additional expertise.
5- The Institute of Forensic Medicine does not have specialized experts in all the fields subject to the aforementioned expertise.
6- Other doctors who are specialized in these fields in Albania, are in a limited number and exercise the function of a doctor in medical institutions, where they have worked with the doctors involved in the investigation and are familiar with them, influencing in this way in the impartiality and objectivity of the performance of the expertise by them.
Currently, we are waiting for the completion of the legal procedures for sending the decision by mail to foreign legal authorities”, says the response to News24.
