The Special Court has accepted SPAK’s request, passing for trial 3 former Inspectors of the Ministry of Environment and 2 doctors.
It is about the inspectors, Ilir Nishani, the brother of former President Bujar Nishani, Genci Hickë and Gerson Tafa, who are accused of passive corruption, and the two doctors, Kostandin Balloma and Besim Boçi.
The two doctors Balloma and Baçi will be tried for active corruption, while the three former officials will be tried for “Passive corruption of persons exercising public functions.”
Hicka, Tafa and Nishani were inspectors of the Ministry of Environment and they had asked the clinic where Balloma and Boçi worked, 30,000 Lek so that they would not be fined for the treatment of hospital waste.

The Special Prosecutor’s Office against Corruption and Organized Crime on 29.12.2023 submitted to the Court the request with the object: Sending to court the criminal case that belongs to the criminal proceeding with No. 84, of 2020, in charge of the defendants Genci Hicka, Ilir Nishali and Gerson Tafa, who are accused of the criminal offense “Passive corruption of persons exercising public functions” committed in cooperation provided by article 259 and 25 of the Criminal Code, as well as in charge of the defendants Konstandin Balloma and Besim Boīi who are accused of the criminal offense “Active corruption of persons exercising public functions” committed in cooperation provided by article 244 paragraph 1 and 25 of the Criminal Code.
In the session of 12.02.2024, the Special Court of First Instance for Corruption and Organized Crime (preliminary session) with a panel composed of judge Erjon Bani, after examining the claims of the parties, with decision No. 39 The Basic Register, dated 12.02.2024 decided:
Acceptance of the request of the Special Prosecutor’s Office against Corruption and Organized Crime.
Sending to court the criminal case that belongs to the criminal proceeding with No. 84, of 2020, in charge of the defendants:
Genci Hicka, who is accused of the criminal offense of “Passive corruption of persons exercising public functions” committed in cooperation provided by article 259 and 25 of the Criminal Code;
Ilir Nishani, who is accused of the criminal offense of “Passive corruption of persons exercising public functions” committed in cooperation provided by article 259 and 25 of the Criminal Code;
Gersion Tafa, who is accused of the criminal offense “Passive corruption of persons exercising public functions” carried out in cooperation provided by article 259 and 25 of the Criminal Code;
Konstandin Balloma, who is accused of the criminal offense “Active corruption of persons exercising public functions” carried out in cooperation provided by article 244 paragraph 1 and 25 of the Criminal Code;
Besim Boīi, who is accused of the criminal offense of “Active corruption of persons exercising public functions” committed in cooperation provided by article 244 paragraph 1 and 25 of the Criminal Code;
No appeal is allowed against this decision.
