Olsi Rama, the brother of Prime Minister Edi Rama has reported to SPAK, the head of the DP Group, Gazment Bardhi, whom he accuses of “false report”.
In a document filed today, Oslai Rama emphasizes that untrue facts were declared on television, which he says were not consumed by him.
“Dear Mr. Prosecutor,
I, the complainant Ols Rama, have been made aware during these days of some untrue statements on a television show about me, made by a deputy of the Assembly of the Republic of Albania, the accused Mr. Gazment Bardhi.
Because the statements made, in my estimation, contain the elements of the criminal offense of “False Report”, provided for by Article 305 of the Criminal Code, and first of all affect me as a person and give me the status of a victim of a criminal offense, based in articles 58 and 283 of the Code of Criminal Procedure, I submit this criminal report in writing, presenting the factual circumstances as well as the legal reasoning as follows:
I. Circumstances of the fact The accused Gazment Bardhi is a deputy of the Assembly of the Republic of Albania and on March 28, 2024 he was invited to the show “Opinion” on the national television “Klan”.
From an objective point of view, it turns out that the accused has presented false evidence in a program shown on a national television. He has acted publicly in this way, with the intention of starting a criminal proceeding against me, for untrue and unconsummated facts on my part.
With this behavior, the accused has violated the regular and normal activity of the justice bodies, but also my rights to freedom as an individual, protected by criminal legislation.
From the subjective point of view, the creation of these evidences was done directly by the accused, as he is aware of their untruth and deliberately aims to present them to the investigative bodies so that criminal proceedings can be initiated against me, the complainant. . In view of the legal criteria, the accused fulfills the conditions to be considered the subject of this crime.
As mentioned above, and based on Article 287/1 in relation to Article 58/1, letter a, of the Code of Criminal Procedure, I request the registration of criminal proceedings against Mr. Gazment Bardhi, Member of Parliament, for committing the criminal offense of “False reporting, provided for as such by Article 305 of the Criminal Code
I remain at your disposal to give statements for the benefit of this investigation, any other data, written or not, valid for the continuation of the investigative actions”, emphasizes Olsi Rama.
